Advantage Mode Terms and Conditions
I. Introduction
The following terms and conditions govern Advantage Mode (“Advantage Mode”), a program brought to you by Uber Technologies, Inc. or its respective subsidiaries, licensees, and affiliated companies. Participation in Advantage Mode is subject to these terms and conditions, your Platform Access Agreement and Uber’s Privacy Notice, which are incorporated herein (collectively, the “Program Terms”). By participating in Advantage Mode you are agreeing to these Program Terms.
II. ELIGIBILITY
To be eligible for Advantage Mode, you must (1) reside in the United States, (2) meet all eligibility requirements to be a driver (a “Driver”) as set by applicable law and Uber; (3) have a Driver account in active standing; (4) have set your home city within the Uber app to an Eligible Location in the United States; and (5) maintain the following while driving with Uber:
- An acceptance rate of 25% or more;
- A cancellation rate of 8% or less;
- A star rating of at least 4.85; and
- A CMT Driving Insights score of 75 or more.
Your eligibility for Advantage Mode will be reviewed as follows:
- Your acceptance rate, cancellation rate, or star rating will be calculated within ten minutes after each: 1) trip acceptance, 2) trip cancellation, or 3) new star rating.
- Your CMT Driving Insight’s Score will be calculated as of 5 a.m. local time each day.
All Drivers meeting all of the qualifications will be automatically placed in Advantage Mode. Once Advantage Mode is active, there is no additional action required to participate in Advantage Mode. If you are currently in Advantage Mode, and your acceptance rate, cancellation rate, star rating, or CMT Driving Insights score fall below the qualification thresholds you may continue to be eligible for Advantage Mode for a limited period, after which you will return to Standard Mode.
Drivers who do not meet the qualifications will be in Standard Mode (“Standard Mode”), where they receive a higher proportion of trip requests through the Uber Driver App’s Trip Radar feature. Drivers in Standard Mode will not be eligible for Advantage Mode rewards.
Your cancellation rate, acceptance rate, and CMT Driving Insights Score are calculated as follows:
- Cancellation & Acceptance Rate: Your cancellation rate will be calculated taking the number of rides or delivery requests you canceled over the last 100 accepted requests, including matched Trip Radar requests, received in the last 3 years. Your acceptance rate will be calculated taking the number of rides or delivery requests you accepted, or Exclusive Ride Requests you let expire, over the last 100 Exclusive Rides Requests received in the last 3 years.
- CMT Driving Insights Score: Your score is based on data from your last 50 trips that ended on or after June 27, 2024. This includes completed trips and canceled trips. Shared rides are excluded, as well as food, package, and rental vehicle deliveries. More information about how your CMT Insights Score is calculated is outlined here.
Drivers who signup for the platform in an Eligible Location may receive a trial (“the Trial”) of Advantage Mode for their first fifty (50) rides or delivery trips. After the Trial, Drivers will need to meet the requirements listed above to continue to be in Advantage Mode.
III. Eligible Locations
To access Advantage Mode or any Rewards (as defined below), you must have your home city set in one of the following cities: Atlanta, GA, Austin. TX, Baltimore, MD, Birmingham, AL, Boise, ID, Central Atlantic Coast, FL, Charleston, SC, Charlotte, NC, Cincinnati, OH, Cleveland, OH, Columbia, SC, Columbus, OH, Connecticut, Dallas, TX, Detroit, MI, El Paso, TX, Fort Myers-Naples, FL, Grand Rapids, MI, Greenville, SC, Hampton Roads, VA, Harrisburg, PA, Houston, TX, Indianapolis, IN, Jacksonville, FL, Kansas City, MO, Las Vegas, NV, Lehigh Valley, PA, Louisville, KY, Madison, WI, Memphis, TN, Miami, FL, Nashville, TN, New Orleans, LA, Oklahoma City, OK, Omaha,NE, Orlando, FL, Philadelphia, PA, Phoenix, AZ, Piedmont Triad, NC, Pittsburgh, PA, Raleigh-Durham, NC, Reno, NV, Rhode Island, Richmond, VA, Salt Lake City, UT, San Antonio, TX, Sarasota, FL, Savannah-Hilton Head, GA, St. Louis, MO, Tallahassee, FL, Tampa, FL, Tucson, AZ, Tulsa, OK, Wilkes-Barre Scranton, PA (the “Eligible Locations”).
