COURIER TERMS AND CONDITIONS
優快送條款與條件
Courier enables users (“you”) to request the delivery of package(s) (the “Package(s)”) to your designated address (“Courier Delivery Services”). Courier Delivery Services are provided by Third Party Transportation Providers through the Uber App. For the avoidance of doubt, Third Party Transportation Providers shall mean Uber Portier Taiwan Co., Ltd. (“Portier Taiwan”).
優快送讓使用者(「您」)能請求運送包裹(「包裹」)至您指定地址(「優快送外送服務」)。優快送外送服務係由第三方運輸提供商透過Uber應用程式所提供。為免疑義,第三方運輸提供商係指優食台灣股份有限公司(即Uber Portier Taiwan Co. Ltd.,「優食台灣」)
These Courier Terms and Conditions (“Courier Terms”) set out the additional terms and conditions that apply if you request a Courier Delivery Service via the Uber App.
本優快送條款與條件(「優快送條款」)訂定之補充規定適用於您透過 Uber 應用程式要求優快送外送服務之情形。
1. Relationship/ 關係
These Courier Terms are supplementary to and shall be incorporated into the Taiwan Rides Terms and Conditions (HERE) (“Rides Terms”) and govern your access and use of applications, websites, content, and products and services made available by Uber B.V. and its parents, subsidiaries, representatives, affiliates, officers and directors (collectively, “Uber”), Third Party Transportation Providers, and/ or independent contractors who intend to perform on-demand delivery services on behalf of Third Party Transportation Providers (“Delivery Partners”).
This means where you choose to use Courier Delivery Service to request delivery services from Third Party Transportation Providers, the following applies to your use and access of Courier Delivery Service:
- these Courier Terms; and
- except as modified by these Courier Terms, the Rides Terms.
Capitalised terms in this Courier Terms that are not defined shall bear the meaning ascribed to them in the Rides Terms. Except for what is expressly provided for under this Courier Terms, no other provision of the Rides Terms shall be amended and all terms and conditions of the Rides Terms shall continue, remain in force and apply. In the event of a conflict between these Courier Terms and any other terms and conditions of the Rider Terms the Courier Terms will prevail for Courier Delivery Services unless expressly stated otherwise.
本優快送條款係補充並應納入 Taiwan Rides 條款和條件(「Rides條款」)(按這裡),用以規範您存取或使用 Uber B.V. 及其母公司、子公司、代表人、關係企業、經理和董事(下合稱「Uber」;「優步」)、第三方運輸提供商及/或意圖代表第三方運輸提供商履行按需外送服務之獨立承攬人(「外送合作夥伴」)提供之應用程式、網站、內容、產品和服務。
當你選擇使用優快送外送服務請求自第三方運輸提供商提供外送服務時,以下適用您的存取或使用優快送外送服務 :
- 本優快送條款;和
- 除本條款修改外之Rides條款。
本優快送條款中未定義的大寫術語應具有Rides條款中賦予它們的含義。除本優快送條款明確規定的內容外,不得修改Rides條款的任何其他條款,Rides條款的所有條款和條件應繼續有效並適用。如優快送條款與Rides條款中之條款或條件有衝突時,除非另有明確約定,優快送條款於優快送外送服務中應優先適用。
2. Courier Delivery Services/ 優快送外送服務
Courier allows you to request Courier Delivery Services of Package(s) using the Uber App. Package(s) includes both the content and the materials for its containment.
優快送使您得使用 Uber 應用程式請求優快送運送服務運送包裹。包裹指包含內容物和包覆之材料。
You may place requests to have Packages delivered by Third Party Transportation Providers via the Uber App, using the ‘Courier’ request option.
您得使用 Uber 應用程式中的「優快送」請求選項請求第三方運輸提供商運送包裹。
Courier Delivery Services are offered in designated areas as communicated via the Uber App from time to time (“Courier Active Area”). Uber does not guarantee that the Courier Delivery Services will be available in the Courier Active Area at all times.
