Delivery Pick Up Terms - Pick Up Addendum

You as a Merchant have already entered into an Uber Eats Services Agreement (“Agreement”) with Uber Eats Poland sp. z o.o. and Uber Portier B.V. (collectively “Uber”). This Addendum is governed by that Agreement and will allow your Customers using the Uber Eats App - as of the date of your acceptance - to collect Items requested from your specified location without the involvement of a Delivery Partner ("Non-Delivery Method").

By clicking “I accept the Terms and Conditions”, you agree to be bound by the terms in this Addendum.

This Addendum governs the general availability of Items provided to your customers through the Uber Eats App via the Non-Delivery Method (“Non-Delivery Items”).

1. Service Fee

In consideration for the Uber Eats Services in connection with the Non-Delivery Method, Uber Eats Poland will charge Merchant a Non-Delivery Service Fee of 14% (or lower than that, if Uber sends you such notice) for each Non-Delivery Item sold by Merchant via the Uber Eats App. Uber Eats Poland will calculate the Non-Delivery Service Fee as follows: the Retail Price of the Item(s) sold by Merchant via the Uber Eats App (including any VAT or other sales tax) (such amount, the "Non-Delivery Item Payment") multiplied by the Non-Delivery Service Fee percentage. The Non-Delivery Service Fee shall be increased by VAT.

2. Delivery Services

Non-Delivery Items do not require the involvement of a Delivery Partner. As such, for Non-Delivery Items, no delivery services are provided, so there is no Delivery Fee or Delivery Charge.

3. Revenue Transfer

Uber and/or its Affiliates will transfer to Merchant the total Non-Delivery Item Payment (including any VAT or other sales tax collected on Merchant’s behalf) earned by Merchant, less the Non-Delivery Service Fee and any refunds given on behalf of Merchant to Customers (such final transferred amount being the "Non-Delivery Item Revenue"). The Non-Delivery Item Revenue will be transferred on at least a bi-weekly basis.
