Uber - Promotion Terms– Australia and New Zealand

These Promotion Terms apply to all promotions (each, an “Offer”) in Australia and New Zealand, unless expressly stated otherwise. Each Offer may have additional terms outlined in accompanying promotional material or in-app descriptions. In the event of a conflict between these Promotion Terms and any additional terms, the additional terms will prevail. These terms do not limit or exclude your consumer rights and guarantees under the Australian Consumer Law or in New Zealand, the Consumer Guarantees Act.

General Offer Terms

UBER EATS GENERAL PROMOTIONAL OFFER TERMS

General Terms

1. Offers are valid only for eligible orders placed via the Uber Eats app and may be limited to: specific locations or geographies, participating merchants, product categories or individual items.
2. Offers are not cumulative and cannot be used in conjunction with other promotions or applied to already discounted items.
3. Offers are subject to stock availability, operating hours and availability of participating merchants in your delivery area.
4. Offers are restricted to a single redemption per user per order.
5. Offers are non-transferable and have no cash value.
6. Fees and taxes may still apply.
7. Offers may be modified or withdrawn at any time, including without notice, where reasonable grounds exist for doing so.
8. Uber may, acting reasonably and in good faith, withhold, refuse, limit, reverse or otherwise decide to cancel a promotional benefit that it determines or believes was obtained fraudulently, illegally, in error, or in violation of these or other terms, unreasonably, unacceptably or through misuse (e.g. multiple accounts, self-referrals, technical manipulation).

Eligibility & Redemption

1. Where an Offer contains a promo code, it may require the application of the promo code to your Uber account prior to placing an order.
2. Offers may be limited to the intended recipients specified in the promotional material or in-app, including: (i) a number of users who first apply the promotion code on the Uber Eats app; (ii) first-time users; (iii) a specific category of users (e.g. Uber One Members); or (iv) recipients of promotional material.
3. Redemption may be limited to once per user, per person or per order, or while promotional tagging is displayed.

Offer Application & Fees

Offer applies to eligible items or order values only. Unless expressly stated otherwise, Offers do not apply to:

• Fees;
• Customisations or item additions;
• Tips or gratuities; and
• Restricted items (e.g. alcohol or pharmaceutical items).
• If available, Uber One credits will be deducted from the order value after the application of any Offer.

Offer conditions

Offers may specify specific additional conditions:

1. Minimum Order Requirement: Where an Offer specifies a minimum order requirement or minimum basket size, the offer is only valid if the order subtotal (excluding fees) meets or exceeds that stated requirement.
2. Maximum Discount Cap: For percentage-based discount offers, the offer is only valid up to a maximum discount as specified in the promotional material or in-app.
3. Offer expiry: Offers may specify an expiry date or number of days until expiry, in which the offer will expire at that point unless it has been withdrawn earlier. For Australian Offers, time zones are AEDT/AEST. For New Zealand Offers, the relevant time zone is NZST. If no expiry time is specified, promotions expire within 30 days.
4. Uber Cash: Where the Offer is an issuance of Uber Cash, it is subject to the Uber Cash Terms and Conditions (https://www.uber.com/legal/en/document/?name=uber-cash-terms-of-use&country=australia&lang=en-au). We may be unable to credit your Uber Cash balance if this would result in your aggregate balance exceeding the balance limit of AU$1,000, for compliance with applicable laws, or where we, acting reasonably, determine or believe that there has been an error, fraud, illegal activity, or violation of any applicable terms. Uber Cash issued to your Uber Cash balance under an Offer is not refundable or redeemable for actual cash, and it is not transferable. Uber Cash issued under an Offer may be applied to orders containing alcohol items for Uber Eats users 18+ in Australia with valid proof of age document only. See stores in app for their liquor licence details. Any Uber Cash issued under an Offer will expire 60 days after the date of issue unless otherwise specified.

UBER RIDES - GENERAL PROMOTIONAL OFFER TERMS

General Terms

1. Offers are valid only for eligible rides requested via the Uber app and may be limited to: specific locations or geographies, ride types, profiles or times.
2. Offers are not cumulative and cannot be used in conjunction with other promotions or applied to already discounted items.
3. Offers are restricted to a single redemption per user unless otherwise specified.
4. Offers are subject to driver and ride type availability in your area.
5. Offers are non-transferable and have no cash value.
6. Offers apply to the value of the trip fare only and do not apply to tolls, surcharges, levies, cancellation fees, wait fees, tips and gratuities or any other fee or charge.
7. If available, Uber One credits will be deducted from the price of the ride before the application of any Offers.
8. Offers may be modified or withdrawn at any time, including without notice, where reasonable grounds exist for doing so.

Eligibility & Redemption

1. Offer applies to the trip fare of an eligible ride only. Unless expressly stated otherwise, Offers do not apply to:

• Fees;
• surcharges , government fees, tolls and taxes;
• any tips or gratuities you choose to make;
• ride requests made on behalf of others; or
• Fare Splits for which the Offer recipient was not the trip requestor.

2. For accounts with multiple valid promotion codes, the eligible promotion with the highest savings will automatically apply to a rider’s next trip.

Offer conditions

Offers may specify specific additional conditions:

1. Maximum Discount Cap: Offers may specify a maximum discount (whether percentage-based or fixed-amount) off fare type. For fixed-amount discounts, any unused portion is forfeited after redemption on an eligible ride.
2. Offer expiry: Offers may specify an expiry date or number of days until expiry, in which the offer will expire at that point unless it has been withdrawn earlier. For Australian Offers, time zones are AEDT/AEST. For New Zealand Offers, the relevant time zone is NZST. If no expiry time is specified, promotions expire within 30 days.
3. First time: Offers may be limited to first-time or new users. These are limited to one per person who creates a valid Uber account for the first time.
4.