優快送外送服務乃不定時透過 Uber 應用程式於指定區域提供(「優快送使用範圍」)。 Uber 並不保證優快送外送服務將隨時於優快送使用範圍內提供。
2.1. If you choose Courier Delivery Services/如您選擇優快送外送服務
If you choose the ‘Courier’ request option, you will be charged for the Courier Delivery Services. Delivery Partners will collect Packages from you or from your designated address and deliver those Packages to your nominated location as part of the Courier Delivery Services.
如您選擇使用優快送,您需支付優快送外送服務之費用。 作為優快送外送服務的一部分,外送合作夥伴將自您或自您指定地點提取包裹並運送包裹至您的指定地點。
For each Courier Delivery Service requested, the Third Party Transportation Provider will endeavour to ensure that your request is matched to a Delivery Partner as soon as reasonably possible. Unfortunately, independent factors such as traffic and weather, as well as the actions or inactions of Delivery Partners may cause delays in the provision of Courier Delivery Services.
就每一個 優快送外送服務 請求, 第三方運輸提供商將努力確保您的請求將於合理情形下盡快被外送合作夥伴接受。 惟,例如交通或天氣以及外送合作夥伴之作為或不作為等獨立因素皆可能導致外送服務之遲延。
You shall notify and obtain the consent of any third party recipient or sender of a Package that their personal information, including their name, phone number and pick-up or delivery address, will be disclosed to Uber, Third Party Transportation Provider, and Delivery Partners for purposes of Courier Delivery Services and in accordance with Uber’s Privacy Notice (https://privacy.uber.com/policy/).
您應通知包裹之任何第三方收貨人或寄貨人並徵得其同意,有關他們之個人資訊,包含姓名、電話號碼及取貨或送貨地址,將出於優快送外送服務之目的並根據優步之隱私聲明(https://privacy.uber.com/policy/)揭露予Uber、第三方運輸提供商及外送合作夥伴。
You represent and warrant that you are the owner of the Package(s) or an authorized agent of the owner, and that the requested method of delivery has been authorized. You also represent and warrant that, as an agent of the Package(s) owner, you accept the Courier Terms.
您聲明並保證是包裹的所有人或經所有人授權的代理人,且您要求運送的方式已經過授權。您亦聲明並保證作為包裹所有人的代理人接受優快送條款。
2.2. Prohibited Packages/ 違禁包裹
You agree to comply with any and all laws and regulations relating to the Package itself, its condition, packaging, handling, storage and transportation. In addition, you may not use or access Courier Delivery Services to send any prohibited Packages (“Prohibited Packages”). A Restrictive Item List of Prohibited Packages is published online by Uber (HERE) (as updated from time to time without prior notification). Uber retains the sole discretion to prohibit additional Package items from time to time. It is your responsibility to ensure that you have checked the current list of Prohibited Packages each time you use the Courier Delivery Services. Depending on your location, there may be additional Prohibited Packages or restrictions on the use of Courier Delivery Services for specific categories of items.
您同意遵守任何和包裹本身,及其狀態、包裝、處理、儲藏與運送相關法規。此外,您不得利用或使用優快送外送服務寄送任何違禁包裹(以下稱「違禁包裹」)。違禁包裹之運送物品限制清單由優步於線上發布(按這裡) (不定期更新,且不另行事先通知)。優步得不定時自行決定限制額外的包裹項目。您有責任確保每次使用優快送外送服務時均檢查最新的違禁包裹清單。依據您所在之位置,可能會有額外之違禁包裹或對特定類別物品使用 優快送外送服務之限制。
If you use Courier Delivery Services to deliver Prohibited Packages or any items that are restricted by applicable laws or could affect the operation of the Courier Delivery Service, Third Party Transportation Providers and Delivery Partners may refuse to deliver the Packages and may take necessary measures to report the matter to the relevant authorities. Any delivery fees already paid will not be refunded. Furthermore, if Third Party Transportation Providers or Delivery Partners reasonably suspect that the Package involves prohibited items, or if there are safety or other regulatory concerns, Third Party Transportation Providers or Delivery Partners have the right to refuse to accept or deliver the item.
