Uber or its affiliate is the issuer of Uber Cash to users on the Uber platforms in Taiwan. These Uber Cash terms of use (“Uber Cash Terms”) constitute a legally binding agreement between you as a User (as defined below) and Uber.
Uber或其關聯企業是在台灣的Uber平台上向使用者發放Uber Cash點數的發放者。本Uber Cash點數使用條款(下稱「Uber Cash點數條款」)將構成您作為使用者(定義如下)和Uber之間具法律拘束性的協議。
1. Uber Cash Terms & General Terms
Uber Cash點數條款及一般條款
1.1 By having an Account, you agree that you have understood and agreed to these Uber Cash Terms.
一旦您擁有帳戶,您即同意您已瞭解並同意本Uber Cash點數條款內容。
1.2 These Uber Cash Terms:
a. supersede any prior terms or agreements with you in respect of Uber Cash (if any); and
b. only relate to the use, loading and redemption of Uber Cash as a Payment Method and do not apply to alternative Payment Methods or to the services obtained with Uber Cash.
本Uber Cash點數條款:
a. 取代先前與您訂立之Uber Cash點數相關條款或協議(如有);及
b. 僅涉及Uber Cash點數作為付款方式上的使用、增添和兌換,並不適用於其他付款方式或使用Uber Cash點數所取得的服務。
The provisions of the General Terms also apply to your use of the Wallet and Uber Cash. In the event of a conflict between the Uber Cash Terms and the General Terms regarding Uber Cash, these Uber Cash Terms prevail.
《一般條款》的規定亦同時適用於您的錢包及Uber Cash點數之使用。如本Uber Cash點數條款與《一般條款》有與Uber Cash點數相關之歧異,應以本Uber Cash點數條款為準。
2. Definitions
定義
2.1 All capitalized terms in these Uber Cash Terms have the meaning set forth in the General Terms, unless otherwise defined in these Uber Cash Terms.
除非在本Uber Cash點數條款中另有定義,否則本Uber Cash點數條款中的所有名詞定義均如《一般條款》中的定義。
2.2 “Appeasements” means non-refundable and non-transferable credits issued to you by Uber or its affiliate as Uber Cash, as a gesture of goodwill, for example where you have had an unpleasant experience or service in respect of a Transaction. Appeasements are issued subject to these Uber Cash Terms, the General Terms and any additional or specific terms established by Uber (including with respect to expiration) as communicated to you by Uber, including but not limited to via its mobile applications or websites.
「補償禮遇金」是指由Uber或其關聯企業基於善意以Uber Cash點數的形式發放給您的不可退款、不可轉讓的點數,例如在您進行交易時遇到不愉快的經歷或服務。補償禮遇金的發放受到本Uber Cash點數條款、《一般條款》和由Uber向您通知(包含但不限於透過行動應用程式或網站)的任何其他額外或特定條款(包括關於有效期限的條款)的拘束。
2.3 “General Terms” means the General Terms of Use published on the Uber website (https://www.uber.com/legal/zh-tw/), as amended or restated from time to time.
「一般條款」是指Uber網站(https://www.uber.com/legal/zh-tw/)上所登載經不時修訂或重定的一般使用條款。
2.4 “Payment Method” means a method of payment within your Account for Transactions within the Territory.
「付款方式」是指您的帳戶中用於境內交易的付款方式。
2.5 “Promo Credits” means non-refundable and non-transferable promotional credits issued to you by Uber or its affiliate as Uber Cash, in connection with a promotion or promotional codes (“Promo”) which are issued subject to these Uber Cash Terms, the General Terms and any other additional or specific terms that Uber establishes (including with respect to expiration) on a per Promo basis as communicated to Users by Uber, including but not limited to via its mobile applications or websites.
