Uber Hotels Terms and Conditions

These Terms and Conditions for Uber Hotels govern your access to and use of hotel booking services made available through the Uber platform, which enable you to search for, book, and pay for hotel accommodations provided by participating hotels (“Travel Providers”) through third-party booking partners (“Booking Partners”). Your use of Uber Hotels is subject to these Terms and Conditions and the general Canada Terms of Use, Privacy Policy, and Uber's Community Guidelines, which are incorporated herein (collectively “Uber Hotels Terms”).

Role of Booking Partners and Travel Providers

Hotel bookings made through the Uber platform are facilitated by Booking Partners. The applicable Booking Partner (including but not limited to Expedia or its applicable affiliate, such as Expedia Travel LLC or Travelscape LLC) or the Travel Provider, depending on the payment option selected at the time of booking (for example, pay now or pay at the property), will be the merchant of record for hotel bookings. The Booking Partner and/or Travel Provider, as applicable, is responsible for processing payments, identification verification and compliance, confirming reservations, and managing cancellations, refunds, and customer support related to hotel bookings.

Uber’s Role

Uber’s role is limited to re-marketing and facilitating access to Booking Partners’ hotel booking services and related functionality through the Uber platform. Uber is not a Booking Partner, hotel operator, or merchant of record for hotel bookings. Uber does not own, control, or manage any hotel accommodations and is not responsible for the acts or omissions of any Booking Partner or Travel Provider.

Your Agreement to Booking Partner Terms

By making a hotel reservation through the Uber platform, you agree to the terms and conditions of the applicable Booking Partner as presented to you at the time of booking, including these Supplier Terms and Conditions as updated from time to time.

You also agree to any additional terms, rules, and restrictions provided by the applicable Travel Provider at the time of booking, including cancellation policies, check-in requirements, and applicable fees.

You acknowledge that you must review and accept these terms at the time of booking in order to complete your reservation.

Travel Provider Terms

Each hotel booking is subject to the specific terms and conditions of the Travel Provider. These terms may include important information regarding cancellation eligibility, refundability, occupancy limits, incidental charges, and other restrictions.

It is your responsibility to review these terms prior to completing your booking.

  1. Payments and Charges

All charges for hotel bookings are processed by the applicable Booking Partner or the Travel Provider, depending on the payment option selected at the time of booking. Uber facilitates the payment process within the Uber platform by providing access at your election to your payment credentials via your Uber wallet, but is not the merchant of record for such transactions.

Prices for hotel bookings may change until a booking is confirmed. Taxes, service fees, local taxes, and other charges may apply. Bank or card issuer foreign exchange or cross-border transaction fees may also apply and are not controlled by Uber.

Changes, Cancellations, and Refunds

All changes, cancellations, and refund requests are governed by the applicable terms or policies of the Booking Partner and Travel Provider. Uber does not control and is not responsible for these policies or for the processing of any refunds.

Certain changes or modifications may not be available through the Uber platform and may require contacting the Booking Partner or Travel Provider directly.

Any Uber One credits or similar promotional benefits granted by Uber in relation to a hotel booking are governed by the terms of Section 9 (“Uber One Benefits and Rewards”) and any applicable terms surfaced at the time of redemption or acceptance.

Customer Support

Customer support for hotel bookings is provided primarily by Booking Partners or, where applicable, the Travel Provider. Uber may provide limited assistance in directing you to the appropriate support channel but is not responsible for resolving issues related to hotel bookings.

Booking confirmations and related travel documents will be sent to the email address you provide at the time of booking.

Travel Information and Availability

Information regarding hotel accommodations, including descriptions, photos, amenities, availability, pricing, and policies, is provided by Booking Partners and Travel Providers, respectively. Uber does not verify such information and does not guarantee that it is accurate, complete, or up to date.

Uber is not responsible for any inaccuracies, errors (including pricing errors), or omissions in such information, or for the unavailability of any hotel accommodations or their respective amenities or offerings. Availability and pricing may change at any time prior to booking confirmation.

Uber is not responsible for the performance or non-performance of any Booking Partner or Travel Provider, including any failure to provide booked accommodations or services. Uber is also not responsible for any delay, interruption, modification, or cancellation due to the acts of third-parties or a force majeure event (e.g., extreme weather).

Uber One Benefits and Rewards

Certain hotel bookings may be eligible for Uber One credits or other promotional benefits, discounts or awards (“Reward(s)”). Reward eligibility, timing, and amounts are subject to applicable terms and conditions presented at time of booking and the Uber One Terms and Conditions.

Rewards may be subject to verification processes, including confirmation of stay by the applicable Booking Partner or Travel Provider, and may be delayed or adjusted accordingly.

Except where required by law, Uber One terms, offers, and pricing are subject to change at any time without notice. Uber reserves the right to cancel, suspend, or modify Uber One or any part of it at its discretion.

Privacy

Uber’s Privacy Notice applies to the collection, use, and processing of your personal information by Uber in connection with your use of the Uber platform for hotel bookings.

