After a thorough review of our existing products, we have decided to discontinue Uber Eats Stories function. From 2022/9/23, you will no longer be able to use the Uber Eats Stories function to create, edit or view any Content. This Stories Terms and conditions (Users) will also be terminated on 2022/9/23.

The following terms have the respective meanings given to them below:

以下術語具有以下各自的含意:

“Affiliates” means an entity that owns or controls, is owned or controlled by or is or under common control or ownership of a party, where control is defined as the possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of an entity, whether through ownership of voting securities, by contract or otherwise.

「關聯公司」指企業所擁有或控制，由一方擁有或控制之實體，或受一方共同控制或擁有之實體。此處控制之定義係指，直接或間接擁有指導或決定實體管理、政策方向的權力，無論是透過有表決權股份、契約或其他方式。

“Content” means customized data, images, text, and information that You create and submit for approval to be displayed in the Uber Eats App.

「內容」指您所創作、提交供審核並於Uber Eats App上展示之客製化數據、文字和資訊。

“Content Creation Tool” means a website, application and/or other technology interface, made available by Uber Portier to You, for no charge, that allows You to create Content.

「內容創作工具」指由Uber Portier免費提供您，供您創造內容之網站、應用程式和/或其他技術界面。

“Uber” means Uber Portier B.V., Portier Taiwan and/or their Affiliates.

「Uber」指Uber Portier B.V.、優食台灣及/或其關聯公司。

“Community Guidelines” means the applicable Community Guidelines, currently available at https://www.uber.com/legal.

「社群指引」指適用的社群指引，目前提供於https://www.uber.com/legal。

“Items” means food, beverages, or other items.

「商品」指食物、飲料或其他商品。

"Merchant" means any party who makes Items available for sale via the Uber Eats App.

「商家合作夥伴」指任何透過Uber Eats應用程式銷售商品之一方。

“Portier Taiwan” means Uber Portier Taiwan Co Ltd.

「優食台灣」指優食台灣股份有限公司。

“Uber Eats App” means a website, application or other technology interface made available by Uber to its users, that allows them to buy Items from Merchants and/or request the provision of delivery services.

「Uber Eats App」指Uber Portier和/或其關聯公司向使用者提供的網站、應用程式或其他技術界面，允許他們自商家合作夥伴購買產品和/或請求提供外送服務。

“Uber Portier” means Uber Portier B.V..

「Uber Portier」指Uber Portier B.V.。

TERMS

a. General. You are the owner of the Content. Uber takes no ownership, endorsement or responsibility over the Content. You represent that (i) you own or have obtained any rights necessary to the Content, (ii) the Content is true and accurate and reflects Your experience with a particular Merchant, and (iii) the Content complies with applicable laws and regulations, these Users Stories Terms, the Community Guidelines, and any Content creation guidelines and/or policies that may be provided to You by Uber from time to time. By submitting Content, You agree that Uber may publicly share such Content along with Your name and order history for promotional purposes.

一般事項。您是內容的所有者。Uber不對內容承擔所有權、不為內容背書，或為內容承擔責任。您承認並同意，(i) 您擁有或已獲得任何對於內容之必要權利、(ii)內容為真實、正確且反映您對於特定商家合作夥伴之經驗，且(iii)內容符合適用法律與法規、本使用者限時動態條款、社群指引以及由Uber不時提供給您的任何內容創作準則及/或政策。提交內容即表示您同意 Uber 可以出於行銷目的公開分享此類內容以及您的姓名和訂單歷史記錄。

b. Creation request. Portier Taiwan reserves the right to review, approve and/or reject Content before it is displayed in the Uber Eats App. You can submit Content for Portier Taiwan’s review through the Content Creation Tool. Where applicable, Portier Taiwan will use best efforts to provide You with information about the reasons that led to the rejection of your Content creation request. If the Content creation request is approved, Content will be displayed in the Uber Eats App in accordance with these Users Stories Terms. Uber has the right to combine your Content with Content created by either Merchants or other users.

創作請求。優食台灣於Uber Eats App展示內容前，保留對內容進行審查、核准及/或拒絕的權利。您得透過內容創作工具將內容提交給優食台灣審核。優食台灣將盡最大努力提供您有關導致拒絕您內容創作請求原因的資訊(視情況而定)。若內容創作請求獲得核准，內容將依據本使用者限時動態條款展示在Uber Eats App。Uber有權將您的內容與其他使用者或商家合作夥伴所創作的內容結合。

c. Moderation and restrictions. Portier Taiwan reserves the right to reject, and will not display, Content that may negatively affect the Uber or Uber Eats brand, promotes competitors of Uber, is derogatory, illegal, inflammatory, false, inaccurate, misleading, or that in Portier Taiwan’s sole discretion may violate applicable laws or regulations. Portier Taiwan reserves the right to take down the Content at any time and for any reason at its sole discretion. You acknowledge and agree that Portier Taiwan may impose restrictions on the frequency and quantity of Content that You can submit through the Content Creation Tool.

審核與限制。優食台灣保有拒絕的權利且不會展示負面影響Uber及Uber Eats品牌、助長Ube的競爭對手、或具有貶義、非法的、煽動性的、虛假的、不准確的、誤導的、或優食台灣自行認為違反適用法律之內容。優食台灣保留隨時因任何理由自行決定移除內容之權利。您瞭解並同意，優食台灣可能會限制您透過內容創作工具提交內容之頻率與數量。

d. Term, audience, and location. If approved by Portier Taiwan, Content will be displayed in dynamic in-app cards located in the in-app home feed and/or in any other surface or location of the Uber Eats App as decided by Portier Taiwan in its sole discretion. Portier Taiwan reserves the right to choose the size, design, format, and general visual and functional requirements of the surfaces, and/or the locations in which the Content will be displayed.

期限、觀眾及地點。若獲得優食台灣核准，內容將依優食台灣自行決定被展示在動態應用程式內位於首頁來源及/或任何其他Uber Eats App介面或地點之卡片上。優食台灣保留選擇內容將被展示的介面及/或地點之大小、設計、形式及一般視覺及功能要求之權利。

e. License. By creating and submitting Content, You grant Uber an unlimited, non-exclusive, non-transferable, royalty-free, worldwide license to use, adapt, modify, delete from, add to, publicly perform, display, reproduce and translate such Content, in the Uber Eats App.

許可。透過創建及提交內容，您授予Uber 有限的、非排他性的、不可轉讓的、全球範圍內有限且無需報酬的許可，以在Uber Eats App內使用、改編、修改、刪除、添加、公開表演、展示、重製及翻譯該內容。

f. Support. In case You face issues using the Content Creation Tool and/or have questions about these Users Stories Terms, You can contact us free of charge via the ‘Help’ section in the Uber Eats App or by visiting https://help.uber.com/ubereats so our support team can follow up. We will inform you of the outcome within a reasonable period of time.

支援。如果您在使用內容創作工具時遇到問題和/或對本使用者限時動態條款有疑問，您可以透過Uber Eats App的「幫助」選項免費與我們聯繫或透過訪問https://help.uber.com/ubereats 以令我們的支援團隊能跟進。我們將在合理的時間內通知您結果。

g. Language. In the event of any conflict between the English version and the Chinese version of these Users Stories Terms, the English version shall prevail.

語言。本使用者限時動態條款之英文版本與中文版本如有任何歧義，概以英文版本為準。
