UBER PRO TERMS AND CONDITIONS
Uber Pro (the “Program”) is brought to you by Uber India Systems Private Limited, or its respective subsidiaries, licensees and affiliated companies (collectively “Uber” or “we”). These Program Terms (defined below) constitute a legal agreement between you and Uber.
Participation in the Program is subject to these terms and conditions, and also to our Privacy Notice and your Services Agreement, which are incorporated herein (collectively, the “Program Terms”). By participating in this Program you are agreeing to these Program Terms.
Uber is a technology service provider, not a provider of transportation services, as such all Rewards (defined below) offered under the Program are offered on an “as available” basis, contingent upon requests from riders for the transportation services and other contingencies which may impact availability of some Rewards at certain times and places.
THE PROGRAM IS CURRENTLY BEING OFFERED IN SELECT CITIES, WITH CERTAIN REWARDS AVAILABLE IN CERTAIN CITIES. YOU UNDERSTAND THAT UBER MAY TERMINATE OR MODIFY THE TERMS OF THE PROGRAM (INCLUDING, WITHOUT LIMITATION, WHAT THE REWARDS ARE, HOW YOU QUALIFY FOR THEM, THE DURATION OF THE PROGRAM) AT ANY TIME AT UBER’S SOLE DISCRETION. ALL AND ANY REWARDS ON OFFER BY UBER ARE AT THE COMPLETE DISCRETION OF UBER AND UBER MAY CHOOSE TO PROVIDE ALL OR ANY REWARDS IN ALL OR ANY CITIES IN INDIA AS DETERMINED BY UBER AT ITS SOLE DISCRETION. THE REWARDS OFFERED UNDER THE PROGRAM ARE NOT IN THE NATURE OF EMOLUMENTS AND DO NOT CREATE ANY EMPLOYER-EMPLOYEE OR AGENCY RELATIONSHIP BETWEEN UBER AND THE DRIVER PARTNERS. THE PROGRAM IS A LOYALTY PROGRAM BEING INTRODUCED BY UBER TO INCREASE LOYALTY AND ADAPTATION OF UBER PLATFORM BY DRIVER PARTNERS.
You understand that all central, state and local taxes on the Rewards that you accept are your sole responsibility as the Reward recipient.
ELIGIBILITY
All participants in the Program are “Program Members.” In order to participate in the Program, you must (1) reside in India, (2) meet all eligibility requirements to be a driver on the Uber Driver App (a “Driver Partner”) as set by applicable law and Uber; (3) have an active account on the Uber Driver App; and (4) have set your home city within Uber Driver App as one of the participating cities under the Program as may be notified by Uber from time to time (each, a “Participating City”). All active Driver Partners meeting this criteria will be automatically enrolled in the Program. Once you are enrolled, there is no additional action required to participate in the Program.
Your rewards program account (“Program Account”) will automatically be linked to your account on the Uber Driver App. You may not share your Program Account or have multiple membership accounts.
PROGRAM POINTS & PROGRAM PERIODS
You can earn points (“Points”) to access the different Tiers (defined below) and the rewards offered in each Tier. You will earn 1 Point for every Uber Trip you complete, including in case of the following trip types: UberGo, UberXL, UberPremier, UberHire and UberIntercity, UberAuto, UberHire, UberMoto, Package in India. Each such trip shall count as an “Uber Trip” for the purposes of this Program.
You may earn additional Point(s) when you complete an Uber Trip that either begins or ends:
- during the times (displayed in the local time zone) listed in the Uber Pro section of the Uber App under “How to Earn Points”; or
- in certain areas as displayed in the Uber Pro section of the Uber Driver App under “How to Earn Points”.
Uber reserves the right to offer additional Points or additional Point multipliers in certain Participating Cities for certain periods of time, in its sole discretion. Any such additional Point offerings made available in a Participating City will either (i) be made available to all eligible Program Members in that Participating City or (ii) be made available to a randomized cohort of all eligible Program Members in that Participating City. Uber, in its sole discretion, may modify, cease, increase, or expand upon any additional Point multiplier offerings in its sole discretion and at any time.
