- Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- The promoter is Uber Australia Pty Ltd (ABN 49 160 299 865) of Level 8, 1 O’Connell St, Sydney NSW 2000 (“Promoter”).
- Entry is only open to individuals ages 18 years or over who are members of the Australian Uber Rewards Program with Gold Status or higher, and have earned the 750 points required to claim a reward (“Eligible Entrants”). Entry into this promotion is subject at all times to the terms and conditions of the Uber Rewards Program which can be viewed at: https://www.uber.com/au/en/u/rewards/. For the sake of clarity, points must be earned in accordance with the Uber Rewards Program terms and conditions.
- Entries into the promotion open on 15/02/2021 and close at 02:59am AEDST on 15/08/2021 or once 300,000 entries are received, whichever occurs first (“Promotional Period”).
- To enter, Eligible Entrants must, during the Promotional Period, redeem 750 points to select a “Lucky Dip” prize on the Uber app. The Eligible Entrant will be awarded with an instant prize in accordance with clause 11 below.
- Only one (1) entry permitted per Eligible Entrant.
- The Promoter reserves the right, at any time, to verify the validity of Eligible Entrants and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- Eligible Entrants who select a Lucky Dip prize will be provided with a unique promotional code that will be displayed in the Uber Rewards hub, and the ability to apply the code to their account with one click from the prize screen. Each code will be for use in the Uber Eats app. A full list of available prizes is set out in clause 11. Eligible Entrants will be able to manually enter their promotional code into the ‘Promotions’ section of the Uber Eats app.
- Winners from ACT or any winners of prizes valued at over $250 will be published on t.uber.com/RewardsLuckyWin from 16/08/2021.
- The Promoter’s decision is final and no correspondence will be entered into.

2. Estimate based on $7.99 delivery fee per order
- Any ancillary costs associated with redeeming any prize (including any other fees applicable to the order) are not included. Any unused balance of a prize will not be awarded as cash. The promotional codes cannot be combined on one order, or used in conjunction with any other offer. Valid only in Australia where the Uber Eats app is available. Redemption of a prize is subject to any applicable terms and conditions of Uber Eats, as set out on https://www.ubereats.com/au.
- The 6 months of free delivery fee prizes are valid until 25/02/2022, so the promotional code must be applied within the Uber Eats app by 25/08/2021 for the full 6 month period to be honored. The free delivery fee promo code will only apply to orders placed with Uber Eats that have a total order value of $10 or more (excluding delivery and other fees). An amount equivalent to the delivery fee will be deducted from the total order value as a promotion each time.
- All other prizes are valid for 14 days after the promotional code has been applied. Codes are valid until 08/09/2021, so the promotional codes must be applied by 25/08/2021 for the full 14 day redemption window to be honoured.
- If for any reason an Eligible Entrant does not redeem a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
- If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
- Total prize pool value is up to $7,850,625.00. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- A draw for any prizes valued at over $50 that are won, but unclaimed, may take place on 15/11/2021 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and their names will be published on t.uber.com/RewardsLuckyWin from 15/11/2021.
- Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used.
- Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Entrant; or (f) use of a prize.
- The Promoter will use and handle any personal information (“PI”) as set out in its Privacy Policy, which can be viewed at https://www.uber.com/au/en/. The Privacy Policy also contains information about how Eligible Entrants may opt out, access, update or correct their PI, how Eligible Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI to entities outside of Australia in accordance with the Privacy Policy.
