UBER PLUS BETA TERMS AND CONDITIONS
Uber Plus (the “Program”) is brought to you by Uber India Systems Private Limited., or its respective subsidiaries, licensees and affiliated companies (collectively “Uber” or “we”). These Program Terms (defined below) constitute a legal agreement between you and Uber.
Participation in the Program is also subject to the general Privacy Policy, and your Technology Services Agreement, which are incorporated herein (collectively, the “Program Terms”). By participating in this Program you are agreeing to these Program Terms.
Uber is a technology company, not a provider of transportation services, as such all rewards offered under the program are offered on an “as available” basis, contingent upon requests from riders for the transportation services and other contingencies which may impact availability of some rewards at certain times and places.
THE PROGRAM IS CURRENTLY BEING OFFERED IN SELECT CITIES, WITH CERTAIN REWARDS AVAILABLE IN CERTAIN CITIES. YOU UNDERSTAND THAT UBER MAY TERMINATE OR MODIFY THE PROGRAM (INCLUDING, WITHOUT LIMITATION, WHAT THE REWARDS ARE, HOW YOU QUALIFY FOR THEM, THE DURATION OF THE PROGRAM) AT ANY TIME AT UBER’S SOLE DISCRETION. ALL AND ANY REWARDS ON OFFER BY UBER ARE AT THE COMPLETE DISCRETION OF UBER AND UBER MAY CHOOSE TO PROVIDE ALL OR ANY REWARDS IN ALL OR ANY CITIES IN INDIA AS DETERMINED BY UBER AT ITS SOLE DISCRETION. THE REWARDS OFFERED UNDER THE PROGRAM ARE NOT IN THE NATURE OF EMOLUMENTS AND DO NOT CREATE ANY EMPLOYER EMPLOYEE or AGENCY RELATIONSHIP BETWEEN UBER AND THE DRIVER PARTNERS. THE PROGRAM IS A LOYALTY PROGRAM BEING INTRODUCED BY UBER TO INCREASE LOYALTY AND ADAPTATION OF UBER PLATFORM BY DRIVER PARTNERS.
You understand that all central, state and local taxes on the Rewards that you accept are your sole responsibility as the Reward recipient.
ELIGIBILITY
All participants in the Program are “Program Members.” In order to participate in the Program, you must (1) reside in India, (2) meet all eligibility requirements to be an Uber Driver Partner (a “Driver Partner”) as set by applicable law and Uber; and (3) have set your home city within Uber Driver App as one of the participating cities listed below (each, a “Participating City”). Active Driver Partners that are in Agra, Ahmedabad, Ajmer, Amritsar, Aurangabad, Bangalore, Bhopal, Bhubaneswar, Chandigarh, Chennai, Coimbatore, Dehradun, Delhi NCR, Guwahati, Hyderabad, Indore, Jaipur, Jodhpur, Kanpur, Kochi, Kolkata, Kota, Kozhikode, Lucknow, Ludhiana, Mangalore, Mumbai, Mysore, Nagpur, Nashik, Patna, Prayagraj, Pune, Raipur, Ranchi, Surat, Thiruvananthapuram, Thrissur, Udaipur, Vadodara, Varanasi, Vijayawada, Visakhapatnam will be enrolled in the Program. Uber may at its sole discretion, expand the coverage of the Program to all the remaining active Driver Partners in the above mentioned cities.
Your rewards program account (“Program Account”) will automatically be linked to your Driver Partner account. You may not share your Program Account or have multiple memberships.
