The following terms (“Giveaway Terms”) apply to the Payment Method Survey contest giveaway (”Giveaway“).

Uber is a global mobility and logistics platform, which connects riders who desire to request a ride via Uber mobile application and partner-drivers available in the area. Purpose of the Giveaway is to attract more users, maintain and increase interest of general public to the Uber platform.

The Giveaway is organised and sponsored by Uber B.V., a private limited liability company incorporated under the laws of the Netherlands (registration number 56317441), whose registered address is Vijzelstraat 68, 1017 HL Amsterdam, the Netherlands (“Uber” or “Sponsor”).

In order to enter the Giveaway, you must agree to the Giveaway Terms. Therefore, please read these Giveaway Terms prior to entry to ensure you understand and agree. You agree that submission of an entry in the Giveaway constitutes agreement to these Giveaway Terms. You may not submit an entry to the Giveaway and are not eligible to receive the prizes described in these Giveaway Terms unless you agree to these Giveaway Terms. These Giveaway Terms form a binding legal agreement between you and Uber with respect to the Giveaway.

Eligibility: To be eligible to enter the Giveaway, a Participant must: (a) be a citizen of Switzerland or a legal Swiss resident; and (b) be at least eighteen (18) years old (the age of majority in Switzerland); (c) have an Uber account, i.e. must have downloaded the Uber mobile app, installed it into the smartphone and accepted the terms of use. By entering the Giveaway, you warrant that you satisfy these eligibility requirements. We may require the winner to provide proof of identity and proof of age. Identification considered suitable for verification is at our discretion.

Employees, interns, contractors, and official office-holders of Uber, and its parent company, subsidiaries, affiliates, and their respective directors, officers, employees, advertising and promotion agencies, representatives, and agents (“Giveaway Entities”), and members of the Giveaway Entities’ and their immediate families (parents, siblings, children, spouses, and life partners of each, regardless of where they live) and members of the households (whether related or not) of such employees, officers and directors are ineligible to participate in this Giveaway.

Uber reserves the right to disqualify any participant from the Giveaway if, in Uber’s sole discretion, it reasonably believes that the participant has attempted to undermine the legitimate operation of the Giveaway by cheating, deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other participants or Uber.

Giveaway Timeline: The Giveaway begins on 22nd of February 2017 8:00am Central European Time Zone and ends on 23rd of February 2017 23:00pm Central European Time Zone. Winners will be selected by Uber on the 24th of February 2017 (the “Winner Selection Timeline”). The winner will be contacted and provided with all information about how to redeem prizes through their personal emails not later than 25th of February 2017 (the “End of Notification Period”). All prizes can be redeemed by the winners till the end of the year 2017.

How to enter

In order to enter the Giveaway all the actions described below must be performed within the Giveaway Timeline:

Those who performed all the actions described above and comply with eligibility requirements are considered to have submitted an entry to the Giveaway and become Participants of the Giveaway.

Uber is entitled to suspend an entry into the Giveaway for any person which does not comply with the eligibility requirements specified above in the present Giveaway Terms.

How the winners are selected

In order to select the winners of the Giveaway Uber within the Winner Selection Timeline collects and analyses information about all Participants and randomly selects the Winners among all Participants in the Giveaway Area.

Results of selection of winners of the Giveaway will be fixed in the protocol which will be drafted and signed by Uber. The winners will be contacted and provided with all information about how to redeem prizes through their personal emails not later than the End of Notification Period.

Prizes

The prizes will be provided to the winners directly by Uber. One prize per winner.

EACH PRIZE IS NON-TRANSFERABLE AND CANNOT BE EXCHANGED FOR CASH.

Uber is fully entitled to refuse to give out a prize in case it reveals violation or non-compliance with the present Giveaway Terms.

Uber is entitled to decide what to do with unredeemed prizes at its own discretion.

Taxes

The winner must fully understand that if s/he redeems and receives a prize, s/he is obliged to comply with tax legislation of Switzerland and pay the income tax.

Uber will inform the winner about the value of the natural prize in order for winner to be able to calculate and pay the income tax.

Uber has no obligations to safeguard that the winners of the Giveaway adhere to their obligation to pay any taxes.

Privacy

Participants agree and acknowledge that personal data submitted with an entry, including name, mailing address, phone number, and email address may be collected, processed, stored and otherwise used by Uber and its affiliates and transferred to partners of Uber which provide prizes for the Giveaway for the purposes of conducting and administering the Giveaway, which could include a transfer to a country with less strict data protection laws than the one you reside in, depending on the prize. Individuals submitting personal information in connection with the Giveaway have the right to request access, review, rectification or deletion of any personal data held by Uber in connection with the Giveaway by writing to Uber at the following address: Vijzelstraat 68, 1017 HL, Amsterdam, The Netherlands, attn: Privacy.

Publicity (Media Release)

By entering the Giveaway, you agree to participate in any media or promotional activity resulting from the Giveaway as reasonably requested by Uber at Uber’s expense.

By entering the Giveaway, you irrevocably grant to Uber, its employees, agents, licensees, successors, assigns, and those acting with their permission or authority the irrevocable and unrestricted right to record, reproduce, adapt, edit, modify, summarise, publish, exhibit, distribute, broadcast, display, perform, use and otherwise exploit by any and all means and for any and all uses, and by and in any and all media, now known or hereafter devised, throughout the universe, in perpetuity, in any manner, format or context whatsoever, your appearance, image, name, likeness and/or voice, including your performance for or interview with Uber, and including any sound recordings and/or audio-visual recordings of me, as well as any information, ideas and other materials that you provide to Uber in connection therewith, that are obtained or collected by Uber for the purposes of conducting and administering the Giveaway.

Warranties and Indemnities

To the maximum extent permitted by law, Participant indemnifies and agrees to keep indemnified Uber at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the Participant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, Participant agrees to defend, indemnify and hold harmless Uber from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from: (i) any misrepresentation made by Entrant in connection with the Giveaway; (ii) any non-compliance or improper understanding by Participant of these Giveaway Terms; (iii) acceptance, possession, misuse or use of any prize.
