Terms and Conditions

1. Offer Period. The Offer (defined in clause 2 below) is available from 10:00 to 16:00 local time in each Eligible City (defined in clause 3 below) on Saturday, 19 October 2024 ('Offer Period'). Uber reserves the right to void, cancel, suspend or amend the Offer at any time.
2. Offer. Eligible Users (defined in clause 3 below) will be able to book one $0 Uber Package trip during the Offer Period to have the Eligible Items (defined in clause 4 below) they wish to donate delivered to the Red Cross ('Offer'). A maximum of one Uber Package trip applies per Eligible User. To apply the Offer, Eligible Users must open their Uber app during the Offer Period, click on the banner in the Uber app relating to the Offer, which will direct them to a pre-selected Red Cross Clothing Drive location. Alternatively, Eligible Users can select the 'Package' option, click 'Send a package', enter 'Red Cross Shop' as the destination, and select the first 'Red Cross Shop' location shown. For avoidance of doubt, only packages that contain Eligible Items (as defined in clause 4 below) sent via the Red Cross Clothing Drive product will be eligible for $0 Uber Package trip. Any trips that are requested by you that do not meet all these requirements may be investigated and Uber reserves the right to withhold or deduct credits or other features or benefits obtained through the fraudulent use of the Offer by you in the event that Uber reasonably determines or believes that the use or redemption of the Offer was in error, fraudulent, illegal or in violation of the Offer.
3. Eligible Users. 'Eligible Users' are users of the Uber app in Sydney, Melbourne, Brisbane, Adelaide, Perth, Auckland, Wellington or Christchurch (each an 'Eligible City'). Eligible Users will see a $0 amount payable when they book an Uber Package delivery during the Offer Period via the promotional banner, or directly through Uber Package product with the drop-off location set to one of the Red Cross Shop locations.
4. Eligible Items. 'Eligible Items' are donated clothing and accessories that meet the requirements set out in this clause and are in package(s): (i) not greater than 20 kilograms; and (ii) that fit comfortably in the boot of a mid-size motor vehicle. Prohibited items, including alcohol, medication, recreational drugs, and dangerous or illegal items, must not be sent. Violations may be reported to authorities. For this event Red Cross will accept quality, sellable clothing and accessories. Red Cross will not accept homewares, underwear, or worn out or dirty clothing. Ordinarily, eligible packages for Uber Package deliveries must not have a total value greater than $100, however that limit does not apply for this Offer.
5. Availability. Successful redemption of the Offer is subject to the availability of eligible delivery persons. This means that you will not be able to participate in the Offer if there are no delivery persons available to accept your Uber Package request.
6. Acceptance of terms. You are deemed to have accepted and agreed to be bound by these terms and conditions by participating in the Offer. Your use of Uber Package is subject to Uber’s General Terms of Use (available here). Uber reserves the right to refuse or terminate your participation in the Offer if you are in breach of these terms and conditions or the General Terms of Use.
7. Liability. To the fullest extent permitted by law, Uber, Red Cross and their respective affiliates will not, in any circumstances be responsible or liable to compensate you, accept any liability to you (whether direct, indirect, special, incidental, exemplary, punitive or consequential) for any loss, damage, personal injury or death arising out of or in connection with your participation in the Offer whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not we (or our affiliates) have been advised of the possibility of such loss, damage, personal injury or death. Your statutory rights are not affected. Any liability of ours arising in connection with the Offer shall be several and we accept no joint and several liability in connection with the Offer. Once an item has been picked up for donation, it cannot be reclaimed.
8. Governing law. These terms and conditions shall be governed by the laws of New South Wales, Australia (for Australian participants) and the laws of New Zealand (for New Zealand participants). You agree that the courts of the applicable jurisdiction will have non-exclusive jurisdiction to determine any matters arising out of these terms and conditions.
