Postmates, LLC. (“Postmates”) is sponsoring the Postmates and LAFC Sweepstakes (the “Sweepstakes”). The Sweepstakes is subject to these official rules (the “Official Rules”), and by participating, you (“Entrant”) agree to be bound by them and the decisions of Postmates, which are final and binding in all respects.
NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW OR RESTRICTED BY LAW.
1. Eligibility: In order to be eligible, Entrants must be (i) a legal U.S. resident (ii) at least eighteen (18) years of age; (iii) have an active, valid Postmates account; and (iv) reside in the Los Angeles, CA service market areas where Postmates operates and within at least seventy-five (75) miles of BMO Stadium. Void where prohibited by law. Employees, officers and representatives, and the immediate family members of such employees (i.e., parent, spouse, siblings, children, grandparents, step parents, step children and step siblings, and their respective spouses, and those living in the same household, whether or not related) of Postmates, Los Angeles Football Club, LAFC Sports, LLC, Major League Soccer, L.L.C., Soccer United Marketing, LLC, or any of their affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising and promotion agencies, webmasters and any company involved in the creation, design, execution, production, or fulfillment of the Sweepstakes (collectively, the “Sweepstakes Entities”) are not eligible to enter. Additionally, individuals who are employed by any local, state or federal government office or agency, elected officials and individuals listed on the OFAC Specially Designated Nationals and Blocked Persons (SDN) List are not eligible to enter or win. The Sweepstakes is subject to all applicable federal, state, and local rules, laws, and regulations.
2. How to Enter: During the Sweepstakes Period (as defined below), there are two (2) ways to enter the Sweepstakes:
Order with Postmates: Open the Postmates app (“Postmates app”), enter the promo code LAFC23 in the “Payment” section of the Postmates app before placing your order of $30.00 or more (before taxes and fees) to receive one (1) entry into the Sweepstakes. Once you have placed an order and the applicable promo code has been applied, you are now entered for a chance to win. To enter the Sweepstakes by this method, a Postmates account is required, and can be obtained at no cost at postmates.com or by downloading the app from the appropriate app store. Data and usage rates may apply. By entering the promo code at checkout, Entrant is acknowledging and agreeing to these Official Rules. Any entries that constitute unlawful behavior will be disqualified from the Sweepstakes. No purchase or order with Postmates is necessary to enter or win.
Alternate Method of Entry: To enter without placing an order and entering the promo code in the Postmates app, complete the form found at: https://docs.google.com/forms/d/e/1FAIpQLSdoGUIOwi_il2qSqHKhoA0TMB73JoOyhiQw8y2fyNT5TpE0GQ/view and provide your complete name, phone number and valid email address associated with your Postmates account to receive one (1) entry into the Sweepstakes.
Limit one (1) entry per individual, per email address and/or Postmates’ account throughout the Sweepstakes Period, regardless of method of entry.
Multiple Entrants are not permitted to share the same email address. Any entries that constitute unlawful behavior will be disqualified from the Sweepstakes. By entering the promo code at checkout, Entrant is acknowledging and agreeing to these Official Rules. Postmates in its sole discretion will decide whether a given entry satisfies the criteria for entry in the Sweepstakes. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email or addresses, accounts, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any entrant, the authorized account holder of the email address associated with the entry will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the entry. Each potential winner may be required to show proof of being the authorized account holder. Postmates will make the final determination of identity of entrants in its sole discretion.
3. Sweepstakes Period: This Sweepstakes begins at 08:00 am Pacific Time (“PT”) on May 30, 2023 and ends at 11:59 pm PT on June 2, 2023 (the “Sweepstakes Period”). Postmates’ computer is the official time-keeping device for the Sweepstakes. All entries must be received during the dates and times specified in the Sweepstakes Period. Odds of winning the Sweepstakes depend on the number of eligible entries received during the Sweepstakes Period.
4. Prize: Five (5) Entrants shall be selected as Winners (as defined below) and each Winner will receive one (1) LAFC prize package, which shall consist of the following:
- Two (2) tickets to the June 21, 2023 LAFC vs Seattle Sounders game (exact ticket and seats shall be determined in Postmates or their designees’s sole discretion). Tickets awarded subject to availability.
