Code of Conduct for Fleet Partners

Uber B.V. and its affiliates (collectively “Uber” or “we”) pledge to do the right thing. And we expect our partners to follow the same principle.

Uber’s partnership with its customers, who are independent business entities engaged in the provision of transportation services (collectively, “Fleet Partners” or “you”), is based on cooperation and trust. You use individuals (whom you may employ) in order to provide transportation services on your behalf (“Drivers”) and we believe it is important that your treatment of those individuals is both lawful and fair.

This code of conduct sets out the minimum standards by which Fleet Partners must adhere to when using the Uber app in the United Kingdoms, in addition to the terms of their Services Agreement with Uber and the Uber Community Guidelines. Your adherence to this Code of Conduct constitutes a contractual obligation under our Services Agreement.

We expect any instance of non-compliance, or suspected non-compliance, to be reported to us in good faith, whether directly by Fleet Partners, by Drivers, or by law enforcement. Whenever law enforcement is involved, we will cooperate with their investigation in accordance with our Law Enforcement Guidelines. Once we are made aware of any kind of non-compliance, or suspected non-compliance, with this Code of Conduct by a Fleet Partner, we will endeavour to contact the relevant Fleet Partner to discuss the issues. If we are not satisfied that the Fleet Partners is acting in accordance with this Code of Conduct, in particular where the Fleet Partner fails to provide documents and information necessary to examine or remedy any alleged non-compliance, we may take action against the relevant Fleet Partner, including, but not limited to, suspending or deactivating the Fleet Partner, or terminating our Services Agreement with the Fleet Partner.

1. Legal compliance

Uber requires all of its Fleet Partners to comply with all applicable laws and regulations. This includes all relevant laws and regulations in relation to the provision of services, anti-corruption, anti-money laundering, data protection and employment or commercial practices (which includes ensuring that your Drivers are legally allowed to perform work in the United Kingdom).

2. Discrimination

Any form of discrimination in hiring, employment or commercial engagement practices is unacceptable. This includes any distinction, exclusion or preference based on characteristics such as a person’s race, color, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other protected characteristic under the laws of the United Kingdom.

3. Drivers’ rights

Uber does not tolerate, or condone in any form, slavery, servitude, forced labour, or human trafficking. All Drivers must be treated with dignity and respect. No Driver must be exposed to any inappropriate or unlawful conduct, including but not limited to verbal, psychological, physical and/or sexual abuse, coercion or harassment. Driver’s rights and obligations in relation to Fleet Partners should be clearly set out in the form of a contract that respects all applicable laws, regulations, and trade agreements, and honoured by both parties.

No limits should be set for any Driver on their freedom of contracting with other Fleet Partners or business entities, other than those recognised by applicable laws and regulations.

Fleet Partners are obliged to share this Code of Conduct with their Drivers.

4. Compensation

Fleet Partners undertake to honour all their obligations concerning timely, transparent and accurate payments to their Drivers, subcontractors or employees. All Fleet Partners warrant that their way of doing business is compliant with applicable social security and tax laws.

5. Health & Safety

Fleet Partners shall provide a safe and healthy working environment. Fleet Partners shall adopt the measures needed to prevent such accidents and health hazards as may arise in connection with work. For this purpose, Fleet Partners must put in place systems capable of detecting, avoiding and responding to potential health and safety hazards, such as fatigue resulting from enforcing excessive working schedules.

6. Procedure for complaints

Complaints or information about violations of this Code of Conduct may be reported by Drivers to Uber through the “Help” section of the Uber app at any time. Individuals filing a complaint are asked only to report such complaints and information they believe in good faith to be true. All Fleet Partners guarantee that individuals filing complaints will not be subject to reprisals or disciplinary action of any kind.
