Senior Account Terms of Use
By accepting the invite to create a Senior Account as part of an Uber Family profile, you acknowledge and agree to these Senior Account Terms of Use, governing your use of the Services. You confirm that you are of legal age and have the mental and legal capacity to enter into this agreement and delegate the rights described herein. You agree to grant an individual authority to assist with managing your Senior Account (“Family Organizer”) within the Uber Family profile. This assistance may include managing payment information, requesting trips, managing addresses (“Saved Places”), and communicating with Uber support on your behalf. You acknowledge and understand that you may only modify, or revoke the permissions granted to the Family Organizer by leaving the Uber Family profile. If you require assistance doing so, you may contact Uber Support. Your Family Organizer has also agreed to these Senior Account Terms of Use.
You agree that Uber may contact you or your Family Organizer through the Uber app, by phone, email or other reasonable means regarding your use of the Services, including regarding issues and incidents reported by you, your Family Organizer, drivers, or others. You acknowledge that Uber may contact you without your Family Organizer being present. You further understand and agree that information either you or your Family Organizer provide to Uber in connection with using your Senior Account for Services may be shared with each other.
You and your Family Organizer are jointly responsible for ensuring that the Senior Account is used solely for authorized purposes. This includes financial responsibility: You will be responsible for all payments, purchases, and transactions made using the payment method, even those initiated by your Family Organizer. Uber's responsibility is limited to providing the Services, and we are not responsible for any misuse of funds by the Family Organizer beyond their authorized permissions. Any financial disputes related to transactions must be resolved directly between you and your Family Organizer. You understand that Uber does not mediate disputes between Senior users and Family Organizers and disclaims all liability for unauthorized or unintended use of your payment method, to the maximum extent permitted by law.
Authority of the Family Organizer
You acknowledge and consent to your Family Organizer having the authority to take the following actions with respect to your Senior Account:
- Request rides on your behalf, which will be charged to the payment method that you delegated to them. Once requested, they can also change or cancel rides on your behalf.
- Access your account’s registered phone number and trip details for all past and present rides. This includes your real-time trip location details and receipts for these past rides.
- View, create, edit, and delete any of your Saved Places. You will be notified when Saved Places are modified or deleted.
- Communicate with drivers concerning your trips, including communications with the driver on trips they have requested for you.
- Act on your behalf in safety incidents, including reporting issues and contacting emergency services.
You acknowledge and accept that you may only modify or revoke the Family Organizer’s permissions by leaving the Uber Family profile. If you require assistance doing so, contact Uber Support.
Limitations of the Family Organizer
- Your Family Organizer should not use your payment method to request travel for themselves.
- Use of a payment method by your Family Organizer is subject to the terms and conditions of the relevant payment method provider. You are responsible for complying with such terms and conditions and assume all risks related to delegating use of such payment method.
You and your Family Organizer are both responsible for ensuring the account is used only for authorized purposes. If Uber becomes aware of misuse, including unauthorized ride requests, we may limit or revoke access to the Family profile.
You acknowledge that your acceptance of these Terms constitutes consent to the permissions and authority granted to the Family Organizer as described in these Terms.
Your local jurisdiction may have laws and regulations governing when, where, or how you may use the Uber App and Services. You understand you and your Family Organizer are responsible for knowing and obeying all laws or regulations that could impact your use of your Senior Account and the Uber App. Your local jurisdiction may also have laws and regulations governing how Uber must respond in the event of an incident involving you or your authorized guests, and you understand that Uber may be required to take certain actions, including mandatory reporting to designated authorities. Uber reserves the right to cooperate with law enforcement or other legal authorities if it believes that any activity related to the Senior Account violates applicable laws or regulations.
Where allowed by local, provincial, state, and/or federal law and enabled in the Uber App, Uber may facilitate the use of audio and/or video recording on trips.
You acknowledge the Privacy Notice, and understand it governs our use of your data. You also acknowledge the Community Guidelines, and understand that both your Senior Account and your Family Organizer’s account may be impacted if you or your Family Organizer fails to adhere to those guidelines. You further understand that the General Terms of Use, including but not limited to the arbitration provisions therein, apply to your use of the Services, and any failure by you to adhere to those requirements may impact both your account and your Family Organizer’s account.
Family Organizer Terms of Use (Senior Account)
These terms apply to your use of the Services in connection with an account for an individual aged 65 or older within your Uber Family Profile (“Senior Account”). Any terminology in these Senior Account Terms of Use that is not otherwise defined has the meaning specified in the General Terms of Use. These terms are based on the understanding that the Senior Account user has the legal capacity to understand and voluntarily consent to these terms and the permissions granted to the Family Organizer. If there are concerns about the Senior Account user’s capacity to provide such consent, other legal arrangements such as a power of attorney or guardianship may be necessary.