IV. Rewards:
Drivers who qualify for Advantage Mode receive the following rewards (collectively the “Rewards”):
- Exclusive Ride Requests: Drivers in Advantage Mode will receive a higher proportion of ride requests through the Uber Driver app which are sent directly to them and which are exclusively theirs to accept or decline before they expire (“Exclusive Ride Requests”).
- The following rides types are not eligible for the Exclusive Ride Requests Reward: delivery trips (such as Uber Eats and Uber Connect), Taxi, Uber XShare, Uber Wait & Save, Uber Black, Uber Black SUV, Uber Premier, Uber Premier SUV, Uber WAV and Uber Reserve, ride requests originating at airports, and trips that do not originate in an Eligible Location.
- Additional Earnings: Drivers in Advantage Mode earn five percent (5%) more on UberX and other non-premium ride types than a Driver would for that trip in Standard Mode (“Additional Earnings”).
- The Additional Earnings Reward is available only to drivers taking eligible non-premium rides that originate in an Eligible Location when in Advantage Mode.
- Commute, delivery trips (such as Uber Eats and Uber Connect), Hourly, Taxi, Uber Black, Uber Black SUV, Uber Premier, and Uber Premier SUV are not eligible for the Additional Earnings reward. Certain earnings such as Quest promotions, tips, wait time fees, cancel fees, tolls, and other third-party fees and operational expenses as stated on your receipt are not included in the calculation of the 5% Additional Earnings Reward. Uber does not guarantee drivers will experience higher earnings than earnings received prior to the launch of Advantage Mode.
- The Additional Earnings Reward while in Advantage Mode will be shown as a separate payout on the trip receipt and weekly earnings statement and is in comparison to eligible earnings that a Driver in Standard Mode would earn for the same trip.
- Earnings: The Uber app or communications sent by Uber may contain information about the earnings of drivers in Advantage Mode, including statements indicating that the majority Drivers in Advantage Mode earn more per online hour than drivers in Standard Mode. This stated percentage is based on the median earnings per hour online of Advantage Mode drivers compared to the median earnings per hour online of Standard Mode drivers in Austin; Charlotte; Columbus; Kansas City, KS/MO; Miami; Nashville; Phoenix; and Tampa, between 7/15/24 and 1/19/25. Actual earnings vary, based on factors like number of trips completed, time of day, and location. Earnings include trip fares, certain promotions (which are subject to change and may vary), and tips (which are provided at the discretion of the rider). Median earnings in your area may be lower than the city's and your earnings could be above or below the median (which is the middle). For the avoidance of doubt, drivers are paid based on their completed trips, but not hourly or weekly.
- Airport Rewards: At airports, drivers in Advantage Mode receive priority matching for rides requests through the Uber Driver app’s Trip Radar feature.
- The following ride types are not eligible for priority matching for Trip Radar at airports while in Advantage Mode: Delivery trips (such as Uber Eats and Uber Connect), Taxi, Uber Black, Uber Black SUV, Uber Wait & Save, Uber WAV, Uber Premier, Uber Premier SUV, Uber XShare and trips that do not originate in an Eligible Location.
V. TERMINATION OF ACCESS & DISCLAIMERS
Uber may suspend, revoke, or terminate your access to Advantage Mode at any time for any reason. Uber reserves the right to modify, suspend or discontinue Advantage Mode, or any part thereof, at any time without notice and without further obligations to you, including by changing the specific Rewards offered; change any other requirements necessary to obtain Rewards.. Any and all changes and/or amendments to these Program Terms will become binding upon all users of Advantage Mode immediately upon being updated.
Advantage Mode and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons outside of Uber’s control. Uber is not responsible for any unavailability, interruptions or errors with Advantage Mode, its features or any Rewards. Advantage Mode and all the information accessible through it are provided for informational purposes only on an “as is” and “as available” basis. Uber and our affiliated entities make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
