SUPPLEMENTAL TERMS: COURIER (UK)
These supplemental terms apply in addition to any other rights or obligations set out in the General Terms of Use (“Third Party Provider”) if you request the Courier Delivery Services via the Uber App. To the extent there is any conflict between these terms and the User Terms, these terms will take precedence in connection with Courier only.
Courier allows you to request delivery of package(s) (both the content and the materials for its containment) (the “Package(s)”) by independent third party providers of delivery services (“Third Party Providers”) who have an agreement with Uber Eats UK Limited (Uber Eats UK”) to a designated address using a mobile or web-based application or other interface offered by Uber Eats UK (the “Uber App”), as described below.
Key Principles
- The Courier Delivery Services must not be used for Packages valuing more than £100.
- You are responsible for any loss, damage or theft of a Package. Uber Eats UK and its affiliates do not provide insurance coverage.
- You must not use the Courier Delivery Services to send Prohibited Items.
- Your use of the Courier Delivery Services is subject to size and weight restrictions.
1. Courier Delivery Services
1.1 Once you have been provided access to the Uber App by Uber Eats UK, you may place requests for delivery of Packages using the Uber App, via the ‘Courier’ request option (“Courier Delivery Services”). You may request a ‘Package’ or ‘Small Package’ Courier Delivery Service.
1.2 Courier Delivery Services are offered in designated areas as communicated via the Uber App from time to time (“Courier Active Area”). Uber Eats UK does not guarantee that the Courier Delivery Services will be available in the Courier Active Area at all times.
2. If you choose Courier Delivery Services
2.1 If you choose the Courier request option, Courier Delivery Services will be provided by Uber Eats UK and performed by Third Party Providers, who will collect Packages from you and deliver those Packages to your nominated location as part of the Courier Delivery Services. You will be charged by Uber Eats UK for the Courier Delivery Services.. A Third Party Provider is not an employee of Uber Eats UK or any of its affiliates and may delegate to another person to provide such delivery services on their behalf.
2.2 For each Courier Delivery Service requested, Uber Eats UK will endeavour to ensure that your Packages will be picked up and delivered as soon as reasonably possible. Unfortunately, independent factors such as traffic and weather, as well as the actions or inactions of Third Party Providers may cause delays in the provision of delivery services.
2.3 Each time you request the Courier Delivery Service, you confirm that you have obtained consent from the delivery recipient to share their delivery address with Uber Eats UK. Uber Eats UK will use this personal data in accordance with its Privacy Notice.
3. Prohibited Items
3.1 You may not use or access Courier Delivery Services to send any Prohibited Items (“Prohibited Items”). A list of Prohibited Items is published online by Uber Eats UK (as updated from time to time). For the current list of Prohibited Items please see here. Uber Eats UK retains the discretion to prohibit additional items from time to time. It is your responsibility to ensure that you have checked the current list of Prohibited Items each time you use the Courier Delivery Services. Depending on your location, you may be notified of additional Prohibited Items or restrictions on the use of Courier Delivery Services for specific categories of items. If a Third Party Provider suspects that your Package may contain Prohibited Items, they may take the Package to the nearest police station. Where it is established that the Package does not in fact contain Prohibited Items:
3.1.1 For deliveries that arrive more than 45 minutes after the original estimated delivery time, we will refund you the fees you have paid in connection with the Courier Delivery Services; or
3.1.2 For deliveries that are canceled by Uber Eats UK: (i) where this is due to a Third Party Provider declining to deliver the Package prior to its arrival at the delivery address; and (ii) where we are able to confirm that the Package has not been delivered to the delivery address, we will refund you the fees you have paid in connection with the Courier Delivery Services.
4. Package Restrictions
4.1 You must ensure that the Package(s), together, for a request selecting the ‘Package’ delivery request option: (i) are not greater than 80 kilograms (split into individual items of 20kg or less); (ii) fit comfortably in the boot of a mid-size motor vehicle); and (iii) do not have a total value greater than £100.
4.1.1 You must ensure that the Package(s), together, for a request selecting the ‘Small Package’ delivery request option: (i) are not greater than 15 kilograms; (ii) fit comfortably in a delivery bag of a motorbike or bicycle (max. dimensions: L41cm x D49cm x H41cm); and (iii) do not have a total value greater than £100.
4.1.2 You must prepare, appropriately package and securely close and seal the Package(s) for safe delivery.
5. Refusal or Rejection of Deliveries
5.1 You acknowledge and agree that there may be circumstances where Uber Eats UK may cancel the delivery after acceptance for any reason, including where a Third Party Provider declines to pick up or deliver the Package(s). You may cancel your delivery request without charge at any time. You acknowledge and agree that you are responsible for ensuring that you and anyone who has contact with a Third Party Provider or any other person as part of the Courier Delivery Services you have requested, complies with the Community Guidelines.
6. Delivery, Redelivery, and Undeliverable Packages
6.1 Subject to a Package not containing a Prohibited Item, if the delivery is unable to be completed for any reason (including, for example, where a Third Party Provider is unable to locate the delivery location and is unable to make contact with you), Uber Eats UK will attempt to arrange, with the Third Party Provider, the return of the Package to you.
6.2 If the Package is not able to be returned to you in accordance with section 6.1, you acknowledge and agree that the Package may be left at the original pickup location, an alternative location as instructed by you or at the delivery location or safe place near the delivery location. To the extent feasible and if requested by you, Uber Eats UK may also attempt to facilitate an exchange of the undelivered Package between you and the Third Party Provider.
6.3 You are responsible for the reasonable costs associated with the return, redelivery or disposal of your Package, except where the return, redelivery or disposal arises from any fraudulent, unlawful or negligent act or omission by Uber or Uber Eats UK or a Third Party Provider. Uber Eats UK reserves the right to charge you for the reasonable costs associated with the return, redelivery or disposal of your Package using your payment method designated in your Account.
7. Title and risk
7.1 You acknowledge that neither Uber Eats UK nor its affiliates nor any Third Party Provider takes any title to Packages. Uber Eats UK will have control and care of the Package in accordance with these Uber Delivery Terms, until the Courier Delivery Services are completed, end or are cancelled, including where the Package is returned, redelivered or disposed of.
8. Loss or Damage to Packages; Sending Food or Beverages; No Insurance
8.1 You acknowledge and agree that Courier Delivery Services are available for sending Packages up to one hundred pounds (£100) in value. Subject to section 9 of the User Terms, Uber Eats UK’s total liability to you for the use of the Courier Delivery Services shall not exceed one hundred pounds (£100).
8.2 You assume exposure to and risk of any loss, theft, tampering or delay in your use of the Courier Delivery Services. Uber Eats UK and its affiliates do not maintain insurance for loss, damage or theft. You should contact an insurance agent or broker if insurance coverage is desired. Uber Eats UK and its affiliates do not provide insurance coverage.
8.3 Subject to the limitation set out above and exclusions set out in section 9 of the User Terms, if you use the Courier Delivery Services to send food or beverages or other items not otherwise prohibited by these Uber Delivery Terms, you assume full responsibility for such items after delivery, including any damage due to temperature sensitivity and/or tampering. You further assume full responsibility for chilling any perishables immediately upon delivery to help maintain the safety and quality of those items.
