Official Rules

The Activity “Uber-Mastercard International Champions Cup” will be governed by the following terms and conditions. By the mere fact of participating in the Activity, the participants accept all the terms and conditions of this Regulation unconditionally, including those clauses that limit the responsibility of the Organizers. They also agree to submit to the decisions of the Organizers in any matter related to the Activity.

Uber B.V. domiciled in Vijzelstraat 68-78, 1017 HL Ámsterdam, Netherlands (“Uber”) will be in charge of the organization of the activity through its mobile application.

MasterCard International Incorporated domiciled in 801 Brickell Avenue, Suite 1200, Miami, Florida 33131 (“Master Card”) will be responsible for everything related to the acquisition, organization and delivery of the gift (s) (travel packages) to the participants likely to receive them.

None of the social networks that could be used in this Activity, namely, Facebook, Twitter and/or Instagram participate, endorse or administer this Activity in any way, nor are associated with it and have no responsibility related to the management and administration of the Activity. The participant is aware that is providing his information to the Organizer and not to any of these social networks.

Description of the Activity, eligibility/form of participation:

From May 30, 2017 until June 19, 2017 (activity period) in the Uber Application (the “Application”) will be available a special screen. Users eligible to participate (as detailed below) in the activity that make more rides during the period of the Activity and pay using their MasterCard, will receive as a gift a travel package to see the encounter between Real Madrid vs. Barcelona in Miami Florida on July 29, 2017, according to the characteristics detailed below:

Travel Package Gift description:

In total there are 1 package in the Territory.

The gift does not include the personal expenses incurred by the winners to implement their gift, nor any other item that is not expressly included in this Regulation. The cost of any documentation that must be done by the winners to be able to withdraw or enjoy the gift, is at the expense of each one of them. Winners must have the necessary documentation to be able to travel, including but not limited to visas and passports, the processing of these documents will be responsability of the winners of the gifts. In order to receive the gift, the participant must show the necessary documentation to the organizers: valid passport and visa for the United States, both with a validity of at least 6 months from the date of travel.

Each winner must comply with applicable law and instructions received from the Organizer or those who participate in the provision of any portion of the gift. It must also behave respectfully with the staff of any of the companies involved in the enjoyment of the gift. Failure to comply with this obligation may lead to the withdrawal of the gift and the collection of damages caused.

The gift is indivisible and non-negotiable. To be eligible for a gift, the participants must comply with all the requirements established in this Regulation.

No family nucleus of participants, understanding as such ascendants and descendants of first degree, can win more than one gift in this Activity. Likewise, the gift cannot be used illegally or against decency or that in any way, denigrate or discredit the brand of the Organizer.

Under no circumstances may the Organizers be forced to deliver more gifts than those offered in the advertising and Regulation of this Activity. If for some reason the Organizer is not able to deliver any of the gifts to the winners, it is possible to dispense from the delivery of the gift, in the event that for reasons beyond the reach of the Organizers, the gift must be suspended or that delivering it, constitutes an unacceptable risk to the physical integrity and/or safety of the participant.

The following persons may not participate in the activity: a. Employees, executives and officials of the Organizers; b. Employees, executives and officials of the advertising agencies and other suppliers involved in this Activity; c. Officials of any of the companies co-sponsors of this Activity that, because of their position, may in some way influence the development of the same or the allocation of the prizes; and d. Relatives to the second degree of consanguinity or affinity of all the aforementioned.

Territory: This Activity will be valid and will take effect only within the city of Port of Spain, Trinidad and Tobago.

Participant Information: The Organizers will consider as participants of the Activity those who request the rides that correspond in the special screen and use as a form of Payment their Master Card, fulfilling the requirement of majority of age at all times. In every moment, participants shall provide truthful and accurate information and ensure that the data they provide is sufficient to be located. The Organizer will rely on such information for all purposes of the Activity.

Any inaccuracy that impedes identifying or locating the participant will imply their disqualification, in which case the gift will become available to the next participant with the highest level of rides. The same consequence will be applicable to the fact of providing false or inaccurate information. Any communication related to the Activity will be made according to the information provided. By including data, the participant manifests and guarantees that has sufficient authorization to participate in a personal capacity.