「優惠點數」是指由Uber或其關聯企業以Uber Cash點數的形式向您發放與優惠活動或優惠序號(下稱「優惠」) 相關之不可退款、不可轉讓的優惠點數。優惠點數之發放受本Uber Cash點數條款、《一般條款》及Uber於個別優惠中制定並由Uber通知使用者(包含但不限於通過行動應用程式或網站)之任何其他額外或特定條款(包含有效期限的相關規定)之拘束。ejhgcblckcdjicnfurvnncttfinghklurirujgkftikf
2.6 “Privacy Notice” means Uber’s Privacy Notice published on the Uber website (https://www.uber.com/legal/zh-tw/), as amended or restated from time to time.
「隱私權聲明」是指在Uber網站(https://www.uber.com/legal/zh-tw/)上所登載經不時修訂或重定的Uber隱私權聲明。
2.7 “Territory” means Taiwan.
「境內」是指台灣。
2.8 “Third Party Provider” has the meaning of ‘Third Party Transportation Provider’ and/or ‘Merchant’, as applicable, as defined in the General Terms.
「第三方提供商」依其適用之情形係指《一般條款》中所定義之「第三方運輸提供商」及/或商家。
2.9 “Transaction” means the purchase of goods or services offered by a Third Party Provider or applicable Uber Provided Services via Uber or Uber Eats mobile applications and/or websites pursuant to the General Terms.
「交易」指的是依據《一般條款》透過Uber或Uber Eats行動應用程式和/或網站上購買第三方提供商所提供的商品或服務或購買適用的Uber提供的服務。
2.10 “Uber Cash” has the meaning set out in section 3.1.
「Uber Cash點數」的定義如第3.1條。
2.11 “Uber Cash Terms” means these Uber Cash terms of use, as amended or restated from time to time.
「Uber Cash點數條款」是指所登載經不時修訂或重定的本Uber Cash點數條款。
2.12 “Uber Provided Services” means the services that Uber or Uber's affiliates provide as set out in the General Terms.
「Uber提供的服務」是指Uber或Uber的關聯企業於《一般條款》所記載提供的服務。
2.13 “User” or “you” means you as the individual holding the Wallet.
「使用者」或「您」是指持有錢包的個人。
2.14 “Wallet” means the digital wallet linked to your Account in which we administer your Uber Cash balance.
「錢包」是指連結至您帳戶並由我們管理您Uber Cash點數餘額之電子錢包。
2.15 “we” or “us” means Uber.
「我們」是指Uber。
2.16 “Uber One Credits” means any non-refundable and non-transferable Uber Cash credits which are issued to you as an earned benefit in accordance with the Uber One Terms and Conditions (as amended from time to time).
「Uber One點數」是指依據《Uber One之條款與條件》(經不時修訂)所獲得之優惠,向您發放之不可退款、不可轉讓的Uber Cash點數。
3. What is Uber Cash?
什麼是Uber Cash點數?
3.1 “Uber Cash” means the credits issued by Uber or its affiliates or a Third Party Provider, and includes:
(a) credits provided or gifted to you such as Promo Credits; or
(b) credits earned by you or issued to you in accordance with an offer, an Uber renewable membership product (subject to their applicable terms and conditions), and includes issues of Uber One Credits; or
(c) any other, discretionary grants of Uber Cash such as Appeasements.
「Uber Cash點數」是指由Uber或其關聯企業或第三方提供商發放給您之點數,包括:
(a) 提供或贈送給您的點數,例如優惠點數;
(b) 依據優惠活動或續約制之會員產品(受限於其適用之條款與條件所約束)您所獲得或發放給您的點數,包括 Uber One 點數;
(c) 以及其他以Uber Cash點數形式提供的點數,例如補償禮遇金。
3.2 You will not earn interest or any other benefit over the Uber Cash balance held in your Wallet.
您的錢包中所持有的Uber Cash點數餘額並不會產生利息或任何其他收益。
3.3 You understand and agree that Uber Cash is not a gift certificate, a means of electronic payment, or its relevant product or service.
