Additional Terms – Uber Rent

1. About Us

We are Uber London Limited, a private limited liability company established in the United Kingdom having its offices at Aldgate Tower - First Floor, 2 Leman Street, London, E1 8FA with registered number 08014782 (“Uber”, ”us”, "we"). You can contact us at help.uber.com and +44 808 189 7190.

1. Uber Rent Terms
   1. These Uber Rent Terms and Conditions (“Uber Rent Terms”) govern your access and use of the portal made available by Uber and powered by CarTrawler or third party car rental agencies, that enable users to search for rental cars through a third party booking engine powered by CarTrawler or car rental agency and make car rental reservations with third party providers (“Service Providers”) of rental cars and applicable products and services through the Uber platform (“Uber Rent”). Uber is not responsible for the products and services provided by third parties, which in this case includes the web application powered by CarTrawler or third party car rental agencies, the cars being offered for rent or any applicable products or services, or for the terms and conditions (including financial terms) under which those products and services are offered. Uber will not verify and cannot guarantee that all information is accurate, complete, or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade, or maintenance of our platform or otherwise), inaccurate, misleading, or untrue information, nor non-delivery of information.
   2. Please read these Uber Rent Terms carefully prior to using Uber Rent. By using Uber Rent you confirm your agreement to be bound by the Uber Rent Terms. If you do not agree to the Uber Rent Terms, you may not access or use Uber Rent.
   3. Uber may immediately terminate these Uber Rent Terms or Uber Rent with respect to you, or generally cease offering or deny access to Uber Rent or any portion thereof, at any time for any reason.
   4. Capitalised terms used in this Uber Rent Terms but not defined have the meanings given to them in the UK General Terms of Use.
2. Other terms apply
   1. Where you choose to use and access Uber Rent, the UK General Terms of Use apply.
   2. Your access and use of Uber Rent is also governed by CarTrawler’s Terms and Conditions, as well as all other applicable terms, conditions, policies, limitations and requirements, including, if you rent a car through Uber Rent, the terms and conditions of any Service Providers governing that rental.
   3. If, and then only to the extent that the UK General Terms of Use, or other applicable terms are inconsistent with these Uber Rent Terms, these Uber Rent Terms will prevail only with respect to Uber Rent.
3. Service Provider terms and conditions
   1. By using Uber Rent, you enter into a direct, legally binding contractual relationship with the Service Provider with whom you make a reservation or purchase a product or service, under the Service Provider's applicable terms and conditions.
   2. Uber acts solely as an intermediary between you and the Service Provider, transmitting the relevant details of your reservation to the Service Provider. You agree to comply with all terms and conditions imposed by any Service Provider with whom you select to rent a car, including, but not limited to, payment of all amounts when due, and compliance with the Service Provider’s rules and restrictions regarding availability, fares, and use of products or services.
   3. We strongly advise that you read these Service Provider terms and conditions carefully.
   4. Uber does not provide the car rental service and is not a party to your contract with the Service Provider. You acknowledge that your ability to obtain car rentals through the use of Uber Rent does not establish Uber as a (i) rental car company; (ii) a provider of transportation, logistics or delivery services, or (iii) as a transportation carrier. You further acknowledge that all such car rental, transportation, or logistics services are provided by third party car rental agencies or their independent or franchise operators who are not employed by Uber or any of its affiliates. You agree that Uber has no responsibility or liability to you related to any such Third Party Services other than as expressly set forth in these Uber Rent Terms.
4. Privacy
   1. Uber collects, uses and discloses personal data from or about you as described in Uber’s Privacy Notice.
   2. We also share your personal data with the Service Provider(s) as necessary to enable your use of Uber Rent. By using Uber Rent, you are also acknowledging that you have read and understood the Uber & Car Rental Company Data Sharing Policy.
   3. Service Providers will process your personal data in accordance with their own privacy practices and processes. Uber is not responsible for these and do not control the privacy and security of your information that may be held by Service Providers.
5. Content displayed on Uber Rent
   1. Service Providers may advertise, market, sell, promote, and/or offer, as applicable, cars, goods and services for rent, through which you can discover, search, compare, and make a reservation. These are Third Party Services under the UK General Terms of Use.
   2. The information displayed on Uber Rent is based on the information provided to us by CarTrawler or car rental agencies and fulfilled by Service Providers. As such, although we will use reasonable skill and care in offering Uber Rent, we will not verify and cannot guarantee that all information is accurate, complete, or correct, nor can we be held responsible for any errors including manifest and typographical errors, any interruptions, repair, upgrade, or maintenance of our platform or otherwise, inaccurate, misleading, or untrue information, nor non-delivery of information. Each Service Provider remains responsible at all times for the accuracy, completeness, and correctness of the information, including the rates, fees, prices, policies, conditions, availability and other relevant information that gets displayed on Uber Rent.
   3. Uber Rent is made available for personal and non-commercial use only. Therefore, you are not allowed to resell, deep link, use, copy, monitor (e.g. spider, scrape), display, download, or reproduce any content or information, software, reservations, tickets, products, or services available on Uber Rent for any commercial or competitive activity or purpose.
6. Uber Rent Requirements
   1. As a condition of your use of Uber Rent, you warrant that:
      1. you are at least 21 years old;
      2. you possess a valid driver’s licence that can be used in the UK and will be the primary driver on any rental car you reserve through Uber Rent;
      3. you will use Uber Rent in accordance with these Uber Rent Terms and UK General Terms of Use;
      4. you will only use Uber Rent to make legitimate reservations for non-commercial purposes;
      5. you will only supply information that is true, accurate, current and complete;
      6. you will not authorize third parties to use your account to access and use Uber Rent;
      7. you agree to comply with all applicable laws when accessing or using Uber Rent;
      8. you will only access or use Uber Rent for lawful purposes; and
      9. you will not in your access or use of Uber Rent cause nuisance, annoyance, inconvenience, or property damage, whether to Service Providers or any other party.
7. Fees and Payment
   1. In order to book an Uber Rent reservation, you will be required to provide a payment method for the rental car (including optional products and services) at the time of booking.
   2. All rentals will require prepayment. You may choose to prepay for the rental car in the Uber App using a payment method associated with your account. All such prepaid rental car charges and fees, including optional products and services, will be subject to the Service Provider’s applicable terms and conditions. Any fee disputes or customer service issues for prepaid rental cars may be addressed through the Uber Help Channels.
   3. Please see the Charges and Payment section of the UK General Terms of Use for additional terms regarding payments.
   4. Service Provider may charge additional fees or surcharges under their applicable terms and conditions. For example, extra charges may apply if a driver is aged below 25. Please check the Service Provider terms and conditions carefully.
   5. Fees charged in connection with Uber Rent do not include fees that may be charged by your bank. Please contact your bank directly for inquiries.
8. Cancellations and refunds
   1. Depending on the applicable Service Provider's terms and conditions, you may be able to cancel your rental car reservation, with or without a fee. It is important that you check the Service Provider terms and conditions directly at the time of reservation for these details.
   2. For pre-paid reservations, if permitted by the Service Provider terms and conditions, you can request refunds and make changes to your reservation online via the Uber app. If you need further support, you may reach out to Uber via customer phone support channel or https://help.uber.com/ (“Uber Help Channels”).
   3. The Service Provider may charge you a fee to change, cancel or refund your reservation, as set out in the Service Provider terms and conditions. If so, in relation to pre-paid reservations, Uber will charge these to you.
   4. Notwithstanding the foregoing, at a Service Provider’s sole discretion, a Service Provider may refuse to rent a car, cancel a rental reservation after acceptance, or attempt to arrange alternate scheduling or reservation plans for any reason consistent with the Service Provider’s terms and conditions. In the event that you dispute any decision made by a Service Provider regarding your car rental, you agree to work directly with the Service Provider to resolve the dispute. Uber has no responsibility or liability for the decisions made by Service Providers.

