Win a car, fuel for a year and more

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 

2. The promoter is Uber Australia Pty Ltd (ABN 49 160 299 865) of Level 8, 1 O'Connell St, Sydney NSW 2000 (“Promoter”). 

3. Entry is only open to Australian residents aged 18 years or over who are registered to use the Uber Driver App in Australia as a Driver Partner or Delivery Partner, (each an “Eligible Entrant”).  Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 

4. The Promotion commences at 12.00am on Thursday 15/08/2019 and ends at 11:59pm on Sunday 15/9/19 (“Promotional Period”). All times are in AEDT.

5. To enter Eligible Entrants must click on the link within the email or in app message sent directly to them from Uber, follow the prompts and answer the question “What is your best Uber story from the road? in 25 words or less.

6. This is a game of skill; chance plays no part in how a winner is determined in these Promotions. Winners of the Promotion will be selected on their answer to the 25 words or less question based on:
- The creativity of their answer; and 
- The uniqueness of their answers

7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's sole discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 

8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

9. The judging of the Promotion will take place at 12pm AEDT on Monday 16/09/2019 at 580 George Street, Sydney. The Promoter may judge additional reserve entries and record them in order in case an invalid entry or ineligible entrant is determined as a winner.

10. The winners of the Promotion will be contacted between 18/09/2019 and 20/09/2019 via email to confirm their contact details and agree to their details being shared with the promotional partners for delivery purposes. If the winner does not respond or claim the prize within 48hours, the right to the prize is forfeited.

11. The Promoter’s decision is final and no correspondence will be entered into.

12. There will be a total of one (1) Uber Pro Major Prize winner and ten (10) Uber Pro Minor Prize winners

Delivery: Prize will be delivered to the Holden Dealership closest to the winner’s residential address. The winner must collect the prize from this dealership. Please see additional terms specific to the vehicle prize below.

(Calculated at 1610 litres/yr at $2 per litre equals $3,250 per year and rounded up to $3,500).
Delivery: Caltex StarCash Digital gift card sent via a unique link emailed directly to the winner.

Delivery: JB Hi Fi Voucher sent directly to the winner via email

13. Prize vehicle conditions:  the following additional terms apply to the vehicle prize as part of the Major Prize Package:
- The colour of the prize vehicle will be determined by Holden GM depending on availability at the time of the winner of the Major Prize Package being notified that he or she has won this prize. 
-The prize includes registration, compulsory third party insurance, stamp duty and dealer delivery and on road costs (which may vary State to State).  Additional insurance, options, accessories, petrol and all other ancillary costs associated with the ownership and use of the Vehicle are the sole responsibility of the winner.
-If the winner is, through any legal incapacity or otherwise, unable to register the car in his or her own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. Neither GM Holden nor Uber takes any responsibility for any such arrangements between the winner and the assignee. The winner must provide Holden GM with certified copies of all required documentation as required by Holden before the car is awarded. It is a condition of accepting the Major Prize Package that the winner may be required to sign a legal release in a form to be determined by Holden GM in its discretion.
- The value of the prize is accurate and based upon the recommended retail value of the prize (inclusive of GST) as at the start date of the Competition. The Promoter accepts no responsibility for any variation in the value of the prize after that date.

14 All price items are valued based on recommended retail pricing inclusive of GST and the Promoter takes no responsibility for any variation in item values. Terms from the third party supplier of the above rewards may also apply, as notified to you by the relevant third party supplier. 

15. Prizes are not exchangeable or transferable and cannot be taken as cash.

16. Unless otherwise stated in these terms and conditions, the Promoter will make reasonable efforts to deliver the prize to the winner within 4 weeks of notification.  Once prizes have left the prize supplier’s/Promoter’s premises, Uber takes no responsibility for prizes damages, delayed or lost in transit. Prize items that are returned to sender, will result in the forfeiture of the prize.

17. A judging for any of the prizes, if unclaimed, may take place at the same time and place as the original judging 14 days from the date of the initial judging, subject to any directions from a regulatory authority. 

18. If a prize is unavailable, the Promoter, in its sole discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any directions of any regulatory authority. 

19. Entrants consent to the Promoter and its affiliates using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 

20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, or conduct of third parties involved in the delivery of any part of the prize, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 

21. Nothing in these Terms and Conditions limits, excludes, modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) or similar consumer protection laws in the state the judging is conducted (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

22. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; or (e) taking/use of a prize.
