Division of responsibilities between Uber and third parties - Uber app and website giving access to transportation services

Uber BV provides a technology platform that allows users of the Uber app and website to order transportation services provided by Transportation Service Providers. Uber BV does not provide, buy or resell transportation services.

Uber Polska sp. z o.o. is a licensed intermediary for the transportation of people in passenger cars in Poland. This means that Uber Polska sp. z o.o. transmits passenger transportation orders from the user to Transportation Providers and enables the user to conclude transportation contracts with Transportation Providers or to settle the passenger transportation fee.

By ordering a ride through the Uber app or website, you agree to enter directly into a transportation contract with a Transportation Provider, to which Uber is not a party. Transportation services are provided directly by Transportation Providers.

Transportation service providers offering their services through the Uber app and website are independent entrepreneurs bound by contract with Uber. They may provide transportation services personally or engage drivers to provide such services on their behalf and for their account. In order to register on the Uber app and website to provide transportation services (if Uber’s services are available in a particular city or area), Transportation Providers must meet the legal requirements for access to practice their profession (for example, hold a cab license to provide transportation services in vehicles with up to seven seats). In accordance with Uber’s obligations under the law, Uber will verify certain documents and information provided by Transportation Providers before allowing Transportation Providers (or their drivers) to access the Uber app and website.

Uber collects and processes digital payments on behalf of and for the Transportation Provider. Uber provides these payment services to the Transportation Provider and thereby enables the Transportation Provider to receive payments as part of its contractual relationship with you.

Uber provides customer support for responding to questions or requests regarding transportation services ordered through the Uber app or website. Regardless of whether this customer support is available, the contract for transportation services is made directly between the Transportation Provider and the user. Accordingly, any disputes regarding transportation services will be resolved directly between you and the Transportation Provider.
