Uber Shuttle Packages Terms and Conditions – India

These terms and conditions govern your purchase and use of Uber Shuttle Package Terms, which is a limited promotion package (the "Program" or “Uber Shuttle Package”) offered by Uber India Systems Private Limited, its parent, subsidiaries and/or affiliates (“Uber” or “we”). Uber is a technology company which provides mobile applications for users to arrange and schedule transportation services through third party independent providers of such services under agreement with Uber. Uber is not a provider of transportation services, as such all benefits and discounts offered under the Program are offered on an "as available" basis, contingent upon third-parties' availability to provide the transportation services and other contingencies which may impact availability of some benefits at certain times and places. Uber Shuttle Package Terms are provided in connection with use of the Uber apps.

1. Incorporation.

These Uber Shuttle Promotional Trips Terms and Conditions ("Uber Shuttle Packages Terms") are expressly incorporated into and made a part of the Uber Terms of Use, Privacy Policy and Uber's Community Guidelines  (collectively the “Uber Terms”).. In the event of any conflict between these Uber Shuttle Package Terms and the Uber Terms, these Uber Shuttle Package Terms shall govern as applied to the subject matter herein. Subject to the foregoing, undefined, capitalized terms in these Uber Shuttle Package Terms will have the meaning set forth in the Uber Terms.

By purchasing Shuttle Package Trips you agree to these Uber Shuttle Package Terms, as well as any other specific terms of the offer you received (the “Offer”), which may include important details and restrictions, including, but not limited to, where and when Uber Shuttle Package Promotion may be used, the Rate and Packages Benefits (as defined below), and the validity period and number of trips under the package (the “Validity”). Please refer to your Offer as shown under “Shuttle Package” for details before purchasing Uber Shuttle Package Promotion Trips.

2. How Shuttle Package Trips Work.

Uber Shuttle Package Promotion Trips is a paid service provided by Uber that entitles the user to pricing or other benefits in relation to services provided by third party providers in a specific geographic area for the duration of the Uber Shuttle Package Promotion Trips, as set forth in your Offer (“Package Benefits”). The details for the applicable promotions (and any applicable limitations) shall be set forth in your Offer and stated to you when you sign up for Uber Shuttle Package, including but not limited to the billing rate for the Uber Shuttle Package Promotion Trips (“Rate”) and the billing interval (“Billing Cycle”). Also, certain optional benefits apply to users only upon buying the Shuttle package and not otherwise. The total price of the Uber Shuttle Packages shall be presented to you at the time of purchase. Package Benefits may be subject to applicable limitations. Package Benefits are subject to third party provider availability and acceptance of requests for services in your geographic area. It should be understood that Uber and/or its affiliates do not provide free or discounted services but instead, as part of the pricing benefits, Uber bears the cost of such benefits.

3. Charges and Auto Renewals.

When you purchase Uber Shuttle Package, you will be charged the Rate for the Validity of your selected Uber Shuttle Package on the date of purchase, which will activate your Uber Shuttle Package Promotion Trips, save as otherwise stipulated herein.

Uber may offer you the option to auto-renew your Uber Shuttle Package Promotion Trips within the Uber app subject to your prior explicit affirmative consent to opt-in for the auto renewal feature. Auto-renewal is only available where you have added a debit card or credit card (or such other payment method accepted by Uber from time to time) as a payment method in your Uber Wallet in the Uber app. You may opt to have any one of these payment methods automatically charged to renew your Uber Shuttle Package Promotion Trips. If you elect to auto-renew and unless otherwise you elect to discontinue, your Uber Shuttle Package Promotion Trips will automatically renew at the beginning of each billing cycle or on expiration of the validity of your package benefits, and the rate for your Uber promotional trips will be automatically charged to your selected payment method. You may choose to turn off the auto-renewal feature any time before the next charge by toggling off the auto renewal option in your Uber Wallet under Shuttle Package, otherwise the auto-renewal amount you have selected will continue unless and until you elect to turn it off. Auto renewal will be cancelled upon completion of the then current Uber Shuttle Package Promotion Trips. If your selected payment method is declined, Uber will prompt you for a new payment method. Uber is not responsible for any fees charged by the cardholder's bank including, but not limited to, overdraft fees, insufficient funds fees, interest charges, foreign exchange fees, cross border fees, and other penalties levied by the cardholder's bank.