您了解並同意Uber Cash點數並非禮券、電子支付方式或該等相關產品或服務。
4. Loading Uber Cash
增添Uber Cash
4.1 It is not permissible for you to purchase or load Uber Cash into your Wallet in the Territory.
在境內,您不得購買或增添Uber Cash點數到您的錢包。
4.2 Appeasements will be applied by Uber directly to your Uber Cash balance in your Wallet.
補償禮遇金將直接由Uber添加到您的錢包中的Uber Cash點數餘額。
4.3 Promo Credits may be provided to you by Uber or a Third Party Provider physically, by SMS, email or other digital means. To add Promo Credits to your Wallet, follow the instructions provided to you with the physical Promo, SMS, email or as directed in the digital means.
優惠點數可能以實體形式、簡訊、電子郵件或其他電子方式由Uber或第三方提供商提供給您。若要將優惠點數添加到您的錢包中,請依照實體優惠、簡訊、電子郵件中或其他電子方式中的指示進行操作。
4.4 Where Uber Cash is provided as an Appeasement, Uber will load such Uber Cash into your Wallet.
當我們向您提供Uber Cash點數作為補償禮遇金,Uber將會把該Uber Cash點數增添至您的錢包中。
4.5 We may be unable to, or we may refuse to, load Uber Cash to your Wallet, for example if loading Uber Cash makes your balance exceed a threshold determined by us or specified by applicable law.
我們可能無法或我們得拒絕將Uber Cash點數增添至您的錢包中,例如:如增添Uber Cash點數將使您的餘額超過我們所決定或依據適用法律所規定之限額。
5. Using Uber Cash
使用Uber Cash點數
5.1 Uber Cash may only be applied on eligible Transactions within the Territory.
Uber Cash點數僅得適用於境內符合條件的之交易。
5.2 You can use Uber Cash as a Payment Method provided that you have an active and valid Account. We may require you to add a secondary Payment Method to be able to use Uber Cash as a Payment Method. For example where your Uber Cash balance is not sufficient to cover the full Transaction amount. We reserve the right to modify the type of Transactions for which Uber Cash can be used as a Payment Method.
只要您擁有活躍且有效的帳戶,您可以將Uber Cash點數作為付款方式。我們得要求您添加第二個付款方式,以使您能夠使用Uber Cash點數作為付款方式。例如在您的Uber Cash點數餘額不足以支付全部交易金額時。我們保留修改得使用Uber Cash點數作為付款方式的交易類型的權利。
5.3 Uber will automatically apply Uber Cash to an eligible Transaction if you have Uber Cash in your Wallet. You may choose to select another Payment Method for an eligible Transaction.
如果您的錢包中有Uber Cash點數,Uber會自動將Uber Cash點數使用於符合條件的交易。您也可以為符合條件的交易選擇其他付款方式。
5.4 Uber Cash is not transferable to other users or otherwise.
Uber Cash點數無法轉讓給其他使用者或以其他方式轉移。
5.5 When you enter into a Transaction and Uber Cash is applied as a partial or full Payment Method, you consent to Uber or the Third Party Provider involved in that Transaction initiating a payment transaction with your Uber Cash balance upon completion of the Transaction. If you owe Uber or the Third Party Provider any fees or charges in relation to the Transaction, you consent to Uber initiating a payment transaction with your Uber Cash balance upon completion of the Transaction.
當您進行交易,並使用Uber Cash點數作為付款方式以支付部分或全部之款項,您同意Uber或涉及該交易之第三方提供商於交易完成時使用您的Uber Cash點數餘額付款。如果您對Uber或第三方提供商有與交易相關的任何費用或收費之欠款,您同意Uber於交易完成時使用您的Uber Cash點數餘額為付款。
5.6 Completion of a payment transaction using Uber Cash will result in an immediate and irrevocable debiting of your Uber Cash balance. Your Uber Cash balance will be debited for the Transaction amount including any applicable taxes, fees or charges imposed by the Third Party Provider and/or Uber.