若您使用優快送外送服務運送違禁包裹或任何適用法律限制的物品或可能影響優快送外送服務營運的物品,第三方運輸提供商及外送合作夥伴得拒絕提供外送服務,並得採取必要的措施向主管機關報告,且已收取之運費將不退還。此外,如果第三方運輸提供商或外送合作夥伴合理懷疑包裹涉及違禁物品,或因安全或其他法規監管之原因,第三方運輸提供商或外送合作夥伴有權拒絕接收或運送該物品。
Should any third party suffer any loss or damage (including but not limited to physical damage, loss of income, personal injury, financial loss, or any other loss or damage) as a result of your breach of the Courier terms, you shall be fully liable for all such losses and damages.
若因您違反本優快送條款,造成任意第三方遭受損失或損害(包括但不限於物理損害、收入損失、人身傷害、財務損害、或任何其他損失或損害),您應自行承擔全部責任。
You must prepare, appropriately package and securely close and seal the Package(s) for safe delivery. In the event of improper packaging, Third Party Transportation Providers and Delivery Partners may request that you address the issue; if you fail to take appropriate action, you agree and acknowledge that you shall be solely responsible for any resulting loss or damage to the Package and the Third Party Transportation Providers and Delivery Partners may refuse to deliver the Package.
您須準備、適當包裝並牢固的關閉和密封包裹以確保安全外送。如有包裝不妥的情形,第三方運輸提供商及外送合作夥伴得請您加以處理;若您消極不為處理時,您知悉並同意如包裹因此而受有任何損失或損害,您應自行負責,且第三方運輸提供商及外送合作夥伴亦得拒絕運送。
You agree that when delivering hazardous or fragile items, you shall clearly label the Package with appropriate markings such as 'Handle with Care' or 'Fragile,' according to the nature of the items. If such markings are not provided and damage occurs, Uber, Third Party Transportation Providers, and Delivery Partners shall not be held responsible. Furthermore, if such damage results in harm to the goods, property, or vehicles of others, including Third Party Transportation Providers and Delivery Partners, you shall be liable for any resulting damages and compensation.
您同意於託運危險品或易損壞物品時,應按其性質在包裹上標明「應予注意」或「易損壞品」等字樣,如不標明致有毀損者,優步、第三方運輸提供商及外送合作夥伴均不負責任。且如因而毀損他人(包括第三方運輸提供商及外送合作夥伴)之貨物、財產及車輛者,應由您負損害賠償之責。
You acknowledge that Uber, Third Party Transportation Providers, and Delivery Partners cannot be aware of the contents of the Package you send. Unless prior consent has been given by you, a request is made by law enforcement authorities, or as otherwise provided in these Courier Terms, Uber, Third Party Transportation Providers, and Delivery Partners will not open the Package to verify its contents, and as such, cannot be held responsible for the delivery of any items. Uber, Third Party Transportation Providers, and Delivery Partners shall not bear any obligations or legal liabilities arising from the results of the delivery.
您瞭解優步、第三方運輸提供商及外送合作夥伴無法知悉您寄送包裹的內容,除有事先經過您的允許、經執法機構的要求或本優快送條款另有約定之情形,否則優步、第三方運輸提供商及外送合作夥伴均不會開拆包裹確認內容物,故無法針對運送物品予以負責。優步、第三方運輸提供商及外送合作夥伴對於因運送產生的結果均不負任何義務與法律責任。
You acknowledge and agree that during the delivery process, if Delivery Partners reasonably suspect that your Package involves prohibited items or if law enforcement authorities request to inspect your Package, Delivery Partners have the right to disclose or provide your Package to the law enforcement authorities. After the Package has been inspected, Delivery Partners will make reasonable efforts to restore the packaging; however, Uber, Third Party Transportation Providers, and Delivery Partners shall not be liable for maintaining the integrity or condition of the Package.