You earn Points in fixed three month periods. The fixed three month periods (each a “Program Period”) are currently set as follows:
Program Period 1: April 1 - June 30
Program Period 2: July 1 - September 30
Program Period 3: October 1 - December 31
Program Period 4: January 1 - March 31
Points expire and reset to zero at the end of every Program Period. Points do not accumulate across or carry over to the next Program Period. Points will accumulate in the Program Period in which Uber processes the point (which may be the next Program Period). You do not earn any Points for taking rides as a rider on the Uber App. Points have no cash value and are used solely to determine your Program Tier. Points may be revoked if an Uber Trip, for which Points were earned, is refunded or if Uber believes, in its sole discretion, that Points were earned through or in connection with any fraud, abuse of the platform, or in violation of your Services Agreement and/or Uber’s Community Guidelines.
PROGRAM TIERS AND PROGRAM STANDARDS
The Program offers four membership Tiers: Blue, Gold, Platinum and Diamond (each a “Tier”). Tiers unlock access to certain rewards (“Rewards”) offered by Uber and/or third parties. Each successive Tier includes its own Rewards as well as the Rewards of the preceding Tiers.
The Points you earn in one Program Period will determine your Tier in the next Program Period. Tiers are not permanent and must be earned for every Program Period. The number of Points necessary to reach each Tier may vary by Participating City. See the “Your Rewards” section in the “How Uber Pro Works” section under “Uber Pro” in your Uber Driver App for the applicable Points thresholds for the Gold, Platinum and Diamond Tiers for your Participating City. For each Participating City, Drivers Partners who do not meet the requirements for Gold, Platinum, or Diamond Tiers are placed into the Blue Tier.
There are no additional requirements for the Blue Tier other than as set forth in the “Eligibility” section above. To obtain Gold, Platinum, and Diamond Tiers, in addition to the required number of Points for your Participating City, you must also have, at the beginning of or during the Program Period: (1) a minimum of driver star rating average over the past 500 trips as applicable to the Program (or all lifetime trips if you have completed less than 500 trips); (2) no greater than a cancellation rate as applicable to the different Participating Cities and Tiers ; and (3) no less than an acceptance rate as applicable to the different Participating Cities and Tiers, as may be determined and notified by Uber from time to time on the Uber Driver App (collectively, "Program Standards").
See the “How Uber Pro Works” section under "Uber Pro" in your Uber Driver App for the applicable Program Standards for the Gold, Platinum and Diamond Tiers for your Participating City and the method of calculation of cancellation rate and acceptance rate for purposes of this Program.
You can move to a higher Tier during the current Program Period if you meet the Points and other requirements described above. In that case, you will automatically be moved to such a higher Tier and you will stay in that Tier for the current Program Period and the next Program Period, provided you continue to meet the requirements of applicable Points and Program Standards.
Once you obtain a higher Tier, you may be able to immediately access some Rewards for the higher Tier, but not all Rewards may be available immediately.
MAINTAINING YOUR TIER & PROGRAM STANDARDS
In order to maintain your Gold, Platinum or Diamond Tier status during the entire applicable Program Period, you must maintain, at all times, the Program Standards applicable to your Tier.
If you fail to meet any of the Program Standards applicable to your Tier, you will be moved to the Blue Tier. You will lose your access to the Rewards available to higher Tiers, but will maintain access to the Blue Tier and the corresponding Rewards as long as you remain in the Uber Pro Program. Your former Tier can be reinstated if all Program Standards are met during the current Program Period.
HOW TO VIEW POINTS BALANCES
You can view your current Points balances within the settings of your Uber Driver App. Any errors or omissions on transactions posted to your Program Account must be reported within one month by contacting Uber as noted in the 'Contact Us' section below. Failure to supply necessary documentation may result in an inability to award Points or adjust Tier status. For verification, you should retain all receipts and documentation until your Points are credited to your Program Account.
It may take approximately 72 hours for your cancellation and acceptance rates to refresh. In the event of an outage of the Uber systems, your Points may be delayed in displaying in your Program Account. Additionally, if the outage occurs near the end of a Program Period, it is possible the Points will not be applied until the next Program Period.
ACCOUNT TERMINATION
Uber may suspend, revoke, terminate or discontinue your Program Account at any time for any reason. If your Program membership is terminated, all Points associated with your Program membership and any Rewards may be forfeited immediately upon termination, in accordance with the terms of the specific Reward, as detailed below. If your Program membership is terminated due to fraudulent activity or non-compliance with these Program Terms, in addition to forfeiting all Points and Rewards associated with your Program membership immediately, you cannot participate in or rejoin the Program.
