Terms and Conditions of the Program called “Star Service Fee”
These Terms and Conditions regulate the special program called ” Star Service Fee ” (hereinafter “Program”) establishing the Requirements for eligible Drivers Partners (hereinafter the “Participants”) who are active in the application for Driver Partners of Uber (the “UberDriver App”) in the Territory named below, may participate and subsequently have access to the Program consisting of a Service Fee (as defined in Section 4.4 of the Terms and Conditions of Use of the UberDriver App) subject to a discount for a limited time (the “Promotion”).
By participating in order to be eligible for the Program and the Promotion it is understood that the Participants have read, understood and accepted these Terms and Conditions.
- Program description
The Program consists of the Participants who comply with the necessary requirements established in these Terms and Conditions and who receive an invitation email, can access through the UberDriver App to a Promotion with a discount for a limited time, in accordance with what is established later.
- Participants of the Program
This Program will be available only to all the Driving Partners of the UberDriver App who:
- Have received the invitation e-mail to participate and complete the first trip once the validity of the Program has begun.
- Comply with the Requirements in section IV within the Term, as well as these Terms and Conditions
III. Validity, limits and restrictions of the Program
- The Validity of the Program will begin on October 8, 2018 and end on January 8, 2019.
- Access to the Promotions may be concluded in a different time and manner for each Participant who accesses the Program in accordance with the following assumptions:

- The Participant has not completed any of the requirements to access the Program.
- The Participant is no longer active in the UberDriver App;
- The Participant did not receive an invitation email;
- The Participant was deactivated from the UberDriver App; I
- The Organizer decided to suspend or cancel the Promotion, as detailed in section VII of these Terms and Conditions.
- Promotion limited exclusively to Participants who comply with and maintain during the term the conditions indicated in these Terms and Conditions.
- Promotion not cumulative, that is, the Participants will not be able to access simultaneously at two levels.
- Program Requirements (hereinafter the “requirements”):

- Program calendars.
Participants may access these levels provided they have complied with the requirements established in Section IV, as follows:
- The Participant must comply with or maintain the requirements of the Program at the cutting of each month in progress, for purposes of clarity by cut of month means the last calendar day of the current month.
- If the Participant does not meet or maintain the minimum requirements to access the Promotion, he will no longer have access and will not be able to access the benefit until the next month’s cut. Each month cut will evaluate the metrics of 3 months and 5 days before.
The Participants will be creditors of the Promotion only by complying with all the requirements of each level and receive the invitation email to the program and it will be valid until the end of the month in which the Promotion was fulfilled. If the requirements of the level are not met in the following month, the Participant will lose the level of which he was creditor the previous month.
- Description of the Promotion by Level
Participants who meet the requirements for each level established in the table above may be creditors at any of the following levels:
- Gold Level: Service rate of 15% on all completed trips. The validity of the level will begin once the Participant complies with the requirements to access it and will remain in force during the month in which the Participant met those requirements.
- Silver Level: Service Rate of 20% on all completed trips The validity of the level will begin once the Participant meets the requirements of the level and will remain in effect during the month in which the Participant met those requirements.
Uber reserves the right to disqualify and / or reserve access to the Promotion to Participants and / or Winners who have not complied with these Terms and Conditions, as well as the Terms and Conditions of use of the UberDriver App and / or The Uber App. The Promotion is subject to availability, decision and / or changes that may be presented by the Organizer. Therefore, the Participants and the Winners acknowledge that the Promotion described above is not and will not be subject to exchange.
The Participants acknowledge and accept that the level they could access by virtue of their participation in the Program may not be subject to subsequent resale and commercialization of any kind, either directly or indirectly. Likewise, they acknowledge and accept that the delivery of the Promotion is subject to availability, decision and / or changes that may be presented by the Organizer.
Under no circumstances may the Organizer be forced to deliver more than those offered in the advertising and Terms and Conditions of this Promotion. If for any reason the Organizer is unable to deliver any of the Winners and / or Participants, it is possible to waive the delivery of that level, in the event that for reasons beyond the reach of the Organizer the level should be suspended, or that doing so constitutes an unacceptable risk to the physical integrity and / or safety of the Participant and / or Winner.
- Geographical Coverage of the Promotion
The present Promotion will be valid and will have effects only in Mexico City, MX (“Territory”).
VII. Miscellaneous
- These terms and conditions may be modified, canceled and suspended at any time by the Organizer, which will be disseminated through the same means in which they were originally disseminated, including, if necessary, clarifications or modifications that do not alter the spirit of the promotion. Any situation related to the interpretation of these terms and conditions will be settled by the Organizer.
- The Organizer reserves the right, without any responsibility, to invalidate or reject Participants who, in their sole discretion, do not comply with the requirements set forth in these terms and conditions and / or violate the rights of third parties and / or not. they adhere to the applicable legislation. Likewise, the Organizer reserves the right to justifiably eliminate the participation of any Participant that defrauds, alters and / or invalidates the proper functioning and normal and regulatory course of this Promotion. Any abusive or fraudulent use of these terms and conditions will result in the cancellation of the participation of the Participant in the Promotion.
- The Organizer is not responsible for the interruption or disqualification in the connection service to the network and to the server (host) of the site or websites related to the Promotion. The Organizer, without any responsibility, reserves the right to cancel or modify the Promotion, due to any crime, breach or technical failures that could destroy or affect the integrity of it; or if an electronic virus or any other technical problem interferes or harms the administration, security or proper functioning of the Promotion, as technically determined by the Organizer.