您瞭解並同意,於包裹運送過程中,若外送合作夥伴合理懷疑您的包裹涉及違禁物品或遇有執法機構要求對您的包裹進行檢驗,則外送合作夥伴有權向執法機構揭示或交付您的包裹。外送合作夥伴於包裹經檢視後應盡其合理努力恢復包裹之包裝,惟優步、第三方運輸提供商或外送合作夥伴就包裹之完好無損均不負擔維護責任。
2.3. Package Restrictions/ 包裹限制
The Package(s) in their aggregate, per trip, (i) may not be greater than 13 kilograms, (ii) must fit comfortably in the storage compartment of a vehicle, and (iii) may not have a total value greater than NTD5,000, (iv) if delivered by motorcycle: The volume of the item (including packaging) must not exceed 40 x 20 x 30 cm (length x width x height). For other restrictions you may be subject to, please refer to Courier Restrictive Item List (HERE) (as updated from time to time without prior notification). When delivering fragile items or items that require special attention, you should always provide detailed information in the order notes.
每個行程之包裹合計,(i) 不得超過 13 公斤,(ii) 必須能舒適地放入車內, (iii) 總價值不得超過新台幣5,000,並且 (iv) 如是以機車運送者:物品體積(含包裝)不得超過40X20X30公分(長 X寬 X 高)。其他您應遵守之限制規定請參優快送運送物品限制清單 (按這裡) (不定期更新,且不另行事先告知)。於運送易碎物品或需要特別注意之物品時,您應於訂單備註詳盡告知義務。
You acknowledge and agree that if you breach any package restrictions, Third Party Transportation Providers and Delivery Partners may cancel the Courier Delivery Service request, including refusing pickup, requesting proper packaging, or returning the Package to the user, and the user shall be liable for any delivery fee and related cancellation fees. In addition, you shall be solely responsible for any resulting damage to the Package, and neither Uber, Third Party Transportation Providers nor Delivery Partners shall be liable for any such damage.
您瞭解並同意,如有違反任何包裹限制,第三方運輸提供商及外送合作夥伴得取消優快送外送服務的運送請求,包括拒絕提貨、要求提供妥善包裝或將包裹退還給您,且您應支付任何運費及相關的取消費。此外,如有因此造成任何包裹的損壞,您應自行負責,優步、第三方運輸提供商及外送合作夥伴均不負任何責任。
2.4. Refusal or Rejection of Deliveries/ 拒絕或回絕外送
You acknowledge and agree that there may be circumstances where your Courier Delivery Service request may be canceled, including where Third Party Transportation Providers and/or Delivery Partners, in their sole discretion, declines to pick up or deliver the Package(s).
您瞭解並同意,於某些情況下,您的優快送運送服務的運送請求可能會被取消,包含第三方運輸提供商及/或外送合作夥伴自行決定拒絕提貨或外送包裹。
You acknowledge and agree that you are responsible for ensuring that you and anyone who has contact with Uber, Third Party Transportation Providers and/or Delivery Partners, or any other person as part of the Courier Delivery Services you have requested, complies with the Uber Community Guidelines.
您瞭解並同意,您有責任確保您及任何與優步、第三方運輸提供商及/或外送合作夥伴有聯繫之人或任何作為您請求優快送外送服務一部分之其他人遵守Uber社群指引。
2.5. Delivery, Redelivery, and Undeliverable Packages/ 運送、重新運送、及無法運送之包裹
If Third Party Transportation Providers and/or Delivery Partners are not able to complete the delivery for any reason (including, for example, where Delivery Partners are unable to locate the delivery location or are unable to make contact with you or the delivery recipient), you acknowledge and agree that the Package may be left at the original pickup location, an alternative location as instructed by you, or at the delivery location, or safe place near the delivery location. To the extent feasible, Uber, Third Party Transportation Providers, and Delivery Partners may also attempt to arrange for the return of the Package to you.
若第三方運輸提供商及/或外送合作夥伴因任何原因無法完成運送(包含,例如,外送合作夥伴無法找到收件地點或無法與您或外送收件人取得聯繫),您知悉並同意包裹可能會留在原始取貨地點、您指示之替代地點、外送地點或鄰近外送地點之安全地點。於可行之情況下,優步、第三方運輸提供商及外送合作夥伴也可能嘗試安排退還包裹給您。
You are responsible for the delivery fees and other reasonable costs associated with the return, redelivery or disposal of your Package, including instances where your Package is returned due to an incomplete delivery, regardless of the reason, except where the return, redelivery or disposal arises from any fraudulent, unlawful or grossly negligent act or omission by Uber, Third Party Transportation Providers, or Delivery Partners. You may be charged for the delivery fees and the reasonable costs associated with the return, redelivery or disposal of your Package using your payment method designated in your Account.
