1. TERMS AND CONDITIONS OF ITTAXI TRIPS

Preamble

These terms and conditions apply to taxi trips fulfilled by a driver of one of the local taxi networks adhering to CONSORZIO IT TAXI S.C.A.R.L. ("ItTaxi") and booked through the Uber App.

Each taxi driver who is a member of ItTaxi operates, directly and independently from ItTaxi, as a single seller and provider of the transportation service that you have requested through the Uber App ("Taxi Transportation Service").

Depending on the city in which you requested the trip, the Taxi Transportation Service is rendered to you by a taxi driver who is a member of the relevant local taxi networks adhering to ItTaxi. Uber App terms and conditions shall continue to apply. You can find the Uber App terms and conditions in the Uber App and on www.uber.com/en/. In some cases, ItTaxi may also charge the Uber app user an ItTaxi Fee (as hereinafter defined) for its services.

Service description

In general, the taxi transport service is a non-scheduled car service that provides collective or individual transportation of people, which is carried out at the request of the transported, in a non-continuous or periodic manner, on routes and according to schedules established from time to time. When you book a Taxi Transportation Service through Uber, none of this changes, except for the digital method of booking and payment intermediated by the Uber App.

Applicable fare for Taxi Transportation Service and itTaxi Fee.

Each car that provides the Taxi Transport Service through Uber is equipped with a regular taximeter, placed in a position that guarantees the user the maximum visibility of its display. The taximeter indicates the fee to be paid.

The fare for the Taxi Transport Service shown in the Uber App is a mere estimate generated by ItTaxi and shown to the user through the Uber App. The final fare due by the user to the taxi driver is determined by the taximeter, without prejudice to the applicability of the fixed fares predetermined by the municipal regulations and any other legally applicable surcharge or fee. Consequently, the final fare that is actually charged could be lower or higher than the estimate shown in the Uber App.

In addition to the Taxi Transportation Service fee, ItTaxi may charge the user an additional booking fee for its digital intermediation services that enable the Uber app user to transmit the request to the systems of radio taxi facilities responsible by geographic area ("itTaxi Fee").

At the end of the trip, the taxi driver will indicate to Uber the price to be charged to the user according to the applicable regulations and Uber will proceed with the charge, on behalf of the taxi driver, through the Uber App.

For rides in the city of Rome, If the application notifies it via message during the request phase, the fare for the Taxi Transport Service shown in the Uber App corresponds to a maximum guaranteed fare. The final fare owed by the user to the taxi driver is determined by the lower amount between the fare shown in the app at the time of request and the meter fare, without prejudice to the applicability of the fixed fares predetermined by the municipal regulations and any other legally applicable surcharge or fee. Consequently, the final fare actually applied may be lower than the fare shown in the Uber App. The maximum fare is guaranteed for the requested route. In case of destination change after the trip has started or if you request multiple stops during the trip, the meter fare will be applied.

Uber may also charge the user, in addition to the fee for the Transportation Service, the itTaxi Fee.

Since the Taxi Transportation Service is rendered by the taxi driver independently, it is the taxi driver who is required to issue appropriate receipts for the transportation service. ItTaxi and Uber are not the sellers of the transportation service and therefore are not required to issue any receipt for the same. ItTaxi is the seller of the itTaxi Fee, where charged, and in such case the user will be entitled to receive the invoice for the itTaxi Fee directly from ItTaxi. The Uber App will send the Uber user an email summarizing the costs charged for the trip, but such email has no fiscal value.

Where applicable, the itTaxi Fee will be shown in the Uber App before the user submits the ride request and will be applied exclusively when the ride is completed. No itTaxi Fee will be charged in the case of uncompleted rides (e.g., due to cancellation of the request by the user).

Users’ obligations

The user of the Uber App shall pay the taxi driver for the Taxi Transportation Service and the itTaxi Fee to itTaxi, if applicable. Such payments will be intermediated by the Uber App.

Users of the Taxi Transportation Service are prohibited from:

a) smoking in the car;

b) throwing objects from moving or stationary vehicles;

c) demand that the transportation be rendered in violation of applicable safety regulations, including, without limitation, any provisions of the applicable Road Code or applicable municipal regulations;

d) soiling or deteriorating the vehicle and its equipment;

e) committing acts contrary to decency;

f) violate all applicable health requirements;

g) paying the ride fare and, where applicable, the itTaxi Fee with cash outside of the Uber App.

