ADDENDUM TO UBER RIDER TERMS & CONDITIONS
Effective Date: 29th July 2025
This Addendum forms part of the Uber Rider Terms & Conditions and applies specifically to Auto software-as-a-service available in Mumbai. In case of any conflict, this Addendum shall prevail over the Uber Rider Terms & Conditions of use that apply to users for other Uber services.
1. NATURE OF SERVICES & ROLE OF UBER
Uber provides a technology platform that enables riders to connect with independent Driver Partners who subscribe to Uber’s Auto software-as-a-service. Uber does not provide transportation services or function as a transportation carrier. The transportation services are provided solely by Driver Partners, who operate independently. Uber has no control over the execution, completion, or quality of the rides. Uber shall not be responsible for any cancellation by the Driver Partner or refusal to provide transportation services by the Driver Partner.
2. FARE ESTIMATION, NEGOTIATION & PAYMENT RESPONSIBILITIES
2.1. The Uber App may display a Suggested Fare, but this amount is not binding on the Driver Partner or You. The Suggested Fare is shown merely for reference. You and the Driver Partner may mutually agree on a different fare before or during the ride.
2.2. Uber does not interfere in the negotiation of final fare between the Rider and the Driver Partner. You must pay the agreed fare directly to the Driver Partner in cash or any other mode agreed upon by both parties. However, on request, Uber may facilitate digital payments for Driver Partners based on suggested fare displayed on the app. Any difference in the suggested fare and mutually agreed fare between the Rider and the Driver Partner shall be settled directly to the Driver Partner in cash or any other mode agreed upon by both the parties. Uber does not assume responsibility for disputes regarding payment. Any disagreements between the Driver Partner and You concerning fares must be resolved directly between them. Uber does not provide transportation services and is not responsible for setting or enforcing fares or resolving disputes, if any.
2.3. You are solely responsible for paying any applicable additional charges:
- Tolls, state taxes, parking fees, or route-specific surcharges as communicated by the Driver Partner.
- Any other costs incurred during the trip.
3. PLATFORM-RELATED CHARGES & OTHER FEES
3.1. Certain charges may apply to You that are unrelated to any specific trip, including, Uber One membership fees (if applicable), insurance fees, outstanding payments from non-auto Uber trips, Airport/ station pickup surcharges or access fees.The collection of such fees is not linked to or dependent on the provision of actual passenger transportation services rendered by the Drivers directly to the riders
3.2. Uber may charge administrative or service fees including applicable GST and other taxes.
4. LIMITATION OF LIABILITY
4.1. Uber only facilitates connections between Riders and Driver Partners and is not responsible for ride completion, fare disputes, delays, or service quality. Any dispute over fare, service refusal, or ride experience must be resolved directly between the Rider and the Driver Partner. Any charges paid by the user to the Driver Partner is non-refundable, even in cases where a ride is not completed.
5. DISPUTE RESOLUTION & GOVERNING LAW
5.1. Any disputes relating to this Auto software-as-a-service service shall be governed by the laws of India and resolved in manner outlined in the main Rider Terms.
6. GENERAL TERMS
6.1. This Addendum applies exclusively to autorickshaw rides booked under the Auto software-as-a-service service and does not impact any other Uber services.
6.2. Uber reserves the right to update this Addendum at its sole discretion, and continued use of the Uber App constitutes acceptance of the updated terms.
