UBER SAFARI: TERMS & CONDITIONS

a. General: (i) Riders requesting a trip must be 18 years and older; (ii) Uber Safari (Consisting of Uber Day Safari and Uber Night Safari) is available to any eligible rider provided that at the point of pick-up, the rider is within Nairobi County; (iii) Each trip will accommodate a maximum of 7 riders for Uber Day Safari and a maximum of 5 riders for Uber Night Safari; (iv) Trips will only be offered from 17 September 2025 to 17th December 2025 during the booking window of Uber Day Safari (6:00am-2:00pm) and Uber Night Safari (4:30pm-6:00pm). Availability is limited, and bookings are processed on a "first come, first served" basis. Uber cannot guarantee a reservation; (v) The fixed fee of KES 25,000 for Uber Day Safari and of KES 40,000 for Uber Night Safari shall not be inclusive of the entry fee to the Nairobi National Park; (vi) If the driver cancels, riders will be refunded; (vii) Itinerary cannot be modified; and (viii) Upon confirmation, any cancellation made within 48 hours, including a failure to show up at the pick-up location, will incur a cancellation fee of KES 20,000 cancellation fee for the Uber Day Safari and KES 30,000 for the Uber Night Safari. Riders consuming alcohol are reminded that alcohol is not for persons under the age of 18 years.

b. Indemnity: You agree to indemnify and hold Uber, its affiliates and its and their officers, directors, employees and agents harmless from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with: (i) your use of Uber Safari; (ii) your breach or violation of any of these Terms; (iii) Uber’s use of your User Content; or (iv) your violation of the rights of any third party, including third party providers.

c. User Content: You hereby grant Uber, its agents and licensees, the irrevocable, sublicensable, royalty-free right and licence to broadcast, display, publish, reproduce, transmit and otherwise use, your photographs, videos and any other material collected, produced or manufactured whilst participating in Uber Safari (“User Content”). Such use by Uber of such User Content will be for any other purpose, in perpetuity, throughout the world, in all media and formats whether now or later known or developed, without further notice or compensation therefore. You also understand that Uber is not obligated to credit your name in such advertising, marketing, public relations or other promotional purposes and furthermore that Uber is not obligated to use any material that may have been collected, produced or manufactured.