Accidents, lost items and other incidents

Uber and ItTaxi are not responsible for any unforeseeable events that may occur during the Taxi Transportation Service booked through the Uber App thanks to the collaboration with ItTaxi. The taxi driver is the sole party responsible for the Taxi Transportation Service. In the event of unforeseen events in connection with a Taxi Transportation Service booked through the Uber App, the taxi driver will be individually liable to the user of the Uber app.

If the user of the Taxi Transportation Service is unable to take direct contact with the taxi driver who rendered the Taxi Transportation Service, and/or with the local taxi networks adhering to ItTaxi to which the driver belongs to, the user can take contacts with the Uber customer service through the Uber App. In this case the user's personal data may be shared between Uber, ItTaxi and the relevant local taxi network to which the driver belongs to, as well as with the police or other competent public authorities, as permitted by law. DATA SHARING POLICY BETWEEN UBER, ITTAXI AND ITTAXI LOCAL NETWORKS

Why this Data Sharing Policy?

This policy describes how Uber and its partner Consorzio ItTaxi S.C.A.R.L. (“ItTaxi”), which act as independent data controllers, share your personal data to provide you with the transportation services you’ve requested through the Uber app (“Services”). The Services will be fulfilled by a driver of one of the local taxi networks adhering to ItTaxi (“ItTaxi Local Network”). You will be able to book rides with a driver of the relevant ItTaxi Local Network through the Uber app. The contact details of ItTaxi and the list of its Local Taxi Networks is provided at the bottom of this page. Further information can be found on ItTaxi website or writing to privacy@ittaxi.it.

By proceeding with your request you acknowledge that Uber will share your personal data with ItTaxi and the relevant ItTaxi Local Network (which depends on the City you are in) to provide you with the Services of its drivers.

What personal data are we sharing?

Information shared by Uber with ItTaxi and the relevant ItTaxi Local Network

To allow you to request the Services through the Uber app, Uber shares the following information with ItTaxi and the relevant ItTaxi Local Network :

- the user’s name;

- the user’s location information, such as the pick up and drop off information, which will be anonymised after 30 days from completion of the trip;

- other information necessary for ItTaxi for the purpose of billing the itTaxi Fee, where applicable.

In addition to the above, and still for the sole purpose of allowing your request to be satisfied, we will provide the relevant driver with your first name, pick-up and drop-off location. This information will however be anonymised after 30 days from completion of the trip.

Information shared by ItTaxi and the relevant ItTaxi Local Network with Uber

ItTaxi and the ItTaxi Local Network will share the following personal data with Uber:

- the data that is necessary to allow Uber to collect relevant fees (date, start and end time, vehicle details and fare charged);

- trip data for your trip history records (date, start and end time and duration of trip, route information, including point of pick up, gps locations of trip for the sole purpose of allowing to provide you with our services and for security purposes, point of drop off, distance traveled, your driver details, and vehicle details).

Complaints & Incidents

In case of a complaint or incident during a trip fulfilled by a driver of the ItTaxi Local Network, your personal data may be shared between Uber, ItTaxi and the ItTaxi Local Network, as well as with law enforcement agencies or regulatory bodies. This may include, in any case according to the proportionality principle, your contact details, relevant data about the trip, the incident, or actions taken, and may be used to take appropriate action on your Uber account.

Why do we share your personal data?

Uber, ItTaxi and the ItTaxi Local Network use this personal data to provide you with the Services, also described above in more detail, detect and prevent fraud, for safety and security purposes and to improve products and services.

Customer Support

For any customer support related queries, please reach out to Uber. Uber will manage your request. In certain cases Uber, ItTaxi and the ItTaxi Local Network may share data submitted by you as part of your enquiry to help resolve the issue.

Want to stop sharing your personal data?

You can stop the sharing of your data at any time by not taking a trip with a ItTaxi Local Taxi Network. Of course this will prevent you from using the Services of local taxi drivers adhering to the ItTaxi Local Taxi Network.