使用Uber Cash點數完成付款交易將導致您的Uber Cash點數餘額立即且不可撤銷地被扣除。您的Uber Cash點數餘額將扣除交易金額(包括第三方提供商和/或Uber所收取的任何適用的稅費、費用或收費)。
5.7 You may find your Uber Cash balance in your Uber application or Uber Eats application by tapping on your Profile and, subsequently, tapping on “Wallet”.
您可以在Uber應用程式或Uber Eats應用程式中點擊您的個人資料,然後點擊「錢包」以得知您的Uber Cash點數餘額。
5.8 Your use of the Wallet and Uber Cash is free of charge.
您使用錢包和Uber Cash點數是免費的。
5.9 We reserve the right to suspend your use of Uber Cash as a Payment Method and/or forfeit all or part of granted Uber Cash for reasons including but not limited to the security of the Wallet or the Uber Cash balance, fraudulent activities in relation to Uber Cash, and/or violation of these Uber Cash Terms, the General Terms or our Community Guidelines. We will notify you of such suspension and/or forfeiture and the reasons for it prior to such suspension or forfeiture where possible, or at the latest as soon as possible thereafter. You can contact us in relation to your suspension or forfeiture using the contact information detailed in section 15. We will not notify you if this would compromise security reasons or is prohibited by relevant laws and regulations. We may reactivate your use of Uber Cash in the Wallet once the reasons for suspension no longer exist.
我們保留暫停您使用Uber Cash點數為付款方式及/或取消全部或部分已授予的Uber Cash點數之權利,包括但不限於因錢包及Uber Cash點數餘額安全相關原因、與Uber Cash點數有關的欺詐行爲、及/或違反本Uber Cash點數條款、《一般條款》或我們的社群指引等相關原因。在可能的情況下,我們將在暫時停用及/或取消之前,通知您有關此暫停及/或取消的原因,或者在暫停或取消發生之後盡快通知您。您可以使用第15條中提供的聯繫資訊與我們聯繫,以了解有關被暫停或取消的事宜。如果通知您會危及安全或違反相關法律規定,我們將不會通知您。一旦暫時停用的原因消除,我們得重新啟用您在錢包中使用Uber Cash的權限。
6. Redemption

Uber Cash may not be redeemed or exchanged for cash or as a credit to an alternative Payment Method. You can contact us in relation to any concerns you may have by using the contact information detailed in section 15.
Uber Cash點數不得兌換或交換成現金或其他付款方式的點數。如有任何疑慮,您可以透過第15條中提供的聯繫資訊與我們聯繫。
7. Expiry of Uber Cash
Uber Cash點數的有效日期
Uber Cash will be subject to the expiration date set out in any specific terms and conditions communicated to you by the Uber application, the Uber Eats application, Uber or Uber Eats websites or, if applicable, on any physical or other digital material.
Uber Cash點數將受到透過Uber應用程式、Uber Eats應用程式、Uber或Uber Eats網站或任何適用的實體或其他數位資料通知您的任何特定條款和條件中設定的有效日期的限制。
8. Customer identification, fraud identification and anti-money laundering
辨識客戶、詐欺識別及反洗錢
8.1 In order to ensure your security, prevent fraud or identity theft and (if applicable) comply with anti-money laundering and counter terrorism financing laws and regulations (as applicable), we may request information from you at the time of initiating your first Transaction to confirm your identity, to allow you to open and maintain a Wallet and to use Uber Cash. We may also request you for additional information or documents to verify your information from time to time. This is one way that we try to make sure that the person who accesses your Wallet and Uber Cash is you or is duly authorised by you.
為確保您的資訊安全,防止詐騙或身份盜用,以及(如有適用)遵守(適用的)防制洗錢和打擊資恐的法規,在您首次進行交易時,我們可能會要求您提供資訊,以確認您的身份,使您得以設立及持有錢包並使用Uber Cash點數。我們還可能不時向您要求額外的資訊或文件以驗證您的資訊。這是我們盡力確保使用您的錢包和Uber Cash點數的人是您本人或經您正式授權的人的一種方式。
8.2 We may delay, suspend or block your access to and use of Uber Cash until you comply with these information requests or other verification steps that may be required at any time.