If you select to pay your Uber Shuttle Package in cash, you will be asked to pay the third party provider the Rate in cash before the first eligible trip that you take with your Uber Shuttle Package Promotion Trips. If you do not pay the Rate before that first trip, the third party service provider has the right to refuse your trip request and /or may ask you to off-board the vehicle if you do not have another payment method available including another valid Uber Shuttle Package Promotion Trips.

The Uber Shuttle Package charges are inclusive of GST and other applicable taxes.

4. Changes to your Uber Shuttle Package Promotion Trips.

Uber reserves the right to modify or stop offering Uber Shuttle Package Promotion Trips, or change Packages Benefits or Rates, at any time in its sole discretion. If your Rate increases or your Packages Benefits materially change, we will honor your existing Uber Shuttle Package Promotion Trips until its Validity runs out.

Uber may terminate your Uber Shuttle Package Promotion Trips at its discretion without notice and may (subject to applicable law) process refunds, if applicable, to your registered user account. If your refund does not reflect in the account after such termination, please contact customer service by way of the Uber app. We will not give any refund for termination related to conduct that we determine, in our sole discretion, violates these Shuttle Package Terms, Uber's Terms of Use, Uber’s Community Guidelines, any applicable law, or involves fraud or misuse of the Uber Shuttle Package Promotion Trips. Save and except in cases of fraud where your package may be terminated with immediate effect without recourse to any refund, Uber reserves the right to terminate your Uber Shuttle Package Promotion Trips effective at the end of the Validity of the Uber Shuttle Package by providing you notice of such termination. If that happens, you will have access to your Packages Benefits until the end of their Validity.

5. Combining Promotions.

Notwithstanding the terms and conditions of other promotions offered through Uber Shuttle, Uber in its sole discretion may permit Packages Benefits to be combined with other promotions solely applicable to this product and subject to applicable law.

6. Free Trial.

Uber and/or third parties on behalf of Uber may offer some users a free trial or other promotional entitlement to Uber Shuttle Package Promotion Trips for such period and on such terms as Uber deems fit. Such trial or promotional entitlement are subject to these Uber Shuttle Package Promotion Trips Terms except as otherwise stated in the Offer. Only one trial or promotional entitlement is available per user. Free trial eligibility is determined by Uber at its sole discretion and Uber may limit such eligibility or duration to prevent free trial abuse. Certain limitations may exist with respect to combining a free trial with any other offers.

7. Changes to These Uber Shuttle Packages Terms.

Uber reserves the right to modify these Uber Shuttle Package Promotion Trips. If we make material changes while you have an active Uber Shuttle Package Promotion Trips, we will notify you either in the hub and/or via email. Revised Uber Shuttle Package Promotion Trips become effective upon notification to you and your continued use of Uber Shuttle Package Promotion Trips constitutes your acceptance of the revised terms.

8. Transfer of Rights.

Uber's rights and obligations under the Uber Shuttle Package Promotion Trips may be assigned or transferred by Uber to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.

9. Disclaimer.

All interpretations of these Uber Shuttle Package Promotion Trips will be at Uber's sole discretion and Uber's decisions will be final.

Uber Shuttle Packages and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons. We are not responsible for any unavailability, interruptions or errors of the Program or its features that are outside of Uber’s reasonable control. Uber may from time to time request information from you to confirm your identity. Uber may delay your access to Uber Shuttle Package Promotion Trips until you comply with this information request. Uber Shuttle Package Promotion Trips and all the information accessible through it are provided for information purposes only on an "as is" and "as available" basis. We, our information providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of Uber Shuttle Package Promotion Trips, the information, materials, content, availability, and products. Uber Shuttle Package Promotion Trips and these Uber Shuttle Packages Terms are provided by Uber and do not modify the contractual relationships among or between the individuals and entities that use Uber’s technology to offer or services, and Uber, except as expressly set forth herein. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties or merchantability and fitness for a particular purpose.