您應對與退還、重新運送或包裹處置之運費及相關之合理費用負責(包含您的包裹因為任何原因無法完成運送而退還於您之情形),但若前開退還、重新外送或處置是由優步、第三方運輸提供商或外送合作夥伴之任何欺詐、非法或嚴重過失行為或不作為所引起者,則不在此限。您可能透過您帳戶中指定之付款方式被收取因退還、重新運送或包裹處置相關之運費及合理費用。
2.6. Title/ 所有權
You acknowledge that neither Uber, Third Party Transportation Providers, nor any Delivery Partners take any title to Packages. You maintain title to the Packages at all times.
您瞭解優步、第三方運輸提供商及任何外送合作夥伴均不擁有包裹之任何所有權。 您始終擁有包裹之所有權。
2.7. Loss or Damage to Packages; Sending Food or Beverages; No Insurance/包裹遺失或損壞;食物或飲品之寄送;無保險
If your Package is lost or damaged in delivery progress, you may make a claim in accordance with the Courier Loss or Damage Policy(HERE) (a "Claim"). To make a Claim, you will need to provide Uber with certain information and proof as required under the Courier Loss or Damage Policy.
若您的包裹在運送過程受到遺失或損壞,您可以根據優快送遺失或損壞政策(按這裡)提出補償要求。若您要提出補償要求,您應依據優快送遺失或損壞政策提供優步相關資訊及證明文件。
You acknowledge and agree that where items have been lost or damaged as a result of any fraudulent, unlawful or negligent act or omission by Uber, Third Party Transportation Providers or Delivery Partners, Uber may provide you an appeasement amount equal to the replacement value of the items, up to a maximum total value of NT$5,000. For details regarding the claim process, required information, limit on claims, etc., please refer to the Courier Loss or Damage Policy (HERE).
您知悉並同意如果運送物品因優步、第三方運輸提供商或外送合作夥伴的任何欺詐、違法或疏忽行為而遺失或損壞,優步可能會提供等於物品價值的補償,最高補償總價值為 NT$5,000。其他有關申請流程、必須提供的資訊、申請限制等內容,請參優快送遺失或損壞政策(按這裡)。
Uber and Third Party Transportation Providers do not maintain insurance covering loss, damage or theft. You should contact an insurance agent or broker if insurance coverage is desired.
優步及第三方運輸提供商不會承保涵蓋遺失、損壞或竊盜之保險。若欲承保前開保險,您應聯絡保險代理人或保險經紀商。
If you use the Courier Delivery Services to send food or beverages or other items not otherwise prohibited by these Courier Terms, you assume full responsibility for such Packages after delivery, including any damage due to temperature sensitivity and/or tampering. You further assume full responsibility for chilling any perishables immediately upon delivery to help maintain the safety and quality of those items.
若您使用優快送外送服務寄送本優快送條款未禁止之食品或飲料或其他物品,於運送後您應就前開包裹承擔全部責任,包含因溫度敏感性和/或污染造成之任何損壞。於送達後,您應就立即冰鎮易腐爛物品負全部責任,以協助保持前開物品之安全和質量。
2.8. Charges and Cancellations for Courier Delivery Services/ 優快送外送服務費用及取消
The delivery fees for Courier Delivery Services are calculated and determined in accordance with the pricing structure and incidental charges published online by Uber (HERE). You agree that when using Courier Delivery Services, the delivery fees shall be calculated based on the published pricing structure and incidental charges.
優快送外送服務之運費,經優步於線上公告運費及雜費表(按這裡)核定計算之。您同意於使用優快送外送服務時,即應以公告之運費及雜費表計算運費。
You may elect to cancel your request for Courier Delivery Services from Third Party Transportation Providers at any time prior to Delivery Partners arriving at the pick-up address, in which case you may be charged a cancellation fee.
