Terms and Conditions Win a Motorbike Competition 2024

The following terms & conditions (the “Rules”) apply exclusively to the “Win a Motorbike Competition” (the “Competition”) and all Participants are deemed to have read, understood and accepted the Rules, by virtue of utilising and/or rendering independent personal services via the Uber Eats platform:

1. This Competition is organised by Uber Eats South Africa Proprietary Limited (the “Promoter”). As part of the Competition, Big Boy Fourways will be giving away a brand new Motorbike to one eligible delivery person (“Big Boy Give Away/ Prize”) in each city.

2. The Competition commences at 12:01 AM on Wednesday, 31 July 2024 and ends at 11:59 PM on Saturday, 31 August 2024 (the “Competition Period”). The time zone applicable to the Competition is South African Standard Time (SAST).

3. The Competition is only open to delivery people in Johannesburg, Cape Town, Durban, Polokwane, Bloemfontein and Gqeberha who have utilised and rendered their independent personal services through the Uber Eats platform in South Africa and who have met the qualifying criteria (“Participants”).

4. The Competition is only valid within the following cities in South Africa, namely Johannesburg, Cape Town, Durban, Polokwane, Bloemfontein and Gqeberha. Participants must be within South Africa at the time of entering and/or participating in the Competition for any potential verification process (to the extent necessary). Participants must be within South Africa at the time any Prize is awarded, should the Participants be declared the Winner, failing which, such person will be disqualified or ineligible and a different Winner shall be chosen under the same terms and conditions.

5. On each Monday during the Competition Period, the cohorts of eligible delivery people will receive an in-app notification of their qualification status.

6. All Participants who earned a valid entry will be invited to a lucky draw to be hosted in each city. The drawn entrants in each city will win Big Boy Give Aways provided that they are present at the draw.

7. In order to be eligible for the Competition and stand a chance to win the Prize, Participants must, on a weekly basis during the Competition Period:

7.1. Complete 6 (six) trips or more each day between 17:00 – 20:00 on a Friday, Saturday and Sunday, after which they will automatically gain 1 x entry; and
7.2. Achieve a completion rate of 98% for all delivery requests received by them on the Uber Eats platform for a particular week during the Competition Period, after which they will automatically gain 1 x entry; or
7.3. Complete 100% of all delivery requests received on the Uber Eats platform for a particular week during the Competition Period, after which they will automatically gain 2 x entries; and
7.4. Maintain a 90% acceptance rate for all delivery requests received by them on the Uber Eats platform, after which they will automatically gain 2 x entries (the “Qualifying Criteria”).

8. Each week is a new week to earn more entries into the draw. Participants can earn a minimum of 1 (one) entry each week by meeting the Qualifying Criteria. The more entries earned, the greater the chance of winning.

9. For the sake of clarity, trips completed on the Uber Package products are specifically excluded for consideration in terms of this Competition.

10. Only trips completed on the Uber Eats platform shall be considered for the Prize.

11. The Winners in each city will be chosen randomly via a draw, with Uber Eats randomly selecting a single entry from the pool of eligible entries. The Participants who correspond to the entry selected during the draw will be the Winners. The draw will be conducted at anAppreciation event to be hosted in each city between 5 September 2024 and 17 October 2024. In order to win, Participants must be present at the draw.

12. By participating in the Competition, Participants stand to win the following Prize:

13. If the Winner is not able to collect their Prize from Uber or an authorised agency within 30 (thirty) days of being notified, the reward shall be deemed forfeited.

14. Once the Winner has received the Prize, ownership of and risk in and benefit attaching to the Prize will pass on to the Winner immediately upon delivery of the Prize to the Winner.

15. If a Participant or the Winner (i) participated in the Competition or (ii) successfully received the Prize, in a manner, which in the Promoter’s sole discretion, provided the Participant or Winner with an unfair advantage over other entrants or Participants, such a Participant and/or Winner will be disqualified from this and potentially all future competitions run by the Promoter.

16. The Winner is obligated to behave responsibly and comply with the Competition Rules and all reasonable requests of the Promoter and its agents.

17. Prizes cannot be substituted for cash or any other alternative item.

18. The Competition is specifically not open to:

18.1. any person who is directly or indirectly involved or associated with the control of the Promoter or is controlled by the Promoter;
18.2. an employee, director, member, partner, agent or consultant of the Promoter;
18.3. an employee, director, member, partner, agent or consultant of the Promoter’s advertising agencies, advisers, dealers and suppliers;
18.4. immediate family members of any of the persons mentioned in paragraphs 18.1 – 18.3 above; and
18.5. any delivery person who is waitlisted and/or deactivated from the Uber Eats platform at any time during the Competition Period

19. This Competition is independent of any other offer from Uber Eats or Uber.

20. If a delivery person gets waitlisted or loses access to the Uber Eats platform, the delivery person will automatically be disqualified from the Competition and lucky draw.

21. All Participants and the Winner indemnify the Promoter, it’s advertising agencies, advisers, nominated agents, partners, suppliers and Uber Technologies Inc., its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in and/or use of any Prize in any way whatsoever in relation to this Competition (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoter and/or use of the Prize).

22. By entering into the Competition, the Participants agree that, should they be declared the Winner, Uber Technologies Inc. and its affiliates (including the Promoter, the Promoter’s advertising agencies, advisers, nominated agents, partners and suppliers) may contact the Winner via telephone call and email and/or use their names for any promotional reasons and activities. Uber Technologies Inc. and its affiliates, including the Promoter shall treat any personal information collected from the Participants and Winner in accordance with the Privacy Notice.

23. The Promoter may require the Winner to complete and submit an information disclosure agreement and indemnification to enable the Promoter to ensure compliance with these Rules and the Consumer Protection Act 68 of 2008. Should the Winner refuse or be unable to comply with this rule for any reason, such Winner will be deemed to have rejected the Prize and it shall revert back to the Promoter.

24. By taking part in the Competition, either wittingly or unwittingly, all Participants and the Winner agree to be bound by these Rules. Any dispute or uncertainty, of any nature, in relation to the Competition and the Rules, shall be decided and resolved by the Promoter, in its sole and absolute discretion, whose decision shall be final and binding on all affected or related persons. The Promoter expressly reserves the right at any time and without notice to the Participants or any other persons, and for any reason which the Promoter reasonably deems necessary or appropriate, in its sole and absolute discretion, to (i) amend, modify, or change these Rules and/or any prize and (ii) postpone, suspend or cancel this Competition and/or any prize, or any aspect thereof.
