- The Rider Survey Prize Draw (the “Prize Draw“) is open to all riders aged 18 years or over, except employees of the Promoter, their families, agents or any third party directly associated with administration of the Prize Draw.
- The opening time and date for entries is 4pm on 25th June 2016, and the closing time and date of the Prize Draw is 9am on 25th July 2016 (the “Entry Period”) Entries received after this time will not be counted.
- To enter the Prize Draw you must complete and submit the rider survey in accordance with the instructions provided with the survey within the Entry Period. Only one entry per person is permitted.
- The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure.
- Five winners will be chosen by a random draw performed by a computer process on 1st August 2016 (“Draw Date“).
- The winners will receive each one of five prizes worth EGP 100 of Uber credit (the “Prize”). The winners will be notified by email before August 2 2016.
- The Prize will be added to the winners’ Uber account within 10 days of being notified of their win.
- The Prize for the winners is non-exchangeable, non-transferable and no cash alternative is offered.
- The Promoter reserves the right to replace the Prize with an alternative Prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
- The decision of the Promoter regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered into about it.
- Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the Prize to anyone in breach of these terms and conditions.
- The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
- Insofar as is permitted by law, the Promoter, their agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, their agents or distributors or that of their employees. Your statutory rights are not affected.
- The winners may be required to participate in publicity related to the Prize Draw which may include the publication of their name and photograph in any media.
- Personal data supplied during the course of the Prize Draw may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the Prize.
- Except where prohibited by law, participants agree that any dispute, conflict or controversy, howsoever arising out of or broadly in connection with or relating to the the Prize Draw or the Prize awarded shall be resolved individually, without resort to any form of class action, and shall be first mandatorily submitted to settlement proceedings under the International Chamber of Commerce Mediation Rules (ICC Mediation Rules). If the said dispute has not been settled within 60 (sixty) days after a request for Mediation has been submitted under the said ICC Mediation Rules, such dispute shall be exclusively and finally resolved by arbitration under the Rules of Arbitration of the International Chamber of Commerce (ICC Arbitration Rules). The ICC Rules’ Emergency Arbitrator provisions are excluded. The dispute shall be resolved by one arbitrator to be appointed in accordance with the ICC Rules. The place of arbitration shall be Amsterdam, The Netherlands. The language of the arbitration shall be English.
- All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or the rights and obligations of you and the Promoter or their affiliates in connection with the Prize Draw or the Prize (whether contractual or non-contractual), shall be governed by, and construed in accordance with the laws of Egypt
- The Promoter of this promotion is Uber B.V., of Vijzelstraat 68-78, 1017 HL Amsterdam, Netherlands.
١. إن الاشتراك في سحب الجوائز على استبيان الركاب (“سحب الجوائز”) متاح لكل الركاب الذين تتراوح أعمارهم بين 18 عامًا أو أكثر باستثناء موظفي الشركة أو أفراد عوائلهم، أو العملاء، أو أي طرف ثالث مرتبط مباشرة مع إدارة السحب على الجائزة.
٢. سيفتح المجال لكتابة الاستبيان في الساعة 4 مساءً يوم 25 يونيو 2016م وسيكون آخر وقت لتقديم الاستبيان هو 9 صباحًا يوم 25 يوليو 2016م (“فترة الإدخال”)، ولن يتم احتساب أي استبيانات تقدم بعد هذا الوقت.
٣. للدخول في السحب على الجائزة يجب أن تكمل استبيان الركاب وترسله بما يتوافق مع الارشادات المقدمة مع الاستبيان خلال فترة الإدخال. ويسمح بتقديم استبيان واحد فقط لكل شخص.
٤. لا تتحمل الشركة أي مسؤولية عن الاستبيانات التي لم يتم إكمالها بسبب أي خلل تقني، أو اختلال في التشغيل، أو أي عطل في أجهزة الحاسب أو برامجه، أو في الأقمار الصناعية، أو الشبكة، أو الخادم.
٥. سيتم اختيار خمسة فائزين من خلال سحب عشوائي يتم بعملية حاسوبية في يوم 1 أغسطس 2016 م (“تاريخ السحب”).