HOW YOUR TIER IS DETERMINED
You must earn points (“Points”) to access the different Tiers (defined below) and the rewards offered in each Tier. You will earn 1 Point for every trip you complete as a Driver Partner during the non-peak hours, in the following views: UberGo, UberPOOL, UberXL, UberPremier, UberHire and UberIntercity in India. Each such trip shall count as an “Uber Trip” for the purposes of this Program. You will earn an additional amount of Points (for a total of 3 points if your home city is Agra, Ahmedabad, Ajmer, Amritsar, Aurangabad, Bangalore, Bhopal, Bhubaneswar, Chandigarh, Chennai, Coimbatore, Dehradun, Delhi NCR, Guwahati, Hyderabad, Indore, Jodhpur, Kanpur, Kochi, Kolkata, Kota, Kozhikode, Lucknow, Ludhiana, Mangalore, Mysore, Nagpur, Nashik, Patna, Prayagraj, Pune, Raipur, Ranchi, Surat, Thiruvananthapuram, Thrissur, Udaipur, Vadodara, Varanasi, Vijayawada, Visakhapatnam, or if your home city is Mumbai a total of 4 points, or if your home city is Jaipur a total of 2 points) when you either a) pick-up a rider and commence a trip or b) complete a trip, during the following times (displayed in the local time zone) (“Additional Point Hours”):

You earn Points in fixed three month periods. The fixed three month periods (each a “Program Period”) are currently set as follows:
Program Period 1: July 1, 2019 -September 30, 2019
Program Period 2: October 1, 2019 - December 31, 2019
Program Period 3: January 3, 2020- March 31, 2020
Program Period 4: April 1, 2020- June 30, 2020
Program Period 5: July 1, 2020- September 30, 2020
(The program may continue beyond the period of September 30, 2020, at Uber’s sole discretion)
Points expire and reset to zero at the end of every Program Period. They do not carry over to the next Program Period. Points will count in the Program Period in which Uber processes the point (which may be the next Program Period). You will not earn any Points for taking rides as a rider on Uber App. Points have no cash value and are used solely to determine your Program Tier. Points may be revoked if a ride, for which Points were earned, is refunded or if Uber believes, in its sole discretion, that Points were earned through or in connection with any fraud, abuse of the platform, or in violation of Uber’s Community Guidelines
A Program Members’ Tier status shall be determined by: 1) the Points earned in the previous Period; 2) At Fault Cancellation Rate (calculated on a rolling thirty (30) day basis) 3) Acceptance Rate (calculated on a rolling thirty (30) day basis) and 4) Star Rating average over the past 500 trips. If a Program Member has completed less than 500 trips, the Star Rating is based on the average Star Rating of all lifetime trips.
On (1) above, for Program Members who were not Program Members in the previous Period, we will use the period in which the Program Members start taking trips to determine Program Member Tier status in the next period.
PROGRAM TIERS AND WINDOWS
The Program offers four membership Tiers: Blue, Gold, Platinum and Diamond (“Tiers”). Tiers unlock access to certain rewards (“Rewards”) offered by Uber and/or third parties. Each successive Tier includes its own Rewards as well as the Rewards of the preceding Tiers.
The Points you earn in one Program Period, will determine your Tier in the next Program Period. Tiers are not permanent and must be earned for every Program Period. IN ADDITION TO THE POINTS THRESHOLD OUTLINED BELOW, YOU MUST ALSO HAVE MORE THAN STAR RATING, MORE THAN ACCEPTANCE RATE AND LESS THAN THE CANCELLATION RATE, AS MAY BE NOTIFIED TO YOU BY UBER FROM TIME TO TIME ON A PER CITY BASIS.

You can move to a higher Tier during the current Program Period if you meet the Points and rating requirements described above. In that case, you will automatically be moved to the next Tier and you will stay in that Tier for the current Program Period and the next Program Period. For example, if you are a Driver Partner in Delhi NCR and earn your 500th Point and have the required rating (4.75 or greater), cancellation rate (6% or less) and acceptance rate (85% or greater) in Program Period 3, you will have earned the Gold Tier for the remainder of the Program Period 3 and for the entire Program Period 4 provided you maintain all Quality Standards during Program Period 4 (see “Maintaining Your Tier” below).
Once you obtain a higher Tier, you may be able to immediately access some Rewards for the higher Tier, but not all Rewards may be available immediately. Some Rewards, including without limitation, the Faster Pickups at Select Airports, Trip Duration and Trip Direction, may require you to go offline and back online within the Uber Driver App for the Reward to apply to your next trip.
MAINTAINING YOUR TIER - Quality Standards
In order to maintain your Gold, Platinum or Diamond Tier status during the entire applicable Program Period, you must maintain, at all times (1) the minimum Star Rating (2) a cancellation rate lower than the defined cap and (3) a minimum acceptance rate (collectively, the “Quality Standards”), as may be notified to you by Uber from time to time for the respective cities.
If you fail to meet any of the Quality Standards, you will lose your Tier status and access to the corresponding Rewards until you reach the minimum Star Rating, a cancellation rate lower than the defined cap and the minimum acceptance rate, as may be notified to you by Uber from time to time for respective cities which shall have a higher cut-offs as compared to the Quality Standards. If you fail to meet any of the Quality Standards, you will maintain access to the Blue Tier and the corresponding Rewards as long as you remain in the Uber Pro Program.
HOW TO VIEW POINTS BALANCES
You can view your current Points balances within the settings of your Uber Driver App. Any errors or omissions on transactions posted to your Program Account must be reported within one month by contacting Uber as noted in the Contact Us section below. Failure to supply necessary documentation may result in an inability to award Points. For verification, you should retain all receipts and documentation until your Points are credited to your Program Account.