PROGRAM CHANGES AND PROGRAM TERMINATION
We reserve the right to modify, suspend or discontinue the Program, or any part thereof, at any time without notice and without further obligations to you or any other Program Members, including, but not limited to modifications that: a) govern how Points are earned on and after the date of change; b) change the number of Points required to access a Tier; c) change the specific Rewards provided in each Tier; d) change any other requirements necessary to obtain Rewards within a Tier; or e) change the Rewards available. No Points will be earned after the effective date of termination. Any and all changes and/or amendments to these Program Terms will become binding upon all Program Members immediately upon being updated.
TRANSFER OF RIGHTS
Uber’s rights and obligations under the Program may be assigned or transferred by Uber to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.
INTERPRETATION OF PROGRAM TERMS.
All interpretations of these Program Terms will be at Uber’s sole discretion and Uber’s decisions will be final.
DISCLAIMER
The Program and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons outside of our control. We are not responsible for any unavailability, interruptions or errors of the Program, its features or any Rewards. The Program and all the information accessible through it are provided for informational purposes only on an “as is” and “as available” basis. We, our affiliated entities and third party Rewards providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of the Program, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
REWARDS DETAILS AND ADDITIONAL TERMS
Rewards are privileges granted to you. Unless otherwise expressly provided, Rewards are not redeemable for Points or cash and have no cash value. Rewards may also only be available in certain Participating Cities and to some Program Members. Certain Reward details, terms and limitations are described below and are hereby incorporated into these Program Terms. Additional Rewards may be offered. Additional Rewards may be communicated to Program Members via email or other forms of communication from time to time without being added to the Program Terms. All Rewards may be modified or discontinued at any time in Uber’s sole discretion.
Rewards provided by third parties may require additional action by you, including, without limitation, agreeing to additional terms or creating an account with such a third party and sharing of certain data with such third parties providing products or services. Driver Partners are responsible for all taxes that may be owed as a result of receiving the Rewards. UBER SHALL NOT IN ANY EVENT BE LIABLE OR RESPONSIBLE FOR THE PRODUCTS OR SERVICES OFFERED BY THIRD PARTIES.
To ensure the success of the Program, Uber may collect information on such third party Rewards-based transactions for information and reporting purposes, in each case, subject to the terms to which you and such third party have agreed.
THE FOLLOWING LIST INCLUDES DETAILS ON THE CURRENT REWARDS. CERTAIN REWARDS ARE PROVIDED BY PARTICIPATING THIRD PARTIES. PLEASE NOTE THAT OFFERS FROM THIRD PARTIES, INCLUDING BUT NOT LIMITED TO THE QUALIFICATIONS FOR ACCESSING THE REWARDS, AS WELL AS THE IDENTITY OF THE THIRD PARTIES THEMSELVES, ARE SUBJECT TO CHANGE AT ANY TIME IN UBER’S DISCRETION. THE FOLLOWING LIST MAY NOT BE INCLUSIVE OF ALL REWARDS AVAILABLE TO PROGRAM MEMBERS.
Micro Credit Access
Who is Eligible:
Driver Partners-cum-car owners in the Blue, Gold, Platinum and Diamond tiers who meet the eligibility criteria at the relevant time shall be eligible for loans from third parties in their Participating City, subject to fulfillment of other conditions as may be imposed by such third parties. Please check your Uber App from time to time to see whether the said Reward is available in your Participating City.
Details: Availing benefit of this Reward may also require acceptance to additional terms and conditions of the third party.
Uber neither specifies nor has any control over the specific conditions on which the loan may be provided by the third party. All the financial transactions in relation to the grant of loan shall be between the third party and the relevant Driver Partners. The ultimate decision of granting the loan and decision on eligibility of a Program Member for a loan shall be at the sole discretion of the third party.
This Reward may also require disclosing certain information of the Program Member by us to the concerned third party, which shall be subject to our Privacy Notice.
Insurance & Wellness
Who is Eligible:
All Program Members are eligible for special insurance and wellness offers offered by the third party service providers including but not limited to insurers, insurance brokers, Master Policyholders and wellness service providers offering these services. Please check your Uber Driver App from time to time to see whether this Reward is available in your Participating City.
Details: This Reward is for Program Members across all Tiers. The Program Members will be communicated a helpline number and the Program Members shall be required to call on this number to avail this Reward.
This Reward may also require acceptance to additional terms and conditions of the relevant insurers, Brokers, Master Policyholders and the wellness service providers. Uber makes no guarantee as to specific conditions on which the insurance or wellness offers may be provided by the respective service providers. All the financial transactions in relation to the grant of insurance shall be between these service providers and the concerned Driver Partners. The ultimate decision of granting the insurance and decision on eligibility of a Program Member for the insurance and wellness benefits shall be at the sole discretion of these service providers.
