ADDENDUM TO TERMS AND CONDITIONS

By clicking “Yes, I agree”, or by continuing to use the Uber App after the Effective Date, you

hereby agree to be bound by this Addendum to the Terms and Conditions (“Addendum”).

You entered into the Terms and Conditions (the “Terms”) executed between you and Uber

B.V. to access the Uber Services. This Addendum sets forth additional terms and conditions in relation to Uber’s Audio Recording feature that are applicable to you if you continue to use the Uber Services and the Uber Application after 14 June 2023 (“Effective Date”).

Capitalized terms used herein but not defined shall have the meanings ascribed to them in the Terms. Except where modified below, the remainder of the Terms shall remain unchanged. This Addendum to the Terms does not alter your relationship with Uber, and in the event of a conflict between this Addendum and the Terms, the terms of this Addendum shall supersede only to the extent of the conflict.

The following terms apply to your use of the Uber App after the Effective Date:

You hereby accept and acknowledge that you and/or Third Party Providers can record the

audio of the trips through an in-app feature. In-app recordings are encrypted and stored on your or Third Party Providers devices, and are only shared with Uber if submitted by you or Third Party Providers in connection with safety incidents in line with Uber’s Privacy Policy. You may not authorize third parties to use your Account, and you may not allow persons under the age of 18 to receive transportation or logistics services from Third Party Providers unless they are accompanied by you. In the event of their use of your Account, you shall be liable for their consent regarding the audio recording of the trips through an in-app feature, as required under the applicable law.
