TERMS AND CONDITIONS - [WOMEN DRIVE WOMEN IN KSA]
These terms and conditions (the T&Cs) constitute a legal agreement supplementing the Uber BV Services Agreement entered into between you and Uber. In order to use the Women Preferred view, you must agree to the terms and conditions set forth below. Upon your execution (electronic or otherwise) of the T&Cs, you shall be bound by the T&Cs set forth herein.
1. DEFINITIONS
1.1 "Customer" has the same meaning given to it under the Uber BV Services Agreement;
1.2 "Driver" has the same meaning given to it under the Uber BV Services Agreement;
1.3 "KSA" means the Kingdom of Saudi Arabia;
1.4 "Woman Driver" means any individual notated as a female Driver;
1.5 "Woman User" means a individual notated as a female Customer; and
1.6 Capitalized terms used herein and not otherwise defined herein shall have the meaning ascribed to such terms in the Uber BV Services Agreement.
2. SCOPE OF PRODUCT
2.1 These T&Cs are intended to regulate a pilot service to be launched in KSA allowing Women Drivers to indicate a preference for incoming requests from Women Users ("Product").
2.2 The Product will only be available to Women Drivers. Customers (including Women Users) will not have the option to request Women Drivers.
2.3 Uber will, to the extent possible, match Women Drivers that opt into the Product with Women Users. Uber cannot guarantee that Women Drivers will be matched with Women Users at all times. Uber cannot guarantee that it will correctly identify the gender of Women Drivers and the gender of Women Users. Driver shall release Uber of any and all liability to Driver as a consequence of matching with a male Customer. Uber will not in any circumstances be responsible or liable to compensate a Driver or accept any liability (whether direct, indirect, incidental, exemplary, punitive, or consequential) in connection with a Driver’s usage of the Product.
2.4 Uber reserves the right to suspend, cancel or amend the T&Cs at any time.
3. USE OF THE PRODUCT
3.1 Gender verification of Drivers.
Uber will notate a Driver as a Woman Driver at the time an individual signs up as a Driver by attempting to verify the gender of the Driver based on the Driver's photograph on the Driver’s official identification card. This verification process will take place once. Uber reserves the right to suspend or cancel the account of any male Driver that falsifies any onboarding document.
3.1.1 Gender verification of Customers.
(a) Uber will attempt to verify the gender of the Customer initially from the first name associated with the Customer’s Uber account, and will prompt all Customers initially notated as Woman Users, by way of a pop up message in the Uber application, to self-identify their gender and confirm that they identify as a woman.
(b) Uber will not carry out any further dedicated gender verification related to its Customers.
(c) Uber reserves the right to suspend or cancel the account of any male Customer that misrepresents his gender when signing up to use [Uber application].
3.1.2 Impact of using the Product.
(a) Using the Product may limit the number of requests Women Drivers who opt into the Product receive and may impact the utilisation and earnings of Women Drivers, since they will, to the extent possible, only be receiving ride requests from Women Users.
(b) A Woman Driver may turn off the Product at any time. If a Woman Driver turns off the Product, a Woman Driver may be matched with Customers of any gender. A Woman Driver may turn the Product on and off at any time and as many times as she wishes.
3.1.3 Right to cancel.
(a) A Woman Driver may cancel the trip at any time without any penalty if the Customer is a male and is unaccompanied by one or more females, provided that the Product was enabled when the pickup request was accepted.
(b) A Woman Driver may be matched to a male Customer, while using the Product, for example if a Woman User requested the trip for another male passenger, or if a male Customer misrepresented his gender in the Customer gender verification process (referenced in 2.1.1).
(c) The right extended in 3.1.3 (a) shall not apply when there is at least one (1) female in a group, even if the group has a mix of males and females.