By participating in Uber Pro, the Driver Partners hereby consent to becoming a member of the Master Policyholder’s relevant group for availing relevant offers including but not limited to insurance. Membership of the group of the Master Policyholder is subject to the terms and conditions governing such membership and Uber does not bear any responsibility towards the same.
The Driver Partners hereby acknowledge that Uber, its subsidiaries, associates, directors or its employees are not engaged in the business of solicitation for insurance. Uber is neither an insurer nor an intermediary and does not earn any premium, commission, brokerage or any other benefit from the subscription of these insurance products by the Driver Partners. All insurance products are underwritten directly by the relevant insurers subject to such terms that govern the issuance of such products.
Area Preferences
Who is Eligible: Driver Partners who achieve either Platinum or Diamond Tier. Area Preferences are only available in certain Participating Cities, which are subject to change at Uber’s sole discretion without notice.* This Reward is only applicable for Driver Partners who complete the trips using four-wheelers.
Details: Area Preferences allows Driver Partners to select areas in their city that they would like to drive in. Driver Partners will only receive trips where the pick-up and drop-off destinations are within the boundaries of the areas they have selected within the Uber Driver App. This feature is redeemable for up to 2 hours per day. While using Area Preferences, Driver Partners will not receive Airport pick-up requests. In order to be added to Airport queues, Drivers must first have Area Preferences turned off and be located at a Staging lot.
*Area Preferences currently is only available in the following markets: Delhi NCR, Kolkata, Bangalore, Chennai, Hyderabad, Guwahati, Jaipur, Ahmedabad, Mumbai, Pune, Chandigarh, Lucknow
Diamond Cash Reward
Who is Eligible: Driver Partners who achieve or re-qualify for the Diamond Tier in a Uber Pro Program Period and maintain such status until the end of the Program Period. Diamond cash reward offer is currently valid only for the Program Period April to June, 2024. This Reward is only applicable for Driver Partners who complete the trips using four-wheelers. Driver Partners who are not 'Active' on the Uber Driver App are not eligible for this Reward irrespective of their Uber Pro tier as at the end of the Program Period April to June 2024. Driver Partners engaged by fleet partners will not be eligible for this Reward unless otherwise communicated separately by Uber to such Driver Partners and/or fleet partners in writing.
Details: Driver Partners must achieve or re-qualify for the Diamond Tier in the Uber Pro Program Period April to June 2024 and maintain such status until the end of the Program Period to be eligible for the cash reward. The cash reward amount may vary. Drivers can access the cash reward amount that they are eligible for in the Uber Pro Hub. The cash reward will be paid to an eligible Driver Partner’s account at the start of the next Program Period (generally within one week of the Program Period start date). Driver Partners are eligible for only one cash reward for the aforesaid Program Period.
Diamond cash reward is currently only available in the following markets: Kolkata, Chennai, Hyderabad and Jaipur to a set of Driver Partners as Uber tests this new Reward.
Priority Support (Phone Support)
Who is Eligible: Driver Partners who achieve the Diamond Tier.
Details: Eligible Driver Partners will not be connected with Interactive Voice Response when they reach out for phone support, instead they will be directly routed to a support agent, thus providing a direct and faster connection. This Reward is not available for following trip types: UberMoto, UberAuto, Connect.
Please note that this benefit is only available if the eligible Driver Partners reach out for phone support from their phone number registered on the Uber Driver App.
Priority Support (GL Support)
Who is Eligible: Driver Partners who achieve the Platinum or Diamond Tier.
Details: No need to book appointments for eligible Driver Partners. They may directly visit GL to take support where instant appointments will be booked for them.
Priority Queue Access
Who is Eligible: Driver Partners in the Diamond Tier.
Details: Driver Partners in the Diamond Tier who are not rematched when dropping off a passenger at a participating airport (see list below) will be given Priority Queue Access, which will be automatically redeemed upon entering the FIFO queue. Such Driver Partners must enter the FIFO queue before the time specified on the in-app pop-up notification. The Driver Partners in the Diamond Tier who enter the FIFO queue will be moved to the front of the line and should expect shorter waiting times for trips. Priority Queue Access is only available at the following airport locations: Indira Gandhi International Airport (DEL), Mumbai Airport (BOM), Chennai International Airport (MAA).
Eligibility requirements vary by airport and may require Driver Partners to have a special permit or placard. The availability of this Reward at a given airport may change at any time without notice.