Any dispute of the participant with third parties as to the ownership of the gifts in no moment will be responsability of the Organizer, regardless of the origin or cause of the acquisition of the product, or any other aspect related to that or any other transaction in which the Participant is involved.

Image rights: The participation in the Activity will imply the consent of the participants that their name, voice and image may be used in television programs, publications and other advertising media, and in general in all dissemination material that the Organizers wish to do in relation to the Activity, either during the promotional term or after the expiration thereof, without remuneration, for an indefinite period. Likewise, the fact of participating in the Activity will involve the consent of the participants that the delivery of the gift can be announced live and the conversations that may take place for the delivery of the gift can be transmitted by radio. This authorization does not imply any obligation to compensate the participant. Additionally, as stated, potential winners and their accompanying persons must sign an express authorization for the use of these image rights as a condition for the gift to be delivered.

In addition, each winner of this Activity must expressly authorize the Organizer so that their image can be transmitted in videos, photographs and personal interviews, on the gift, as well as on the website of the Activity, and in any other means of communication that the Organizer chooses to make the public aware about the experiences of the winners and their companions, if this is the case. This authorization shall not imply any obligation to compensate the participant or their companions.

Responsibility of the Organizer: Uber is responsible for determining the participant(s) who made the largest number of rides and must pay the gift package and make contact with them, not later than 23 June 2017 to make them know that they are entitled to the gift, in the other hand, MasterCard is responsible for the acquisition, organization and delivery of the gifts indicated in this Regulations. Each participant shall also be liable for the use and enjoyment of the gift. By registering participants release the Organizers, co-sponsors, Affiliated Companies, and others involved in this Activity, as well as their executives, employees, representatives or agents from liability for any damages that arise directly or indirectly as a result of their participation in the Activity, or that results directly or indirectly from their acceptance, withdrawal or possession of the gift, or from the fact that their identity is made public by the fact of having participated and/or gained in the Activity.

Notwithstanding the above, the Organizer’s responsibility is expressly released for: a) Expenses incurred to participate in the Activity, to make the gift effective or to enjoy it; b) Unauthorized human interventions by third parties to computer systems or anything similar that could alter the development of the Activity; c) Damages suffered to the integrity or property of the participants or of third parties that are caused by this Activity or during the enjoyment of the gift.

Modification and Suspension of the Activity: The Organizers reserves the right to modify the terms and conditions of this Regulation, as well as, suspend the Activity temporarily or definitively in case of verification of the existence of fraudulent assignment or claim of gifts, as well as in cases of technical failures, or any other event beyond the reasonable control of the Organizers. The alteration of documents and information about the participants, as well as the deception, fraud or falsification, unauthorized manipulation that hinder the normal performance of the Activity and the actions that in the opinion of the Organizers are illegal and may cause damage to the Activity or its Organizers may be prosecuted by the means provided by law.

Likewise, the Organizer is not responsible for the interruption or disabling in the service of connection to the network and the server (host) of the site or websites related to the Activity. The Organizer, without any responsibility, reserves the right to cancel or modify the Activity, due to any crime, breach or technical failure that may destroy or affect the integrity of the aforementioned, or if an electronic virus or any other technical problem interferes or damages the administration, security or correct operation of the Activity, as determined technically and jointly by the Organizer. In case of cancellation or modification of this Activity, the corresponding notice will be disseminated through the means by which the Activity was announced.

Relationship between the parties: No provision of this Activity shall be construed as creator of a relationship between the parties. No participant of the Activity, for being one, acquires the status of employee, representative, or agent of the Organizing Company. With the fulfillment of the obligations established in this Regulation, the relationship between the parties shall be completely terminated.

Identity of the winner: At the end of the Activity, the names, ID number or identity data of the winner will be available to be consulted by any interested party.

Simplified Privacy Notice: The responsible entity will always be Uber BV, domiciled at Vijzelstraat 68-78, 1017 HL Amsterdam, The Netherlands, for purposes solely and exclusively related to the processing and protection of the personal data of the participants and will be treated for the sole purpose of registering their participation in the Activity, contacting the winners to coordinate the delivery of the gifts and for purposes of dissemination, Activity and marketing.