在您完成於任何時候所需的資訊要求或其他驗證步驟之前,我們可能會延後、暫停或停止您存取和使用Uber Cash點數。
8.3 Uber or its affiliates may, from time to time, be required to undertake financial crime screening to comply with applicable laws or regulations. Subject to local regulatory requirements, you consent and authorise Uber and its affiliates to disclose your personal data to the law enforcement and regulatory agencies upon their requests. You also agree to assist Uber and its affiliates and cooperate with any requests for information in this respect.
Uber或其關聯企業可能不時需要進行金融犯罪檢查以遵守適用法律及規定。於符合當地法規要求之前提下,您同意並授權Uber及其關聯企業於執法和監管機構要求下揭露您的個人資料,您亦同意協助Uber及其關聯企業並配合任何與此相關之資訊要求。
9. Authentication & security

9.1 If required by applicable law, we may require you to provide us with personalised security credentials, such as passwords, PIN codes, access codes (for example confirmation codes provided through Uber’s mobile applications and/or website or via SMS) or by using on-device biometric verification methods. Such personalised security credentials will be used to authenticate any instruction you give us through Uber or Uber Eats mobile applications and/or website relating to your use of Uber Cash. This will help us ensure that access to your Wallet and Uber Cash is by you or is duly authorised by you.
如適用法律要求,我們可能需要您提供個人化的安全憑證,例如密碼、PIN碼、存取碼(例如透過Uber的行動應用程式和/或網站或通過簡訊提供的驗證碼)或使用設備上的生物識別驗證方法。這些個人化的安全憑證將用於驗證您透過Uber或Uber Eats行動應用程式和/或網站所給予我們與使用Uber Cash點數的相關指示。這將有助於確保只有您或經您正式授權的人才能使用您的錢包和Uber Cash點數。
9.2 You agree to take all reasonable steps to keep your personalised security credentials safe. This means that you must use your personalised security credentials with care and keep them secret. This, for example, means that (i) you should not write down or save these credentials, (ii) if you can choose a security code yourself, you should make sure it is not easy to guess, (iii) you should make sure no-one can watch while you are entering a personalised security credential, (iv) you must never share a security credential or code, whether via phone, e-mail or otherwise.
您同意採取一切合理措施保護您的個人化安全憑證的安全。這意味著您必須謹慎使用並保密您的個人化安全憑證。例如,這意味著:(i)您不應該寫下或儲存這些憑證(ii)如果您可以自行選擇安全碼,請確保它不容易被猜測,(iii)請確保在輸入個人化安全憑證時沒有人能看到,(iv)您絕不能分享安全憑證或安全碼,無論是通過電話、電子郵件或其他方式。
9.3 You must make sure that any device on which you access Uber or Uber Eats mobile applications and/or website is safe and secure. This, for example, means that you (i) make sure that the software used on your device is up to date and legal, (ii) use a password to safeguard access to the device, (iii) make sure your Account cannot be used by any unauthorised parties, and (iv) lock your device when you are finished using your Account.
您必須確保您用以使用Uber或Uber Eats行動應用程式和/或網站的任何設備是安全可靠的。這包括以下措施:(i)確保您設備上使用的軟體是最新且合法的,(ii)使用密碼保護設備的存取,(iii)確保您的帳戶不被任何未經授權的人使用,(iv)在使用完畢後登出您的帳戶。
10. Liability for unauthorised transactions
未經授權交易的責任
You agree to notify us immediately upon becoming aware of any fraudulent activity or theft or unauthorised use of a payment transaction involving your Uber Cash (an “unauthorised transaction”). For the avoidance of doubt, if a Transaction was partly paid using your payment card, you are still responsible for informing your financial institution or payment services provider of any fraud related to your payment card.