您得選擇在外送合作夥伴到達取貨地址前之任何時間取消您對第三方運輸提供商之優快送外送服務之請求,於此情況下,您可能需要支付一筆取消費。
If you would like to cancel your request for Courier Delivery Services after a Delivery Partner arrived at the pick-up address, you will be charged for the delivery fees and the Third Party Transportation Providers will not be able to issue you a refund.
若您在外送合作夥伴抵達取貨地址之後取消優快送外送服務之請求,您將被收取運費且第三方運輸提供商將無法提供您退款。
You acknowledge and agree that if you cancel the request for Courier Delivery Services, resulting in the need to return the Packages, you shall be responsible for the return delivery fees (i.e., the cost of returning the Packages). Except in cases of gross negligence, Uber, Third Party Transportation Providers, and Delivery Partners shall not be liable for any damage or loss of the Packages during the return process.
您瞭解並同意在您主動取消優快送外送服務之請求,致發生需運回包裹之需求時,您應支付回程(即將包裹運回)之運費;除因優步、第三方運輸提供商或外送合作夥伴之重大過失外,於運回途中發生之包裹損壞或遺失,優步、第三方運輸提供商及外送合作夥伴均不負相關責任。
2.9. Limitation of Liability/ 責任限制
Notwithstanding anything else in the Rides Terms and to the maximum extent permitted by law, in no event shall the total liability of Uber, Third Party Transportation Providers, and/ or Delivery Partners to you in connection with the Courier Delivery Services for all damages, losses and causes of action (whether in contract, in tort (including negligence), in equity, by operation of law or otherwise) exceed NTD5,000.
儘管Rides條款中有任何其他規定且在法律允許之最大範圍內,於任何情況下,就您與優快送外送服務有關之所有損害、損失和訴訟(無論是因契約法、侵權行為(包含過失)、衡平法、法律應用或其他方式),優步、第三方運輸提供商及/或外送合作夥伴之總責任不超過新台幣 5,000 元。
2.10. Payment/ 付款
You understand that use of the Courier Delivery Services will result in charges to you from Portier Taiwan for the delivery services you receive ("Charges"). Charges include applicable fees under Clause 2.8 and other applicable fees and taxes in Taiwan, including any tips to the Delivery Partner that you elect to pay. Applicable Charges paid by you are final and non-refundable, unless otherwise determined by Portier Taiwan or its Affiliate or required by the Taiwan Consumer Protection Act. All applicable Charges are due immediately and payment will be collected by Portier Taiwan or its Affiliate (as applicable) using the preferred payment method designated in your Account. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Portier Taiwan or its Affiliate(as applicable) may use a secondary payment method in your Account, if available. In some cases, you can alternatively make your payment in cash directly to the Delivery Partner at the time of delivery. You can select such cash payment option (if applicable) on the Uber App before you place your request.
您知悉使用優快送外送服務將使第三方運輸提供商就您所獲得之運輸服務向您收取費用(「費用」)。費用包含於第2條第8項約定適用之費用、其他適用之費用及台灣之稅賦,包含您選擇支付外送合作夥伴的任何小費。您所支付適用之費用為最終且不可退費,但優食台灣及其關聯企業另行決定或台灣消費者保護法另有規定時,不在此限。所有該費用應視為立即屆清償期,且優食台灣或其關聯企業(依適用之情形)將依您帳戶設定的優先付款方式,收取該筆費用。若您設定的優先付款方式被認定已到期、無效或發生其他問題致無法扣款,您同意優食台灣或其關聯企業(依適用之情形)得以您帳戶內設定的第二種付款方式進行扣款(如有適用)。有些情況,您可選擇在包裹送達時直接向外送合作夥伴支付現金。您可在提出請求前於Uber應用程式中選擇「現金」支付選項(如有適用)。
2.11. Government Uniform Invoices/ 政府統一發票
To the extent required under Taiwan tax laws, Portier Taiwan will provide you a Government Uniform Invoice with respect to the Charges under Clause 2.8.
於台灣稅法必要之範圍內,優食台灣將向您提供有關第2條第8項所定費用之政府統一發票。