It may take approximately 72 hours for your cancellation and acceptance rate to refresh. In the event of an outage of the Uber systems, your Points may be delayed in displaying in your Program Account. Additionally, if the outage occurs near the end of a Program Period, it is possible the Points will not be applied until the next Program Period.
ACCOUNT CLOSURE
Participation in the Program is a privilege granted to Driver Partners, and as such can be suspended, revoked, or discontinued at any time by Uber for any reason. If your Program membership is closed, all Points associated with your Program Membership and any Rewards may be forfeited immediately upon closure, in accordance with the terms of the specific Reward, as detailed below. If your Program membership is closed due to fraudulent activity or non-compliance with these Program Terms, in addition to forfeiting all Points and Rewards associated with your Program Membership immediately, you cannot participate in or rejoin the Program.
PROGRAM CHANGES AND PROGRAM CLOSURE
We reserve the right to change or close the Program, or any part thereof, at any time without notice and without further obligations to you or any other Program Members, including, but not limited to modifications which: a) govern how Points are earned on and after the date of change; b) change the number of Points required to access a Tier; c) the specific Rewards provided in each Tier; or d) any other requirements necessary to obtain Rewards within a Tier. No Points will be earned after the effective date of closure. Any and all changes and/or amendments to these Program Terms will become binding upon all members immediately.
TRANSFER OF RIGHTS
Uber’s rights and obligations under the Program may be assigned or transferred by Uber to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.
INTERPRETATION OF PROGRAM TERMS.
All interpretations of these Program Terms will be at Uber’s sole discretion and Uber’s decisions will be final.
DISCLAIMER
The Program and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons outside of our control. We are not responsible for any unavailability, interruptions or errors of the Program, its features or any Rewards. We may modify, suspend, or discontinue the Program or any feature at any time without notice. The Program and all the information accessible through it are provided for informational purposes only on an “as is” and “as available” basis. We, our affiliated entities and third party Rewards providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
REWARDS DETAILS AND ADDITIONAL TERMS
Rewards are privileges granted to you. Rewards are granted at the discretion of Uber, may change or be canceled at any time, are not redeemable for Points and have no cash value. Reward details, terms and limitations may be found below. Please note that some of the Rewards listed below may not be available in your home city. Accordingly you may not be entitled to claim some of the Rewards. Rewards provided by third parties may require additional action by you, including, without limitation, agreeing to additional terms or creating an account with such third party and sharing of certain data with such third parties providing products or services. Driver Partners are responsible for all taxes that may be owed in the receipt of Rewards. UBER SHALL NOT BE RESPONSIBLE FOR THE PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES.
To ensure the success of the Program, Uber may collect information on such third party Rewards-based transactions for information and reporting purposes, in each case pursuant to the terms agreed to by the third party Reward provider and the Program Member.
THE FOLLOWING LIST INCLUDES DETAILS ON THE CURRENT OFFERS IN THE UBER PLUS PROGRAM, PROVIDED BY PARTICIPATING PARTNERS OR UBER. PLEASE NOTE THAT OFFERS FROM EXTERNAL PARTICIPATING PARTNERS, INCLUDING BUT NOT LIMITED TO THE QUALIFICATIONS FOR ACCESSING THE REWARDS, AS WELL AS THE IDENTITY OF THE PARTNERS THEMSELVES, ARE SUBJECT TO CHANGE AT ANY TIME IN UBER’S DISCRETION.
Micro Credit Access: SuperMoney
Who is Eligible:
Driver Partners cum car owners in the Blue, Gold, Platinum and Diamond tiers who have been on the Uber platform for more than 6 months and have a monthly average returns of more than INR 25,000 (in the three months immediately preceding the date of application) shall be eligible for a loans from SuperMoney, subject to fulfilment of other conditions as may be imposed by Supermoney. Please check your Uber App, from time to time to see whether the said reward is available in your home city.
Note that to avail benefit of this Reward may also require acceptance to additional terms and conditions of the third party supplier.
Uber makes no guarantee as to specific conditions on which the loan may be provided by Supermoney. All the financial transactions in relation to the grant of loan shall be between Supermoney and the relevant Driver Partners. The ultimate decision of granting the loan and decision on eligibility of a Program Member for a loan shall be at the sole discretion of the third party service provider.
This Reward may also require disclosing of certain information of the Program Member by Uber to the third party service provider.
Priority Airport Rematch
Who is Eligible:
Driver Partners in the Diamond tier in select cities. Please check your Uber App, from time to time to see whether the said reward is available in your home city.
This Reward is subject to availability at a given airport, which may change at any time without notice. If available, a qualifying Program Member may get prioritized for a potentially faster pickup at the airport.