您同意一旦知悉涉及您Uber Cash點數之任何詐欺活動、竊盜或未經授權的付款交易(下稱「未經授權交易」),將立即通知我們。為免疑義,如果交易是以您的付款卡部分支付,您仍需負責通知您的金融機構或支付服務供應商任何有關您付款卡的詐欺事宜。
11. Liability for defectively executed transactions
未執行或有執行上有缺失之交易的責任
Uber or its affiliates is liable to you for Transactions paid for by you using Uber Cash where the Transaction was defectively executed. Any liability to you for such Transactions will be limited to the amount of the relevant Transaction which you incurred. We are not liable for any indirect, special or consequential damages you incur.
如您已使用Uber Cash點數支付交易款項且該交易有執行上之瑕疵,Uber及其關聯企業應就該交易對您負責。任何就該交易對您應負之責任將受限於該交易的數額。我們對於您所受的任何間接、特殊或附帶損害不負有責任。
12. Liability in cases of abnormal and unforeseeable circumstances
異常和不可預見的情況下的責任
Uber and its affiliates will not be liable under these Uber Cash Terms in cases of abnormal and unforeseeable circumstances beyond our control, the consequences of which would have been unavoidable despite our efforts to the contrary, or where we are bound by other legal obligations covered by applicable laws.
在超出我們的控制範圍的異常和不可預見的情況下,且即使我們盡力避免也會無法改變其後果,或我們於適用法律下受其他法律義務拘束之情形下,Uber及其關聯企業均不承擔本Uber Cash點數條款之責任。
13. Amendment of Uber Cash Terms
本Uber Cash點數條款的修正
We may amend these Uber Cash Terms at any time.
我們得隨時修正本Uber Cash點數條款。
14. Information provision
資訊條款
You can review your Uber Cash transactions and balance by logging into your Account at any time. The Uber Cash balance displayed in your Account will serve as conclusive evidence of your Uber Cash balance.
您可以隨時登入您的帳戶以查看您的Uber Cash點數交易和餘額。在您的帳戶中所顯示的Uber Cash點數餘額將作為您Uber Cash點數餘額的決定性依據。

16. Privacy

Our collection and use of personal information in connection with the Services (including Uber Cash) is as provided in Uber’s Privacy Notice located at https://www.uber.com/legal/en/document/?name=privacy-notice&country=taiwan&lang=zh-tw. Uber may provide to a claims processor, regulator or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may involve you and a Third Party Provider and such information or data is necessary to resolve the complaint, dispute or conflict.
我們按照 Uber 隱私權聲明 (https://www.uber.com/legal/en/document/?name=privacy-notice&country=taiwan&lang=zh-tw.) 蒐集和使用與本服務(包括Uber Cash點數)有關的個人資訊。若有涉及您與第三方提供商的投訴、爭議或衝突,且該資料或資訊為解決投訴、爭議或衝突所必要,則 Uber 可向索賠處理商、主管機關或保險公司提供任何必要資訊(包括您的聯絡資訊)。
17. Miscellaneous Terms
其他條款
17.1 If any section of these Uber Cash Terms is deemed to be invalid, void or for any reason unenforceable, for example due to overriding provisions of consumer protection laws in the Territory, whether in whole or in part, that section or part of that section shall be deemed severable and will not affect the legality, validity and enforceability of any remaining sections of these Uber Cash Terms. In addition, we will replace the relevant section or part of that section by provisions that are valid and binding and that have, to the greatest extent possible, a similar effect as the invalid, void or otherwise unenforceable section or part of that section, given the contents and purpose of these Uber Cash Terms.