- Three (3) of the five (5) Winners will receive MDFBX1 Tickets. Approximate Retail Value (“ARV”) per ticket: $200.00.
- The remaining two (2) Winners will receive Founder Tickets. ARV: $305.00
- One (1) signed black authentic jersey. ARV: $154.99;
- One (1) clear LAFC tote. ARV: $14.99;
- One (1) MLS Cup champions scarf. ARV: $41.99;
- One (1) LAFC hat. ARV $49.99;
- Two (2) Pre-match sideline access passes. ARV per pass: up to $2,000.00; and
- $100 in Postmates credit in the form of Uber Cash. Uber Cash terms and conditions apply. ARV: $100.00.
Total estimated aggregate retail value of all the Sweepstakes prizes (collectively referred to as, “Prize” or “Prizes”) is up to USD $24,229.80.
Uber Cash is subject to the Uber Terms of Service, which are available here. For the avoidance of doubt, although the winner will receive the Uber Cash at no cost as the Prize, the provisions in the Uber Cash Terms of Service shall govern to the extent applicable. Prize redemption details shall be provided upon awarding of the Prize. All expenses and other costs not expressly stated in the Prize description are the sole responsibility of the Prize winner. Additional Prize restrictions, conditions and limitations may apply. All elements of the Prize shall be subject to any and all local, state, federal and any other applicable COVID-19 protocols, laws and regulations. Failure to provide any information as requested by the time specified by Postmates or their designee for Prize fulfillment purposes, may result in Winner’s disqualification or forfeiture of the Prize. Winners may be required to be physically present and/or must present valid government-issued photo identification to redeem the Prize. Winner and Winner’s guest(s) agree to comply with all applicable stadium regulations in connection with the Prize. Postmates and the applicable Sweepstakes Entities reserve the right to remove or to deny entry to any Winner and/or his/her guest(s) who engage(s) in a non-sportsman like or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Under such circumstances, the individual (and/or guest) may be asked to leave and may forfeit all remaining portions of the Prize.
Exact tickets are not guaranteed and shall be determined in Postmates’ and the applicable Sweepstakes Entities’ sole discretion. Winner is solely responsible for all incidental expenses, including ground transportation, meals, tips and gratuities, taxes and fees associated with the receipt and/or use of the Prize. MLS game, event, and exhibition dates and times are determined in the sole discretion of MLS and/or LAFC, as applicable, and may be subject to change.
A refund or cash equivalent will not be provided to Winner in the event that the actual retail value of the Prize is different than the stated ARV. Any portion of the Prize not accepted, or redeemed by the dates or allotted time set forth in these Official Rules, or unclaimed and/or unused by the Winner will be forfeited and will not be substituted and no additional compensation will be provided, no transfer of Prize to a third party is permitted. Prize and Prize elements may not be separated or redeemed for cash. Prize is non-transferable and no substitution will be made except as provided herein or at Postmates’ and the applicable Sweepstakes Entities’ sole discretion. Postmates and the applicable Sweepstakes Entities reserve the right to substitute any listed prize for one of equal or greater value if the designated Prize, or any portion thereof, should become unavailable for any reason.