٦. سيستلم كل واحد من الفائزين واحدة من خمس جوائز قيمتها 100 جنيه مصري كرصيد في حساب أوبر (“الجائزة”). وسيتم إخطار الفائزين عبر رسالة بالبريد الإلكتروني قبل تاريخ 2 أغسطس 2016م.
٧. سيتم إضافة الجائزة إلى حساب الفائزين في أوبر في غضون 10 أيام بعد إخطارهم بالفوز.
٨. إن الجوائز المقدمة للفائزين غير قابلة للتبديل، أو التحويل، ولا يمكن استبدالها بمبلغ نقدي.
٩.تملك الشركة الحق باستبدال الجائزة بجائزة أخرى مساوية لها في القيمة أو أعلى منها إذا كانت هنالك ظروف خارج إرادة الشركة والتي تجعل من الضروري فعل ذلك.
١٠. إن القرار الذي تتخذه الشركة فيما يخص أي جانب من جوانب السحب على الجائزة هو قرار نهائي وملزم ولن يتم الدخول في أي مناقشات فيما يخص ذلك.
١١. سيعتبر كل المشاركين قد قبلوا ووافقوا الالتزام بهذه الشروط والأحكام عند تقديم الاستبيان. تملك الشركة الحق لرفض أي استبيان، أو رفض تقديم الجائزة لأي شخص يقوم بخرق هذه الشروط والأحكام.
١٢. يحق للشركة أن تبطل العرض الترويجي، أو تلغيه، أو تعلقه، أو تعدله إذا كان ذلك ضروريًا.
١٣. وبالقدر الذي يسمح به القانون فإن الشركة، وعملائها، والموزعون لن يكونوا – تحت أي ظرف – مسؤولون أو ضامنون قانونيًا لتعويض الفائز ولا يتحملوا أي مسؤولية لأي خسارة، أو ضرر، أو إصابات شخصية، أو وفاة تقع نتيجة لأخذ الجائزة إلا فيما ينجم عن إهمال الشركة أو عملائها أو الموزعون أو أي من موظفيها. ولن تتأثر حقوقكم القانونية.
١٤. قد يتطلب من الفائزين أن يشاركوا في إعلان متعلقة بالجائزة والذي قد يتضمن الإعلان عن أسمائهم وصورهم عبر وسائل الإعلام.
١٥. قد يتم تسليم المعلومات الشخصية التي يتم الحصول عليها خلال فترة السحب عبى الجائزة إلى طرف ثالث فيما يتعلق فقط بإتمام إجراءات الجائزة أو تسليمها، أو الترتيبات المتعلقة بها.
١٦. إذا لم يكن هنالك مانع قانوني فإن المشاركين يوافقون بأن أي نزاع أو اختلاف أو خصومة والتي تنشأ بسبب متعلق بالسحب على الجائزة أو الجائزة ذاتها التي سيتم تقديمها يجب أن يتم حله بشكل فردي دون الرجوع إلى أي نوع من أنواع الدعوى القضائية الجماعية ويجب أن يتم إرسالها أولًا وبشكل الزامي لإجراءات التسوية بمقتضى قوانين الوساطة لغرفة التجارة الدولية. إذا لم يتم تسوية النزاع المذكور في غضون 60 (ستون) يومًا بعد تقديم طلب وساطة لغرفة التجارة الدولية فإن هذا النزاع يجب أن يتم حله بشكل حصري ونهائي من قبل لجنة التحكيم بمقتضى قوانين الغرفة التجارة الدولية للتحكيم. ويستثنى من ذلك أحكام محكم الطوارئ لقوانين التجارة الدولية. ويجب حل النزاع من قبل حكم واحد يتم تعيينه بما يتوافق مع قوانين غرفة التجارة الدولية. يجب أن يكون مكان حل النزاع هو أمستردام، هولندا، ويجب أن تكون اللغة المستخدمة هي اللغة الإنجليزية.
١٧. كل القضايا والأسئلة المتعلقة بصيغة هذه الشروط والأحكام وسريانها، وبيانها، وإلزاميتها أو الحقوق والالتزامات المتعلقة بك وبالشركة أو فروعها فيما يتعلق بالسحب على الجائزة أو الجائزة (سواء كانت تعاقدية أو غير تعاقدية) يجب أن تحتكم للقانون المصري وتفسر بما يناسبه.
