These terms apply to the use of the Services by your teenager, or by you in connection with your teenager. Terminology in these Teen Account Terms of Use that is not otherwise defined has the meanings in the General Terms of Use.
Teen Account Terms of Use (Parent or Guardian)
By inviting, enabling, setting up or allowing your child(referred to below as your “Teen”) to create an Uber account on your Uber Family Profile (“Teen Account”), you attest that you have legal authority to act on your Teen’s behalf, and have conferred with any other parent or legal guardian of the Teen, if and where required. You attest that the Teen is between the ages of 14 and 18. You acknowledge and understand UT LLC(“the Company”) has no duty or obligation to confer with, or seek consent from, any other parent/guardian. You represent you have obtained the consent of your Teen to share their personal information with the Company , if and where required. You have or will review the Teen Account Terms of Use(Teen) with your Teen, and on behalf of your Teen, you agree to those Terms. You agree that the Company may contact your Teen regarding issues and incidents reported by you or others.
You also understand that removing your Teen from your Uber Family Profile will prevent them from requesting rides using their Teen Account. However, their Teen Account will remain intact unless either you or the Teen take additional steps to fully revoke their access.
IMPORTANT: PLEASE BE ADVISED THAT THE GENERAL TERMS OF USE APPLIES TO THIS AGREEMENT AND CONTAINS PROVISIONS THAT GOVERN HOW CLAIMS BETWEEN YOU AND YOUR TEEN, AND THE COMPANY, CAN BE BROUGHT. PLEASE REVIEW THE GENERAL TERMS OF USE CAREFULLY, AS IT STATES THAT, EVEN IF THE COMPANY IS LIABLE TO USERS IN CONNECTION WITH THE WEBSITE OR THE APPLICATIONS REGARDING UBER FOR TEEN, THE COMPANY SHALL BE LIABLE ONLY FOR ORDINARY AND DIRECT DAMAGES ACTUALLY INCURRED BY USERS EXCEPT FOR CASES WHERE SUCH LIABILITY IS INCURRED BY THE COMPANY ’S INTERNATIONAL WRONGDOING OR NEGLIGENCE. BY ENTERING INTO THIS AGREEMENT, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THE GENERAL TERMS OF USE AND HAVE TAKEN TIME TO CONSIDER THE CONSEQUENCES OF THIS IMPORTANT DECISION FOR YOU AND YOUR TEEN.
If and where required, you consent to the Company communicating directly with your Teen, including in situations where they or others (e.g., a driver) may report an issue or incident. This communication may occur through the Uber App, over the phone, by email, or otherwise. If and where required, the Company may, at its discretion, make a good faith effort to notify you and secure your presence before speaking with your Teen. However, your involvement is not a prerequisite to any communication with your Teen.
You agree that only you, your Teen, and adult and minor guests on trips (14-18 years old with parental consent) may access the Services using the Teen Account. Minor guests may not ride using the Teen Account without parental consent and without your Teen also on the trip, and may not otherwise use the Teen Account to access Services. You and your Teen are fully responsible for ensuring that the Teen Account is only used for authorized purposes.
Your local jurisdiction may have laws and regulations governing when, where, or how your Teen may use the Uber App and Services. You understand you and your Teen are responsible for knowing and obeying all laws or regulations that could impact your Teen’s use of their account and the Uber App. Your local jurisdiction may also have laws and regulations governing how the Company must respond in the event of an incident involving your Teen or their authorized guests, and you understand that the Company may be required to take certain actions, including mandatory reporting to designated authorities.
You agree that you are financially responsible for your Teen’s use of their Teen Account as well as use of the Teen Account by any other person. You also agree to indemnify and hold harmless the Company for any and all conduct by your Teen and those taking trips using the Teen Account. However, the Company shall be liable for any damages resulting from its willful misconduct or gross negligence, or arising from special circumstances, as determined by the relevant laws and regulations, including the Korean Civil Code.
Payment of Charges for the use of Services via the Teen Account may be made using any payment method in your Uber Family Profile, in which case you hereby agree to make payment of such Charges, subject to any spending limit indicated in your Uber Family Profile.
Alternatively, payment may also be made via any payment method saved to the Teen Account, or in person directly to the Third Party Provider by cash or card. In the case of any non-cash payment methods, the Charges will be debited directly from the payment method used. You represent and warrant that you have taken all necessary measures to ensure that any payment method saved to the Teen Account is owned by and registered in the name of your Teen; and any non-cash payment method used for payment in person is owned by and registered in the name of its user. You further acknowledge and agree that payment transactions made via any payment method saved to the Teen Account will not be calculated toward any spending limit in your Uber Family Profile.
You further agree that, in the event that payment for the Services received via the Teen Account is not received in full, the Company reserves the right to charge the payment method saved in your Account.
You acknowledge the Privacy Notice and understand it governs our use of your personal data, and acknowledge the Uber Teens Privacy Notice and understand that it governs our use of your Teen’s personal data. You also acknowledge the Community Guidelines, and understand that both your account and the Teen Account may be impacted if you or your Teen fails to adhere to those Guidelines or these Teen Account Terms of Use. You further understand that the General Terms of Use apply to your Teen’s use of the Uber Services and their Teen Account, including but not limited to the liability provisions therein.
