Requirements on the road

To ensure you stay safe and compliant on the road, you’ll need to stay informed on the WA regulatory requirements. The following is a summary of some of the new WA On-Demand Transport Regulations. It is intended as a guide only. Please take the time to read and understand your obligations under these regulations.

WA On-Demand Transport Regulations

1. Display Sticker/Sign

When you are online, you must display a sign indicating that your vehicle is being used to provide passenger services on the Uber app.

To help with this, we’ve made available removable Uber stickers. Under the Regulations, these stickers must be displayed on the left side of your rear windscreen whenever you’re driving with the Uber app.

If a sign is not properly displayed, or if it’s not visible while you’re driving with the Uber app (day or night), you could be issued with a fine by local authorities.

2 Reporting incidents

All notifiable occurrences (incidents) must be reported to Uber.

So, what is a notifiable occurrence? A notifiable occurrence includes any mechanical failures, accidents or injuries that occur during your ride, and/or any situation in which ambulance or Police are involved. This includes incidents that occur when a rider is in the vehicle, when you’re on your way to pick up a rider or when you have just dropped off a passenger. We may then report any notifiable occurrence to the WA Department of Transport. For more information on notifiable occurrences, please see the WA regulations.

3. Vehicle inspections and maintenance

To make sure that all vehicles driving with Uber are safe and properly registered for ride-sharing, your vehicle inspection must undergo an inspection every year, regardless of vehicle age.

Another important aspect of vehicle safety is regular maintenance, and under the WA Regulations, you’re required to ensure your vehicle is regularly maintained as per the manufacturer’s recommendations, with any major maintenance and repairs performed by a licensed mechanic.

4. Change in circumstances

We understand that circumstances change, but it’s important that you notify the Department of Transport if your circumstances change in a way that adversely affects (1) your good character; and/or (2) your mental or physical fitness to drive a vehicle.

The WA Regulations state that this notice must be given within seven (7) days of you becoming aware of your change in circumstances.

5. Ongoing eligibility as an Uber driver-partner in WA

To continue driving with Uber in WA, you’ll need to continue to meet certain regulatory requirements, which include:

  • holding an active driver’s licence in WA, with a charter vehicle (F) extension; and
  • holding an active Passenger Transport Vehicle (PTV) authorisation (OD-C)

Please note that we need to stay up to date with all driver-partners’ abilities to meet these regulatory standards, so we run regular checks on your WA Driver’s Licence number and Vehicle Licence Plate using the Department of Transport Driver Dashboard and Vehicle Dashboard.

You won’t be able to drive using the Uber app in WA if you do not consent to us running checks against your driver’s licence and vehicle licence plate. 6. Obligations for passenger services generally

You’ll need to also be aware of some specific offences that exist under WA regulations regarding:

  • Behaving in an orderly manner;
  • Refusing to pick up a passenger with an assistance animal; and
  • Touting or soliciting for passengers.

It’s up to all WA driver-partners to understand and follow these regulations so we can continue to provide a safe and reliable service on the Uber platform.

7. Cameras (e.g ‘dash cams’)

If you drive with Uber, you are not required to have a camera installed in your vehicle. As an independent provider of transport however, you may choose to do so.

If you do choose to use a camera (e.g. a dash cam) that records inside your vehicle, WA regulations require you to:

  • display a sign inside at the front of the vehicle in the clear view of riders advising them that they may be under camera surveillance while in the vehicle;
  • not misplace or use any camera recording for unauthorised purposes (authorised uses of camera system recordings are outlined in the WA regulations); and
  • provide a copy of your camera recording to Police or DOT, when asked.

These obligations apply to both audio and visual recordings inside a vehicle. This means that even if you are using a forward facing dash cam ( i.e a camera that faces the front windscreen), if that device can record audio within your vehicle, you must comply with these legal obligations.