Tickets are non-transferable and must be used on the date specified by Postmates or Prize provider. Tickets are subject to certain terms and conditions as specified thereon. Resale of tickets is prohibited. Tickets may be directly fulfilled by the Prize provider or Postmates’ designee. Once the tickets have been awarded and accepted by the Winner, neither Postmates nor the Sweepstakes Entities shall have no further responsibility or obligation to a Winner. The terms and conditions of the tickets awarded as part of any Prize will govern in the event a legal game, event or exhibition, as defined by the applicable Sweepstakes Entities, is not played or held, as applicable, due to weather conditions, a global pandemic, an act of God, an act of terrorism, civil disturbance, work stoppage, or any other reason and neither Postmates nor the Sweepstakes Entities will be responsible for any such cancellation or postponement of any MLS game, event or exhibition.If for any reason the Prize is unavailable or a Prize or related event is delayed, canceled or postponed, or for any other reason, Postmates and the applicable Sweepstakes Entities reserve the right to modify the Sweepstakes in its sole discretion and award a substitute prize, or portion of prize, of comparable or greater value as set forth in these Official Rules. No substitution, transfer, assignment or cash equivalent of the Prize, or any portion thereof, is permitted by the Winners. Postmates and the Sweepstakes Entities shall have no responsibility or obligation to a Winner who is unable or unavailable to, or who does not for any reason, accept or utilize a Prize or any portion thereof. Winners agree to comply with any additional terms and conditions applicable to the Prize. The Prize is provided “as is”; Entrants acknowledge that Postmates and the Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize, including any implied warranty of merchantability of fitness for a particular purpose. All costs and expenses not specifically listed above as part of the Prize are solely each Winner’s responsibility, including but not limited to tips and gratuities, and other taxes not otherwise mentioned herein. Any prizes pictured in advertising and other Sweepstakes materials are for illustrative purposes only.
THE VALUE OF THE PRIZE WILL BE TAXABLE TO THE WINNER AS INCOME. All U.S. federal, state and local tax liability, and any other costs and expenses associated with acceptance or use of the prize not specifically provided for in these Official Rules are solely the responsibility of each Winner (regardless of whether the prize, in whole or in part, is used). Winners must submit the Taxpayer ID, Social Security Number and/or any other information or documentation Postmates may require for payment and/or tax reporting purposes, including but not limited to a W9.
5. Drawing and Notification: Five (5) potential winners will be selected in a random drawing held on or about June 5, 2023 from all eligible entries received by Postmates. Odds of winning depend on the number of eligible entries received. Limit of one (1) prize per potential winner for the entire Sweepstakes Period. The winner(s) will be chosen by Postmates based on the Official Rules. Postmates is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or winner’s failure to adequately monitor any account.
The potential winner must then respond to Postmates within forty-eight (48) hours (or another time designated by Postmates). Winner(s) will be required to share an email address and valid email address in order to redeem the Prize. Should the winner fail to respond to Postmates, or in the event that the winner’s entry is invalid, Postmates reserves the right to disqualify that winner and select an alternate entry. Winner will be required to sign an affidavit of eligibility, liability release and a publicity release. Provided that each potential winner is in compliance with the Official Rules and after having successfully proven eligibility, they will be officially confirmed as the winners (each, a “Winner”). By entering or accepting any Prize, Winner allows Postmates and the Sweepstakes Entities to use the Winner’s entry, name, photograph, likeness, voice, opinions, Prize information, biographical information, hometown and state for publicity and promotional purposes without further compensation where permitted by law. Except where prohibited, participation in the Sweepstakes constitutes Entrant’s consent to Postmates’s and the Sweepstakes Entities’ use of Entrant’s entry, name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
6. Conditions of Participation. By submitting an entry for this Sweepstakes, you agree to abide by these rules and any decision Postmates makes regarding this Sweepstakes, which Postmates shall make in its sole discretion. Postmates reserves the right to disqualify and prosecute to the fullest extent permitted by law any entrant or Winner who, in Postmates’ reasonable suspicion, tampers with Postmates or any Postmates partner site, the entry process, intentionally submits more than a single entry, violates these rules, or acts in an unsportsmanlike or disruptive manner. Postmates or their designee may fulfill the Prize to the Winner, and Postmates may share your information with a third party for Prize fulfillment purposes.
