Taxi Booking Services Terms
1.DEFINITIONS
"General Terms" means the terms and conditions (available here) as amended from time to time that apply to your use of Uber’s mobile applications, websites and Uber Products in the United Kingdom.
“Reserved Taxi Booking” means a Taxi Booking with a Taxi Driver who holds a valid hackney carriage licence granted by Transport for London with a specified pick-up time that is 30 minutes or more from the time that the Taxi Booking is made.
"Taxi Booking" means a request by you for a Taxi Ride in the Uber App/Website or a request by you for a passenger journey in the Uber App/Website which Uber has referred to a Taxi Driver.
"Taxi Booking Services" means the services allowing you to request and receive a Taxi Ride via the Uber App/Website.
"Taxi Driver" means a taxi driver who holds a valid hackney carriage licence granted by Transport for London or by a district council and who has agreed to the Uber driver terms (i.e. the terms agreed between us and a taxi driver who has signed up to provide Taxi Rides via the Uber App/Website, as such terms may be amended from time to time).
"Taxi Ride" means the provision by a Taxi Driver of transportation services under a hackney carriage licence for a pre-booked taxi trip.
"Uber App/Website" means the Uber mobile application and/or Uber website and related services provided to you by Uber (on the basis set out in the General Terms) through which you make Taxi Bookings and receive the Taxi Booking Services and any Taxi Rides.
“We” or “us” refers to Uber London and/or Uber Britannia.
Unless otherwise defined in the Taxi Booking Services Terms, capitalised terms in the Taxi Booking Services Terms shall have the same meaning given to them in the General Terms.
2. BASIS OF CONTRACT
These terms (the "Taxi Booking Services Terms") govern the provision of Taxi Booking Services made available to you by us via the Uber App/Website. These Taxi Booking Services Terms apply in addition to the General Terms (with the exception of the Rides Terms and Uber Eats Terms, which do not apply to the Taxi Booking Services or to Taxi Rides, unless expressly stated otherwise in the General Terms). In the event of any conflict between the Taxi Booking Services Terms and the General Terms, the Taxi Booking Services Terms shall prevail unless expressly stated otherwise in the Taxi Booking Services Terms or the General Terms.
For the purposes of the General Terms, a Taxi Ride is a Third Party Service, and the Taxi Driver is a Third Party Provider.
These Taxi Booking Services Terms apply where you have used the Uber App/Website to request a Taxi Ride provided by a hackney carriage licensed by Transport for London (also known as a ‘Black Cab’). When you make a Taxi Booking in this way:
- you accept Uber London’s offer to provide Taxi Booking Services to you in accordance with the Taxi Booking Services Terms; and
- a contract for Taxi Booking Services is created between you and Uber London.
As set out in the General Terms, the Taxi Booking Services Terms also apply where you have used the Uber App/Website to make a request for a passenger journey and we refer that request to a Taxi Driver. If the Taxi Driver agrees to take your trip, the message ‘This is a pre-booked taxi trip’ will be displayed and the Taxi Driver’s identity will be communicated to you in the App or on the Website. At the point of receiving this information, a contract for Taxi Booking Services is created between you and Uber.
A separate contract for a Taxi Ride is created between you and the Taxi Driver who accepts your Taxi Booking when you receive the message referred to above and the Taxi Driver’s identity is communicated to you in the App or on the Website (the "Taxi Ride Contract"). This applies to all Taxi Bookings.
Taxi Drivers are entitled to accept, reject or ignore a Taxi Booking at their discretion.
We do not provide Taxi Rides and we are not a party to the Taxi Ride Contract. We act as a disclosed agent for the Taxi Driver in communicating the Taxi Driver’s agreement to enter into the Taxi Ride Contract and collecting payment on the Taxi Driver’s behalf. We do not accept Taxi Bookings as a licensed private hire operator.
We may amend the Taxi Booking Services Terms from time to time. When we do, a new version will be made available in the Uber App/Website. The date the Taxi Booking Services Terms were last updated is shown at the top of this page. The new version of the Taxi Booking Services Terms will apply to Taxi Bookings made after the new version has been made available in the Uber App/Website. We encourage you to review the Taxi Booking Services Terms regularly to ensure you are familiar with the latest version.
You can make changes to the Taxi Ride Contract through the Uber App/Website. You will be informed in the Uber App/Website if the change is not possible.
The Community Guidelines apply in respect of your use of the Taxi Booking Services.
3. THE PROVISION OF TAXI BOOKING SERVICES BY US
We provide certain Taxi Booking Services. The Taxi Booking Services include:
1. Transmitting Taxi Bookings to Taxi Drivers and communicating their acceptance of a Taxi Booking to you, but without prejudice to the Taxi Driver’s rights at their sole and absolute discretion to accept, reject or ignore a Taxi Booking;
2. Collecting and processing payments made by you and paying charges to Taxi Drivers;
3. Informing you of the estimated price, the estimated time of arrival of the Taxi Driver and the estimated duration of the journey;
4. Keeping records of Taxi Bookings;
5. Remotely monitoring trips booked using the Uber App/Website; and
6. Post-Taxi Ride services, including receiving and dealing with feedback, questions and complaints, and managing any lost property queries.
4. THE PROVISION OF TAXI RIDES BY TAXI DRIVERS
The Taxi Driver who accepts your Taxi Booking is responsible for the Taxi Ride. In the event of any dispute regarding the Taxi Ride Contract, we will refer you to the relevant Taxi Driver or Transport for London or the relevant district council, as applicable.
A Taxi Booking can only be accepted by a person who holds a valid hackney carriage licence granted by Transport for London or by a district council. Taxi Drivers are responsible for their compliance with applicable legislation and any relevant licensing conditions.