若本Uber Cash點數條款的任何條款的整體或部分被視為不成立、無效或不可強制執行,例如因境內的消費者保護法之規定,該條款或條款之相關部分應被視為可分割的,且不影響本條款的其餘條款的合法性、有效性及可強制執行性。此外,我們將根據本Uber Cash點數條款的內容及目的,盡可能以效果類似於該不成立、無效或不可強制執行的條款(或部分)的合法、有效及可強制執行的條款(或部分)替換該不成立、無效或不可強制執行條款(或部分)。
17.2 You do not have the right to assign or transfer the Uber Cash Terms or the rights or obligations arising from it, in whole or in part. Uber has the right to novate, assign or transfer the Uber Cash Terms or the rights or obligations arising therefrom in whole or in part without your permission provided this will not lead to a reduction of the rights you are entitled to by virtue of these terms or by law.
您無權轉讓或移轉本Uber Cash點數條款或由此產生的權利或義務 (不論全部或部分)。Uber於不減少您依據本條款或法律所享有的權利之前提下,無須取得您的同意,即有權部分或全部的更新、轉讓或移轉本Uber Cash點數條款或由此而生之權利或義務。
17.3 You confirm that there are no external beneficiaries to these Uber Cash Terms. Nothing that is included in the Uber Cash Terms is intended, or may be construed as creating claims on behalf of third parties.
您確認本Uber Cash點數條款並沒有其他受益人。本Uber Cash點數條款中所包含的任何內容均不意味或可能被解釋成代表第三方之利益提出請求的依據。
18. Language
語言
Any translation of these Uber Cash Terms in Chinese is for your convenience only. The English language version of the Uber Cash Terms is binding and will prevail in the event of a conflict with a version in a language other than English.
本Uber Cash點數條款的任何中文翻譯,僅為方便您參考之用。英文版本的本Uber Cash點數條款具有拘束力,且於與非英文版本有歧異時,以英文版為準。
19. Term and termination
有效期及終止
19.1 These Uber Cash Terms are valid and applicable until they are amended and replaced by the latest version published on our website. You can terminate your use of the Wallet and the applicability of these Uber Cash Terms at any time via Uber or Uber Eats mobile applications and/or website by closing your Account. When you terminate the General Terms in accordance with its terms, we will consider this to also include termination of these Uber Cash Terms.
本Uber Cash點數條款在未經我們於網站上公告的最新版本修訂且取代之前,皆有效且適用。您可以隨時透過Uber或Uber Eats的行動應用程式和/或網站關閉您的帳戶,以終止使用錢包以及所適用本Uber Cash點數條款。當您根據其規定終止《一般條款》時,我們將視此為同時終止本Uber Cash點數條款。
19.2 Uber may (subject to any applicable laws) terminate these Uber Cash Terms with respect to you taking into account a notice period of at least two weeks.

19.3 All Uber Cash balance available in your Wallet will immediately expire and will be forfeited upon your termination of your Account under the General Terms or the termination of these Uber Cash Terms.
於您依據《一般條款》終止帳戶或終止本Uber Cash點數條款時,您將失去錢包裡的所有可使用的Uber Cash點數餘額,且該Uber Cash點數將立即失效。
20. Applicable Law and Jurisdiction
準據法及管轄
The Uber Cash Terms are exclusively governed by the laws of the Territory, excluding its rules on conflicts of laws. However, if you reside in the Territory, statutory consumer protection regulations in your country of residence that are more beneficial for you may apply. The Vienna Convention on the International Sale of Goods of 1980 (CISG) shall not apply. Any dispute, conflict or controversy, howsoever arising out of or broadly in connection with or relating to the Uber Cash Terms, including those relating to its validity, its construction or its enforceability, shall be settled by the judicial proceedings in the Territory.
本Uber Cash點數條款應專屬適用境內法律為準據法,並排除法律衝突法則之適用。然而,如果您居住在境內,您可能適用更利於您之居住國的法定消費者保護法之規定。1980年《聯合國國際貨物銷售公約》(CISG)並不適用於本條款。任何爭議、衝突或糾紛,無論源自或廣泛的與本Uber Cash點數條款相關,包括涉及其有效性、解釋或可強制執行性的事項,均應透過境內的司法程序解決。