7. Intellectual Property: Ownership of the pre-existing underlying intellectual property of the entrant remains the property of the entrant subject to Postmates’ and the Sweepstakes Entities’ rights to reprint, display, reproduce, perform, use, and exhibit the entry for the purpose of administering and promoting the Sweepstakes and for Postmates’ marketing and advertising purposes. By participating in the Sweepstakes, each entrant grants to Postmates and the Sweepstakes Entities a non-exclusive, worldwide, fully paid, royalty-free, perpetual, transferable license to reprint, display, reproduce, perform, use, and exhibit (including the right to make derivative works of) the entry and materials and information submitted on and in connection with the Sweepstakes or use or receipt of the prize for any and all purposes in any medium. Each participating entrant hereby warrants that any entry and other materials and information posted or provided by entrant are original with entrant and do not violate or infringe upon the copyrights, trademarks, rights of privacy, publicity, moral rights or other intellectual property or other rights of any person or entity, and do not violate any rules or regulations. If the entry or information or materials posted or provided by entrant contain any material or elements that are not owned by entrant and/or which are subject to the rights of third parties, entrant represents he or she has obtained, prior to submission of the entry and information or materials, any and all releases and consents necessary to permit use and exploitation of the entry and information and materials by Postmates and the Sweepstakes Entities in the manner set forth in the Official Rules without additional compensation.
Each entrant warrants that the entry and materials and information posted or provided do not contain information considered by entrant, its employees or personnel, or any other third party to be confidential, and that the entry, materials and information provided do not violate any laws or regulations. Entrant agrees that Postmates has the right to verify the ownership and originality of all entries and that, upon Postmates’ request, entrant must submit a written copy of any release or permission entrant has received from a third party granting entrant the right to use such property. Entrant understands and acknowledges that in the event a submission is selected as a winning entry, and entrant’s ownership, rights and the originality of the entry cannot be verified to the satisfaction of Postmates or is in any other way ineligible, Postmates may select an alternate Winner.
8. Disclaimer, Release and Limit of Liability. NEITHER POSTMATES NOR THE SWEEPSTAKES ENTITIES MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE SWEEPSTAKES. BY ENTERING THE SWEEPSTAKES OR RECEIPT OF ANY PRIZE, EACH ENTRANT AGREES TO RELEASE AND HOLD HARMLESS POSTMATES, THE SWEEPSTAKES ENTITIES, AND EACH OF THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/SWEEPSTAKES AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, NEGLIGENCE, GROSS NEGLIGENCE OR OTHER TORTIOUS CONDUCT, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE SWEEPSTAKES OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (1) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY ENTRANTS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE SWEEPSTAKES; (2) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE; (3) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE SWEEPSTAKES; (4) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE SWEEPSTAKES OR THE PROCESSING OF ENTRIES; OR (5) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANT’S PARTICIPATION IN THE SWEEPSTAKES OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed Postmates reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
9. Privacy and Use of Sweepstakes Information. All information submitted by Entrants and collected by Postmates in connection with Entrant’s entry will be subject to and will be treated in a manner consistent with Postmates’ website Terms and Conditions accessible at: https://www.uber.com/legal/terms/ and Postmates’ User Privacy Policy available at: https://www.uber.com/legal/privacy/. By participating in the Sweepstakes, Entrant hereby agrees that Postmates may collect and use his or her personal information submitted with the entry, and acknowledges that he or she has read and accepted the Postmates’ User Privacy Policy. Among other things, the information Entrants provide may be used for sending Entrants company updates and announcements about Postmates and its products and/or services.

GOVERNING LAW AND DISPUTES: THESE OFFICIAL RULES AND THE SWEEPSTAKES ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF CALIFORNIA, AND THE FORUM AND VENUE FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES SHALL BE IN THE COUNTY OF SAN FRANCISCO, CALIFORNIA. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN CALIFORNIA. ANY SUCH CONTROVERSY OR CLAIM WILL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND WILL NOT BE CONSOLIDATED IN ANY ARBITRATION WITH ANY CLAIM OR CONTROVERSY OF ANY OTHER PARTY. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN THE COUNTY OF SAN FRANCISCO, CALIFORNIA. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
11. Accessibility of Official Rules: A copy of the Official Rules is available via https://postmates.com/blog/. Where required by law, Postmates will provide the name of Winner(s) of a Sweepstakes to those who request it. For the names of Winners: (i) send a self-addressed, stamped envelope postmarked to Postmates, LLC, 1515 3rd Street, San Francisco, CA 94158, Attn: Winner List; and (ii) write the name of the Sweepstakes on the lower left hand corner of the envelope. All requests for the names of the Winners must be received within two (2) weeks of the end of the Sweepstakes Period.
