Commute Pass Terms and Conditions

These Commute pass Terms and Conditions (“Terms”) represent a binding agreement between you and Uber India Systems Private Limited, along with its subsidiaries and affiliates (“Uber,” “we,” “our,” or “us”), governing your use of the Commute pass program (“Commute pass”). These Terms are designed to be an addendum to the main Uber Terms of Service applicable under the SaaS model and apply specifically to the purchase of Commute Pass. By subscribing to or using Commute pass, you acknowledge that you understand and agree to these Terms as well as the main Uber Terms of Service, including any arbitration provisions contained therein. IF YOU DO NOT AGREE TO THESE TERMS OR THE UBER TERMS OF USE, DO NOT SUBSCRIBE TO OR USE Commute pass.

1. Nature of the Commute Pass

1.1. Technology Service Only: Uber does not itself provide transportation, carriage, taxi, motor vehicle, logistics, or passenger transport services. All transportation services requested through the Uber platform, including rides for which Commute Pass benefits are applied, are provided solely by i driver-partners directly to the rider. Uber is not a transportation service provider, common carrier, transport operator, taxi operator, employer, agent, partner, or principal of any driver-partner. Driver-partners are independent service providers and are not employees, workers, agents, or representatives of Uber. Each ride requested through the Uber platform constitutes a separate service arrangement between the rider and the driver-partner who accepts the ride request.

1.2. Nature of the Pass: The Commute Pass ("The Pass") is a subscription that allows the rider to obtain eligible rides during the specified Pass duration ("Pass Period") for a pre-defined route (the "Designated Route") within the applicable service area at a promotional fare regardless of the dynamic market pricing that might otherwise apply at the time of the request. This promotional fare is offered by Uber to the rider and the suggested price (“Suggested Price”) communicated to the driver through the platform continues to be the market price. Promotional fares may differ in each subscription period and apply only to eligible products i.e. UberGo/Moto.

The Pass is a platform-based promotional pricing feature offered by Uber in connection with eligible ride requests made through the Uber App. The Pass does not constitute the sale, resale, or pre-purchase of transportation services or any guaranteed ride inventory.

1.3 Pass Period: This Pass shall be valid for the period of one month or the period expressly specified in the Pass.

1.4 Ride Eligibility: To benefit from the Pass, pickup and drop-off locations must be within the designated coverage zones and requested during applicable time windows. Changes to the Designated Route, destination, or additional stops may disqualify the ride from the pass. Rides exceeding pre-set mileage limits may also be ineligible.

2. Best Effort and No Price Commitment

2.1. Best Effort Matching: Uber’s technology facilitates price discovery by connecting Riders with nearby drivers who may choose to accept trips at the Suggested Price. The completion of a ride under the Pass is strictly contingent on a Driver voluntarily accepting the Suggested Price. Drivers are independent contractors and retain full discretion to accept or reject any ride request and fare, including those made under the Pass.

2.2. No Guarantee of Immediate Match: The purchase of a Pass does not guarantee immediate ride availability or a specific waiting time.

2.3 Independent Determination: The Rider acknowledges that the final price for the transportation service is determined by the Driver-Partner's decision to accept or reject the trip offer. The promotional fare available to riders under the Commute Pass is funded and administered separately by Uber as a platform-level promotional incentive. Nothing in the Commute Pass program obligates any driver-partner to accept ride requests at any particular fare or through any particular pricing construct.

3. Usage Restrictions

3.1. Route Specificity: The Pass Price is valid only for the Designated Route selected at the time of purchase. Any deviations or changes to the destination may result in the trip being charged at the prevailing market price.

3.2. Applicability: This Pass is limited to "Applicable Products" and specific cities as defined in the Uber App at the time of purchase.

3.3. Savings Limits: Each subscription includes a maximum savings cap compared to market price. If your accrued savings reach this cap, promotional price for subsequent rides will be restricted. Savings details can be tracked in the account hub section of the Uber app.

3.4 Market Rates: If the market price is lower than promotional fare under the commute pass you’ll pay the actual market price for that ride.

3.5 Commute pass benefits cannot be combined with other promotions or discounts unless explicitly stated. The program may not be available in all regions or to all Uber users.

4. Subscription Management

4.1 Non-Refundable Policy: Once your first ride is taken using the Commute pass, the subscription becomes non-refundable.

4.2 Renewals and Cancellations: Your subscription does not renew automatically. Cancellation must be completed through the Uber app help section.

4.3 Multiple Subscriptions: Uber reserves the right to limit the number of Commute pass subscriptions per account.

5. No Transferability or Cash Value

Commute pass cannot be transferred, exchanged, or redeemed for cash.

6. Modifications and Termination

4.1. Modification Right: Uber reserves the right to modify, suspend, or terminate the Commute Pass program or these terms at any time without prior notice and at its sole discretion.

4.2. Modification by Rider: Once a Pass is purchased, it cannot be modified. If you want to change the route or time, you’ll need to cancel the Pass and then purchase a new one with the updated details. To cancel, please navigate to “Ride Passes” under the Account section of the app, choose the Pass you would like to cancel and simply click “Cancel Pass” and follow the prompts.
