The following outlines the Notice of Rights provided by Uber Technologies, Inc. (Uber), pursuant to Seattle Municipal Code (SMC) Chapter 8.40. This Notice of Rights is applicable to covered app-based workers, as defined by SMC 8.40.
Pursuant to SMC 8.40, covered app-based workers have the right to:
1. Challenge an unwarranted deactivation through Uber’s internal deactivation challenge procedure and/or through other avenues pursuant to SMC 8.40.060, subject to coverage eligibility under SMC 8.40.030.A;
2. The policy describing the deactivation challenge procedure pursuant to SMC 8.40.060.B;
3. 14 days’ notice of an impending deactivation, except in the case of egregious misconduct;
4. Access any and all records relied upon by Uber to substantiate deactivation, pursuant to SMC 8.40.080;
5. Be protected from retaliation for exercising in good faith the rights protected by SMC 8.40; and
6. File a complaint with the Seattle Office of Labor Standards consistent with SMC 8.40.130 or bring a civil action for violation of the requirements of SMC 8.40