By agreeing to manage a Senior Account as a Family Organizer, you attest that you are permitted to request and manage Services on behalf of a Senior that has accepted an invitation to join your Uber Family profile (“Senior Account user”). You confirm that you are acting with the full, voluntary consent of the Senior Account User. You are not acting as a legal representative or agent unless separate documentation, such as a power of attorney, is on file with Uber. You acknowledge and understand that the Senior Account user has also agreed to the Senior Account Terms of Use, governing their use of the Services. You represent you have obtained the consent of the Senior Account user to access and manage their personal information within your Uber Family profile. You have or will review the Senior Account Terms of Use with the Senior Account user, and you acknowledge that the Senior Account user has agreed to those Terms. You agree that Uber may contact the Senior Account user regarding issues and incidents reported by you, the Senior Account user, drivers, or others. You also understand that should you wish for the Senior Account user to no longer have access to their Senior Account, you are responsible for managing their access within your Uber Family profile.
IMPORTANT: PLEASE BE ADVISED THAT THE GENERAL TERMS OF USE APPLIES TO THIS AGREEMENT AND CONTAINS PROVISIONS THAT GOVERN HOW CLAIMS BETWEEN YOU AND THE SENIOR ACCOUNT USER, AND UBER, CAN BE BROUGHT, INCLUDING AN ARBITRATION AGREEMENT AND/OR REQUIREMENT. PLEASE REVIEW THE ARBITRATION AGREEMENT CAREFULLY, AS IT REQUIRES YOU AND THE SENIOR ACCOUNT USER TO RESOLVE ALL DISPUTES WITH UBER ON AN INDIVIDUAL BASIS AND, WITH LIMITED EXCEPTIONS, THROUGH FINAL AND BINDING ARBITRATION. BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THE GENERAL TERMS OF USE AND HAVE TAKEN TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION FOR YOU AND THE SENIOR ACCOUNT USER.
You acknowledge and agree that information provided by either you or the Senior Account user to Uber may be shared with each other, and you have the following permissions with respect to the Senior Account:
- Full access to the Senior Account user’s Saved Places
- The ability to book rides for the Senior Account user using Saved Places
- The ability to track trip details for all past and present rides completed under the Senior Account within your Uber Family profile
- The ability to set spending limits for the Senior Account
- The ability to contact drivers on behalf of the Senior Account user
- The authority to act as a proxy for the Senior Account user in safety incidents, including reporting issues to support and contacting emergency services on their behalf.
You acknowledge that your authority as a Family Organizer is limited as follows:
- Your access to the Senior Account user's payment methods is solely for the purpose of facilitating transportation services and must be used in a manner that benefits the Senior Account user.
- You may not share any payment information or personal information of the Senior Account user with others.
- By requesting a ride using the Senior Account user's payment method, you represent and warrant that the Senior has given you full authority to request that particular ride. This includes authority for each ride’s details, such as ride type, pickup/dropoff location, and any on-trip preferences.
- You may not request rides for emergency purposes.
- In addition to these Terms, Uber’s general Terms of Use and Community Guidelines still apply to rides you request on behalf of the Senior Account user. Your account access may be impacted if you violate these terms.
Enforcement and Account Access
Misuse of a Senior Account, including requesting rides for your own use without consent, may result in the restriction or removal of your access to the Uber Family profile.
You agree that only you, the Senior, and otherwise authorized adults may access the Services using the Senior Account. You and the Senior Account user are fully responsible for ensuring that the Senior Account is only used for authorized purposes.
Your local jurisdiction may have laws and regulations governing when, where, or how the Senior Account user may use the Uber App and Services. You understand you and the Senior Account user are responsible for knowing and obeying all laws or regulations that could impact the use of their account and the Uber App. Your local jurisdiction may also have laws and regulations governing how Uber must respond in the event of an incident involving the Senior Account user or their authorized guests, and you understand that Uber may be required to take certain actions, including mandatory reporting to designated authorities. Uber reserves the right to cooperate with law enforcement or other legal authorities if it believes that any activity related to the Senior Account violates applicable laws or regulations.
You acknowledge the Privacy Notice, and understand it governs our use of both your data and that of the Senior Account user. You also acknowledge the Community Guidelines, and understand that both your account and the Senior Account may be impacted if you or the Senior Account user fails to adhere to those Guidelines or these Senior Account Terms of Use. You further understand that the General Terms of Use apply to the Senior Account user’s use of the Uber Services and their Senior Account, including but not limited to the arbitration provisions therein.
