Uber Eats Promotion Terms (Uber-Created Promotions) Addendum – Australia
These terms and conditions constitute an addendum to your Agreement and set out additional terms under which Portier Pacific (as defined in the Agreement) will create Uber-Created Promotions on your behalf that will be provided through the Uber Eats App to potential customers of Participating Locations (the Addendum). A reference to the “Agreement” in this Addendum is to the Uber Eats Merchant Agreement between the person identified within the email communication which
links to this Addendum (also referred to as “you”), Uber Technologies, Inc., a Delaware corporation having its offices at 1725 3rd Street, San Francisco, CA 94158, United States of America (Uber) and Portier Pacific Pty Ltd ABN 28 622 365 459, an Australian company registered in New South Wales (Portier Pacific).
This Addendum amends your Agreement on and from the date of your acceptance. If there is any conflict between this Addendum and the other parts of your Agreement, this Addendum will apply with respect to the subject matter of this Addendum. All other parts of your Agreement remain in full force and effect. Capitalised terms in this Addendum have the meaning given in your Agreement, unless otherwise specified.
By requesting an Uber-Created Promotion, in accordance with section 2.5 of the Service Terms – Uber Promotion Tools, you will be deemed to agree to the terms and conditions set out in this Addendum.
This Addendum consists of:
(a) Attachment A – Uber-Created Promotion Terms; and
(b) Attachment B – Campaign Form Template.