5. CHARGES AND PAYMENT IN LONDON
In London, the Taxi Booking Services are provided by Uber London in exchange for your offering to enter into the Taxi Ride Contract.
The fares and other charges that apply to a Taxi Ride provided by a Taxi Driver in Greater London are determined pursuant to the London Cab Order 1934 (as amended by Transport for London from time to time) (the “London Cab Order”). These include a booking fee which can be levied where a Taxi Ride is booked online or through an app, which includes the Uber App/Website, and is additional to the fare shown on the taximeter. The fares and other charges can be found on Transport for London’s website, available here, along with information about the booking fee and certain additional charges. These fares and charges may be modified or updated from time to time. It is your responsibility to remain informed about the current rates for a Taxi Ride.
The estimated price for the Taxi Ride (which will include VAT, if applicable) will be provided to you via the Uber App/Website before you make a Taxi Booking and will be based on the booking fee and fare calculation rates set out in the London Cab Order. You may be charged a different amount than the estimated price, including because of increased costs due to material changes to the route, changes to the pick-up or drop-off point, en route stops or heavy traffic. You may also be charged additional amounts permitted to be charged under the London Cab Order (for example for Heathrow terminal drop-off charges).
Additional charges may also apply, for instance if you or another passenger travelling as part of your Taxi Ride Contract soils, contaminates, or damages a vehicle, in which case you will be charged the soiling fee specified in the London Cab Order if the cab has to be taken out of service for cleaning.
You may choose to pay a tip which will be remitted to the Taxi Driver but you have no obligation to do so.
Our accepted payment methods are set out in the Uber App/Website. When you make a Taxi Booking, Uber London may need to verify the payment method selected by you by issuing a temporary authorisation hold from your bank. For more information, please click here. Following completion of a Taxi Ride, if you think a payment is incorrect, please contact us promptly to let us know.
6. CANCELLATION IN LONDON
To cancel your Taxi Booking, please follow the steps set out in the Uber App/Website. Uber London will make refunds due to you as soon as possible, where applicable. Please note that a cancellation fee may be applied if:
- you cancel your Taxi Booking a few minutes after a Taxi Driver has accepted your Taxi Booking;
- you cancel a Reserved Taxi Booking less than 60 minutes in advance of your chosen pick-up time; or
- if you do not present yourself at the pick-up location.
Cancellation fees for Reserved Taxi Bookings are different - and may be higher - than for other Taxi Bookings. This is intended to compensate the Taxi Driver who accepted your Reserved Taxi Booking for their time spent preparing to fulfil your Reserved Taxi Booking.
If a Taxi Driver becomes unavailable after accepting your Taxi Booking, the Taxi Ride Contract with that Taxi Driver will terminate and your Taxi Booking will be offered to alternative Taxi Drivers. If no Taxi Driver is available to accept or fulfil your Taxi Booking, we will inform you and you will not be charged in respect of the Taxi Ride or the Taxi Booking Services.
7. CHARGES, PAYMENTS AND CANCELLATION OUTSIDE OF LONDON
You will be shown in the Uber App/Website the estimated time of the Taxi Driver’s arrival and estimated time of journey completion, but these are estimates only and time shall not be of the essence.
The price for the Taxi Ride (which will include VAT, if applicable) will be the price provided to you via the Uber App/Website before you request a passenger journey. This may include relevant surcharges (including airport pickup, dropoff, tunnel tolls, parking or other airport charges) and/or tolls, road charging schemes, including congestion charge, charges for low emission or similar zones, and road tax.
You may be charged a different amount than the price stated in certain situations, including but not limited to, material changes to the pick/up drop off point, route taken, driver waiting time, stops or traffic. In this situation, the rates that will apply will be available to you via the Uber App/Website. These may be modified or updated from time to time. More information can be found here. Additional charges may also apply, for instance if you, or any passenger, soils, contaminates, or damages a vehicle, in which case you may be charged for such damage, as well as for a cleaning fee as more particularly set out in the Community Guidelines.
You may choose to pay a tip which will be remitted to the Taxi Driver but you have no obligation to do so.
Our accepted payment methods are set out in the Uber App/Website. When you request a passenger journey, we may need to verify your payment method by issuing a temporary authorisation hold from your bank. For more information, please click here. When the Taxi Ride has been completed, if you think a payment is incorrect, please contact us promptly to let us know.
To cancel your Taxi Booking, please follow the steps set out in the Uber App/Website. Uber will make refunds due to you as soon as possible, where applicable.
If a Taxi Driver becomes unavailable after accepting your Taxi Booking, the Taxi Ride Contract with that Taxi Driver will terminate and we will endeavour to find you another driver. That driver may be a Taxi Driver (in which case the Taxi Booking Services Terms will continue to apply) or a Third Party Provider that is a driver licensed to carry out private hire transportation services (in which case the Rides Terms will apply in place of the Taxi Booking Services Terms). Where another driver cannot be found, we will inform you and you will not be charged.
The applicable cancellation policy is set out here and information on cancellation fees here. See Sections 5 and 6 of the General Terms for more information regarding charges, payment and cancellation.
8. PERSONAL DATA
Uber collects, uses and discloses information from or about you as described in Uber’s Privacy Notice.
9. LIMITATION OF LIABILITY
See Section 9 of the General Terms.
Please note that all hackney carriage vehicles are required by law to hold and maintain public hire insurance in order for drivers to legally carry and transport passengers. If your problem relates to a motor incident, please contact us for your Taxi Driver’s details in order to progress matters. We will not be liable for any matters covered by your Taxi Driver’s insurance unless and until you have exhausted all potential remedies related to motor accidents.