Trip Duration
Who is Eligible:
Driver Partners in the Diamond or Platinum tier who maintain a trip acceptance rate or higher as notified by Uber from time to time for each city (calculated on a rolling thirty (30) day basis). Driver Partners in the Blue or Gold Tier are not eligible for this Reward.
To qualify for this Reward, an eligible Driver Partner must maintain an acceptance rate or higher, as notified by Uber from time to time for each city.(calculated on a rolling thirty (30) day basis)
DocsApp: On Call Consultation with Doctor
Who is Eligible:
All Driver Partners on Uber platform who have completed at least 1 trip in last 28 days are eligible for this Reward.
The Program Members will be required to call on an IVR number via their Uber registered mobile number, which will be communicated to the Program Members, from time to time. The Program Member will be required to follow the steps as directed by the IVR. Once this step is completed, within 24 hours of placing the call, the Program Member will receive an SMS confirming the activation of such Program Member’s account with third party service provider and the Program shall be entitled to avail the services offered by the third party service provider.
This Reward may also require acceptance to additional terms and conditions of the third party service provider.
This Reward may be used by the Program Member or a Program Member can choose to pass the Reward onto a family member (defined as spouse or domestic partner, child, sibling, parent, legal guardian or dependent).
The DocsApp platform will enable you to select and book the consultation calls with various doctors registered on the DocsApp platform. Driver Partners can book consultation services via the DocsApp platform.
Note that the Program Member using this Reward are responsible for the cost of medical treatment that they may need. Further, Uber is not providing any recommendations for medical services as part of this Reward, the medical service and consultation is being provided by the third party service provider and Uber has no responsibility whatsoever with respect to any medical advice/treatment provided to the Program Member and/or to a family member of the Program Member.
Discount on Educational modules/Coaching
Who is Eligible:
All Driver Partners are eligible for discounted rates being offered by the third party service provider (“Toppr”) for annual subscriptions of Toppr platform that offers online educational and coaching modules.
This Reward may be used by the Program Member’s children. The Program Members will be communicated a helpline number and the Program members shall be required to call on the helpline number to avail the services.
This Reward enables the Program Members to select and enroll in the online educational or coaching modules for classes from 5th standard to 12th standard for all subjects, available on the Toppr platform at discounted rates. This Reward may also require Uber to share name, phone number, tier of Program Member with the third party service provider.
This Reward may also require acceptance to additional terms and conditions of the third party service provider.
Note that the Program members are responsible for the cost associated with this Reward, and any computers or technology services (e.g. a reliable internet connection and course-related software requirements) they may need. A computer or laptop or a smartphone is essential in order to be successful with online courses. Uber does not take any responsibility for the quality of course material or the teaching methodology available on the Toppr platform.
Life insurance
Who is Eligible:
All Driver Partners are eligible for special premiums offered by the third party service provider (“Ace Insurance Broker”) for purchasing life Insurance for Driver partners. Please check your Uber App, from time to time to see whether the said reward is available in your home city.
This Reward is for Program Members. The Program Members will be communicated a helpline number and the Program members shall be required to call on the helpline number to avail the services.
This Reward may also require acceptance to additional terms and conditions of the third party service provider. Uber makes no guarantee as to specific conditions on which the insurance may be provided by the third party service provider. All the financial transactions in relation to the grant of insurance shall be between the third party service provider and the relevant Driver Partners. The ultimate decision of granting the insurance and decision on eligibility of a Program Member for the insurance shall be at the sole discretion of the third party service provider.
Health Insurance
Who is Eligible:

This Reward may be used by the Program Member’s family members. The Program Members will be communicated a helpline number and the Program members shall be required to call on the number to avail the services.

Uber makes no guarantee as to specific conditions on which the insurance may be provided by the third party service provider. All the financial transactions in relation to the grant of insurance shall be between the third party service provider and the relevant Driver Partners. The ultimate decision of granting the insurance and decision on eligibility of a Program Member for the insurance shall be at the sole discretion of the third party service provider.
Motor Insurance
Who is Eligible:

This Reward is for Program Members. The Program Members will be communicated a number helpline and the Program members shall be required to call on the number to avail the services.
This Reward may also require acceptance to additional terms and conditions of the third party service provider. Uber makes no guarantee as to specific conditions on which the insurance may be provided by the third party service provider. All the financial transactions in relation to the grant of insurance shall be between the third party service provider and the relevant Driver Partners. The ultimate decision of granting the insurance and decision on eligibility of a Program Member for the insurance shall be at the sole discretion of the third party service provider.