9. Insurance
   1. Any insurance in connection with the car rental will be subject to the terms agreed between you and the service provider(s).
10. Disclaimer
    1. Uber Rent is provided "as is" and "as available." Uber disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these Uber Rent Terms, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. In addition, Uber makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of Uber Rent or any services or goods provided through Uber Rent by Service Providers, or that Uber Rent will be uninterrupted or error-free. Uber will not be responsible for any inaccuracy relating to the information displayed on Uber Rent, including rates and availability of the Service Provider as made available on Uber Rent. Uber does not guarantee the quality, suitability, safety or ability of Service Providers.
    2. Uber Rent does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification, rating, or type of accommodation of any Service Provider or its facilities, venue, vehicles, products or services made available, unless explicitly indicated otherwise.
11. Your liability and indemnity
    1. You are liable for any damage suffered by us as a result of your violation of the Uber Rent Terms, your misuse of the Third Party Services provided in connection with Uber Rent or your violation of any laws or third party rights. You are liable for all activities conducted through your account unless such activities are not authorised by you and you are not otherwise negligent.
    2. You agree to indemnify, defend (at our option) and hold us and our respective officers, directors, and employees harmless from and against all claims, liabilities, expenses, damages, penalties, fines, social security contributions and taxes arising out of or in connection with: (i) your breach of any of these Uber Rent Terms; (iii) your breach of applicable law; (v) any third party claims directly or indirectly related to your use of Uber Rent and/or the Third Party Services, including from Service Providers, in each case to the extent the such are not directly caused by Uber’s or its affiliates actions.
12. Limitation of Liability
    1. Nothing in these Uber Rent Terms limits or excludes any liability which cannot legally be limited or excluded, including liability for death or personal injury caused by our negligence and liability for fraud or fraudulent misrepresentation or alters your rights as a consumer that cannot be excluded under applicable law.
    2. Uber, its affiliates, directors, officers, employees, workers, agents and/or subcontractors are not liable for any damages, losses or costs arising out of or in connection with:
       1. the Third Party Services provided or offered in connection with Uber Rent by Service Providers, including but not limited to the condition or availability of rental cars;
       2. any acts, errors, omissions, representations, warranties or negligence of any Service Providers;
       3. any personal injuries, death, property damage or other damages or expenses resulting from section 13.2.1 and 13.2.2;
       4. any transaction between you and any Service Provider or other business partner in connection with Uber Rent;
       5. any unavailability of, or inaccuracy relating to, the information displayed on Uber Rent (including rates, availability, and ratings) of the Service Provider; or
       6. any delay or failure in performance resulting from causes beyond Uber's reasonable control.
    3. Uber, its affiliates, directors, officers, employees, workers, agents and/or subcontractors are not liable for any: (i) loss of profits; (ii) loss of sales or business; (iii) loss of agreements or contracts; (iv) loss of anticipated savings; (v) loss of use or corruption of software, data or information; (vi) loss of or damage to goodwill and (vii) indirect or consequential loss, in each case arising from your use of or reliance on, or inability to use or access, or delay of Uber Rent, whether based in contract, tort (including negligence, misrepresentation), breach of statutory duty, restitution or otherwise, and even if Uber have been advised of the possibility of such damages.
    4. Please see the Limitation of Liability section of the UK General Terms of Use for details on the limit of our total liability to you under these Uber Rent Terms.
13. Changes to these Uber Rent Terms

