On September 5, 2017, the Trump administration announced the rescission of the DACA (Deferred Action for Childhood Arrivals) program on March 5, 2018. According to the Department of Homeland Security (DHS), the agency will phase out the program over the next 6 months and will stop accepting new DACA applications after September 5th, but will continue to process pending cases and will accept some renewal applications for a limited period.
Uber is offering help to members of our driving and delivery community affected by the changes to the DACA program. Please see below for the support we’re pledging to you, as well as answers to some of your frequently asked questions.

Frequently Asked Questions (FAQs)*
Please see below for answers on how this policy change may affect you and your loved ones. These FAQs will be updated as the Department of Homeland Security issues new information.

Is my DACA and work permit still valid?
Your DACA and associated Employment Authorization Document (EAD) are valid until they expire unless terminated or revoked for a specific, different reason. The expiration date is noted on the I-797 Approval Notice and on the bottom of your EAD.
My DACA and EAD expire soon – can I renew them?
If your DACA and EAD expires between September 5, 2017 and March 5, 2018, you can file renewal applications, but the applications must be received by the government no later than October 5, 2017. In order to renew the application, you will need to submit Form I-821D, Consideration of Deferred Action for Childhood Arrivals and Form I-765, Application for Employment Authorization.
My DACA expires after March 5, 2018 – can I still submit a renewal application?
No, USCIS will not accept or process any renewal applications filed after September 5, 2017, if the DACA expiry is March 6, 2018 or later.
My DACA and EAD applications are currently pending – will they be processed?
If your case was received by USCIS or pending as of September 5, 2017, your DACA (and associated EAD) applications will be processed.
I don’t have DACA but am eligible based on the original program guidelines – can I still apply?
Unfortunately, USCIS will no longer accept any first-time applications after September 5, 2017.
I have an approved DACA EAD, but I have lost the card – what can I do?
If your still-valid EAD is lost, stolen, or destroyed, you can request a replacement EAD by filing a new Form I-765, Application for Employment Authorization.
Is my DACA-based Advance Parole Document still valid?
Yes, approved cases will not be rescinded. However, traveling on an existing advance parole may still be risky.
Can I still apply for advance parole to travel abroad? If my application is already pending, will it be processed?
Unfortunately, USCIS will no longer accept advance parole applications. USCIS will administratively close any pending applications and will return any fees you filed.
Will USCIS send current DACA holders’ information to the ICE?
USCIS stated that information provided in DACA requests will not be proactively provided to ICE and CBP for the purpose of immigration enforcement proceedings, unless the requestor meets the criteria for the issuance of a Notice To Appear or a referral to ICE under the criteria set forth in USCIS’ Notice to Appear guidance. This policy may be modified, superseded, or rescinded.
What will happen next?
The delay of six months is supposed to give Congress time to pass a new law that would provide some type of status as protection to current DACA holders. It is difficult to predict how a new law would work. Most importantly, it is very possible that Congress will not pass a new law before March 2018.
What are my other options?
Some DACA recipients may be eligible for other forms of immigration benefits. For example, some DACA recipients may be able to apply for a green card through marriage to a U.S. citizen, through an asylum claim, or other immigration benefits. However, many DACA recipients will not be eligible for other benefits.
What happens if I have no other options?
When your DACA status expires, if you do not have another immigration status, you will lose work authorization and you will lose protection from removal (“deportation”) based on being undocumented.
What about my social security number?
If you received a valid SSN, it remains a valid number even if you do not have work authorization. You can still use it for opening bank accounts and other uses.
