Digital Services Act - Information on active monthly recipients of Uber’s services & contact details

The Digital Services Act (“DSA”) entered into force in the European Union (“EU”) on November 16, 2022.
Under Article 24(2) of the DSA, online platforms are required to publish ‘information on the average monthly active recipients of the service’ in the EU at the latest three (3) months after the entry into force of the DSA and at least once every six months thereafter. This is for the purposes of determining whether an online platform is a ‘very large online platform’ (“VLOP”).
Uber confirms that the average number of monthly active recipients of its services for the period January to July 2023 in the EU was below 45 million. As such Uber remains below the threshold for VLOP designation. This number has been calculated in accordance with the relevant provisions of the DSA and the Guidance published by the European Commission on February 1, 2023.
Member States’ authorities, the European Commission and the European Board for Digital Services can contact Uber at digital-services-act-group@uber.com, which is to be regarded the ‘single point of contact’ pursuant to Article 11 of the DSA. Communications can be directed in English or Dutch.
