Uber B.V., Uber Portier B.V., and their affiliates (collectively “Uber” or “we”) pledge to do the right thing. And we expect our partners to follow the same principle.
Uber’s partnership with its customers, who are independent business entities engaged in the provision of transportation and/or delivery services (collectively, “Partners” or “you”), is based on cooperation and trust. You use individuals (who you may employ) in order to provide transportation and/or delivery services for you (“drivers and/or couriers") and we believe it is important that your treatment of those individuals is both lawful and fair.
This Code of Conduct sets forth the minimum standards by which Uber’s Partners must adhere when using the Uber or Uber Eats app in Poland, in addition to the terms of their services agreement with Uber and the Uber Community Guidelines. Your adherence to this Code of Conduct constitutes a contractual obligation under our service agreement.
We expect any instance of non-compliance, or suspected non-compliance, to be reported to us in good faith, whether directly by Partners, by drivers or couriers, or by law enforcement. Whenever law enforcement is involved, we will cooperate with their investigation in accordance with our Law Enforcement Guidelines. Once we are made aware of any kind of non-compliance, or suspected non-compliance, with this Code of Conduct by a Partner, we will contact the relevant Partner to discuss the issues. If we are not satisfied that the Partner is acting in accordance with this Code of Conduct, in particular where the Partner fails to provide documents and information necessary to examine or remedy any alleged non-compliance, we will take action against the relevant Partner, including, but not limited to, suspending or deactivating the Partner, or terminating our agreement with Partner.
Uber requires all of its Partners to comply with all applicable laws and regulations. This includes all relevant laws and regulations in relation to the provision of services, anti-corruption, anti-money laundering, data protection and employment practices (which includes ensuring that your drivers or couriers are legally allowed to perform work in Poland).
Any form of discrimination in hiring and employment practices is unacceptable. This includes any distinction, exclusion or preference based on characteristics such as a person’s race, color, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic protected under the laws of Poland.
Uber does not tolerate any form of forced or compulsory labour. All drivers and couriers must be treated with dignity and respect. No driver or courier must be exposed to any inappropriate or unlawful conduct, including but not limited to verbal, psychological, physical and/or sexual abuse, coercion or harassment. Their rights and obligations in relation to Partners should be clearly set out in the form of a contract that respects all applicable laws, regulations, and trade agreements, and honoured by both parties.
No limits should be set for any driver or courier on their freedom of contracting with other Partners or business entities, other than those recognised by the applicable employment laws and regulations.
Drivers and couriers have the right to have access to this code of conduct. Partners are obliged to share this code of conduct with their drivers or couriers.
Partners undertake to honour all their obligations concerning timely, transparent and accurate payments to drivers, couriers, subcontractors or employees. All Partners warrant that their way of doing business is compliant with applicable social security and tax laws.
Partners shall provide a safe and healthy working environment. Partners shall adopt the measures needed to prevent such accidents and health hazards as may arise in connection with work. For this purpose, Partners must put in place systems capable of detecting, avoiding and responding to potential health and safety hazards, such as fatigue resulting from enforcing excessive working schedules.
Complaints or information about violations of this Code of Conduct may be reported by drivers and couriers to Uber through the “Help” section of the Uber app at any time.
Individuals filing a complaint are asked only to report such complaints and information they believe in good faith to be true.
All Partners guarantee that individuals filing complaints will not be subject to reprisals or disciplinary action of any kind