Uber may in its sole discretion change the Uber Rent Terms or any aspect of Uber Rent, or cancel Uber Rent at any time without notice to you. To the maximum extent permitted by law, your continued use of Uber Rent after the effective date of the revised Uber Rent Terms constitutes your acceptance of the terms. If you do not agree with the changes, you are free to stop using Uber Rent at any time.

1. Dispute Resolution

In the event of a dispute, we would ask you to raise a complaint using the contact details in the “About Us” section above. In the unlikely event that we cannot resolve the dispute, we will work with you to discuss a way forward to resolve the dispute, which may include mediation. Uber's right to refer the dispute to a court is expressly reserved. Uber does not commit to using an online dispute resolution platform to resolve consumer disputes.

1. General
   1. Terms not expressly provided herein are governed by the UK General Terms of Use.
   2. The invalidity of any provisions in these Uber Rent Terms does not affect the validity and enforceability of the rest of these Uber Rent Terms. Any such invalid, illegal or unenforceable provisions shall be deemed deleted.
   3. Uber’s failure to enforce any right or provision in these Uber Rent Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Uber in writing
   4. Uber may assign, subcontract or transfer these Uber Rent Terms or any of our rights or obligations in them, in whole or in part, without your prior consent, provided this will not lead to a reduction of the rights you are entitled to by virtue of these Uber Rent Terms or by law. We will tell you if this happens. You may not assign, subcontract or transfer these Uber Rent Terms.