To facilitate hotel bookings, Uber will share certain personal information with the applicable Booking Partner and, where applicable, the Travel Provider. This may include information such as your name, contact details, booking details, payment information, and other information necessary to complete and manage your booking.

Booking Partners and Travel Providers are independent of Uber and are responsible for their own collection, use, and disclosure of personal information. Uber does not control the privacy or security practices of any Booking Partner or Travel Provider. You should review the applicable Booking Partner’s Privacy Statement for more information about how your personal information is handled.

Community Guidelines

Your use of the Uber platform, including in connection with hotel bookings, remains subject to Uber’s Community Guidelines, as updated from time to time.

You agree to comply with these Guidelines in all interactions related to your use of the Uber platform, including interactions with Booking Partners, Travel Providers, Uber support, and other users. Failure to comply with the Community Guidelines may result in the limitation or loss of access to some or all of the Uber platform.

A suspension or deactivation of your Uber Account may not necessarily cancel any hotel booking made via Uber with a Booking Partner and/or with a Travel Provider. You should refer to your booking confirmation email and contact the applicable Booking Partner or Travel Provider directly to continue, modify, or cancel your booking.

Dispute Resolution and Arbitration

Canada

Dispute Resolution.

a. Dispute Resolution to be by Arbitration:

i. All Disputes arising out of or in connection with the Agreement, or in respect of any legal relationship associated with or derived from the Agreement, will be finally and conclusively resolved by arbitration, on an individual basis, under the Arbitration Rules (“ADRIC Rules”) of the ADR Institute of Canada, Inc. (“ADRIC”), except as modified herein. The ADRIC Rules are available by searching www.google.ca to locate “ADRIC Arbitration Rules” or by clicking here. ADRIC may also be contacted at 1-877-475-4353 or www.adric.ca.

ii. The governing law, known as the Seat of Arbitration, will be Ontario. The language of the arbitration will be English or French, at your choice.

iii. The arbitration hearings and meetings may be held at any location(s) the arbitrator considers appropriate. Arbitration hearings may be conducted by telephone, email, the Internet, videoconferencing, or other communication methods, unless the arbitrator disagrees.

iv. If any portion of this Dispute Resolution provision is unenforceable, the remainder of this Arbitration Provision will be enforceable. This Arbitration Provision survives the termination of Uber’s relationship with the Booking Provider, and it continues to apply if Booking Provider’s relationship with Uber is ended but later renewed.

v. This Dispute Resolution provision applies to, without limitation, Disputes arising out of or relating to interpretation or application of this Agreement, including the formation, scope, enforceability, waiver, applicability, revocability or validity of this Dispute Resolution provision or any portion of this Dispute Resolution provision.

b. Class Action Waiver:

i. Both Uber and customer agree to bring any Dispute in arbitration on an individual basis only, and not on a class or collective basis on behalf of others. There will be no right or authority for any Dispute to be brought, heard or arbitrated as a class or collective action, or for customer to participate as a member in any such class or collective proceeding.

c. Arbitration Process:

i. Before starting arbitration with ADRIC, the party bringing the claim in arbitration must first deliver a written Notice of Request to Arbitrate (“Notice”) within the limitation period that would apply if the claim were brought in a Court in your province or territory of residence, or of Ontario if you reside outside Canada. The Notice must include contact information for the parties, the legal and factual basis of the claim, and the remedy sought and amount claimed. Any demand for arbitration made to Uber must be served to the party’s registered address for service of legal process as follows:

ii. Before the Notice is delivered to ADRIC, the party bringing the claim shall first attempt to informally negotiate with the other party, in good faith, a resolution of the Dispute, claim or controversy between the parties for a period of not less than 30 days but no more than 45 days unless extended by mutual agreement of the parties. If the parties cannot reach an agreement to resolve the dispute within this negotiation period, the party bringing the claim may deliver the Notice to ADRIC.

Limitation of Liability for Travel Services

To the fullest extent permitted by law, Uber is not liable for any damages, losses, or claims arising out of or related to hotel bookings, including, without limitation, any acts, errors, omissions, representations, warranties, or negligence of any Booking Partner or Travel Provider, or any issues related to reservations, cancellations, no-show, refunds, service quality, or the availability of accommodations.

All limitations of liability set forth in Uber’s Terms of Use apply to your use of hotel booking services.

Indemnification

Without limiting any indemnification obligations set forth in Uber’s Terms of Use, you agree that such obligations apply to your use of hotel booking services, including any breach of applicable Booking Partner terms, Travel Provider policies, or misuse of the Uber platform in connection with hotel bookings.

  1. Other Provisions

Uber may, in its sole discretion and subject to applicable law, modify, suspend, or discontinue any aspect of Uber Hotels, in whole or in part, at any time, including these Uber Hotels Terms, without prior notice where permitted by law. To the maximum extent permitted by law, your continued use of Uber Hotels after the effective date of any updated Uber Hotels Terms constitutes your acceptance of such changes. If any change of these Uber Hotels Terms is found to be invalid, void, or unenforceable for any reason, that provision will be severable and will not affect the validity and enforceability of the remaining provisions.
