Deactivation Circumstances and Consequences

The circumstances that may warrant a deactivation are outlined in the Deactivation Webpage and contained in the Community Guidelines, both of which are incorporated as part of Uber’s deactivation policy for Seattle delivery people, and are reasonably related to Uber’s safe and efficient operations. Unless otherwise specified, deactivations may result in permanent loss of access to the Uber platform.

Per Seattle’s App-Based Worker Deactivation Rights Ordinance, Uber cannot deactivate a delivery person for any of the following reasons:

  • Availability to work or number of hours worked
  • Acceptance or rejection of any individual offer, any types of offers, or any number or proportion of offers
  • Cancellation of an offer “with cause” as defined in Seattle Municipal Code Section 8.37.020
  • Contacting Uber
  • Solely due to a quantitative metric derived from aggregate customer ratings of your performance
  • Statements regarding compensation and/or working conditions made to customers, other delivery people, network companies, the media, public officials, and/or the public
  • Asserting your legal rights, whether in court or via procedures provided by government agency
  • Results of a background check, consumer report, driver record, or record of traffic infractions, except in cases of egregious misconduct or where required by other applicable law

Any deactivation that is intended to or results in discrimination or a discriminatory act is impermissible.

A temporary suspension lasting less than 48 hours when the Uber platform is unavailable to a delivery person due to reasons unrelated to the action or behavior of the delivery person and that is clearly communicated to the courier at the time of the temporary suspension is not a deactivation. Some examples include:

  • Technology, software, or network outages
  • Account access, security, or safety issues
  • Routine maintenance
  • Inclement weather

From time to time your account may require your attention or other action by you to resolve access or security issues. When this happens, it is not a deactivation. 

Uber may immediately deactivate a delivery person if such action is required to comply with any applicable court order or local, state, or federal laws or regulations, or where a delivery person has engaged in egregious misconduct.

Egregious misconduct means an action or behavior by a delivery person that: (1) endangers the physical safety of a customer, or a third person, Uber, or an animal; or (2) intentionally causes economic harm to a customer, a third person, or Uber; or (3) is threatening, harassing, or abusive to a customer, a third party, or Uber. Egregious misconduct includes but is not limited to: assault, sexual assault, sexual harassment, hate crimes, racial slurs, kidnapping, unlawful possession of a firearm, solicitation of any sexual act, registration as a sex offender, stalking, theft, fraud, robbery, burglary, money laundering, driving related crimes pursuant to Revised Code of Washington (RCW) 46.61.500 through 46.61.540 as amended, failing to maintain a valid state driver’s license, and other conduct that would constitute a Class A felony offense under Title 9 or 9A RCW as amended.

Notice of Deactivation

For a deactivation not involving egregious misconduct, Uber will provide a notice of deactivation 14 days in advance of the deactivation and upon the effective date of deactivation. For a deactivation involving egregious misconduct, Uber will provide a notice of deactivation no later than the effective date of the deactivation.

Deactivation Challenge Procedure

If you are deactivated, you have the right to challenge the deactivation. Details of the deactivation challenge procedure will be provided along with the notice of deactivation.
