ACTIVITY “UBER – REDBULL 2018”

Terms and Conditions

The Activity “UBER – REDBULL 2018” will be governed by the following Terms and Conditions. By the mere fact of participating in the Activity, participants accept these Terms and Conditions unconditionally, including those clauses that limit the responsibility of the Organizers. Likewise, they agree to submit to the decisions of the Organizers in any matter related to the Activity.

The granting of any of the gifts will be conditioned to compliance with each and every one of the applicable laws and regulations, as well as the provisions of these Terms and Conditions. The Organizer (s) reserves the right to disqualify and / or demand the return of gifts granted to those participants who directly or indirectly fail to comply with the rules and conditions set forth herein.
1. Eligibility to participate: With the exceptions that will be said, all those over 18 years of age who are members of the transport community of the organizer, have the application of Uber and be one of the first to apply will be able to participate in this activity. users to request a trip in the special view called “UberRedBull” that will appear in the Uber Application. All of the foregoing in the terms specified in these Terms and Conditions.
Those interested in participating must have at the time of participating a valid identification document recognized by the Government of Trinidad & Tobago.

The following people can not participate: a. Employees, executives and officials of the Organizing Company; b. Employees, executives and officials of the advertising agencies and other suppliers involved in this Activity; c. Officials of any of the Companies co-sponsoring this Activity that, by reason of their position, may in some way influence the development of the Activity or the allocation of the gifts; and d. The relatives up to second degree by consanguinity or affinity of all the previous ones.
1. Organizers: Uber B.V. and A.S Brydens & Sons Ltd. are the Organizers of the Activity and the only ones responsible for it before any third party.
None of the social networks that could be used in this Activity, namely, Facebook, Twitter and / or Instagram, participate in, endorse or administer this Activity in any way, nor are they associated with it and have no responsibility related to the handling and Administration of the Activity. The participant is aware that he is providing his information to the Organizer and not to any of these social networks.
1. Deadlines: This activity will be governed by the following deadlines, which are peremptory:
Deadline to participate: The deadline for participation is limited, starting on February 14, 2018 at 12:00pm (Trinidad & Tobago Time) and ending on the same day at 4:00 pm or while supplies last.
1. How to participate: Uber B.V. and Helados Bon S.A. offer their users the possibility to order (1) a Red Bull unit called UberRedBull. Whoever wishes to participate in this activity must, within the term of the activity, access the Uber application, be one of the users to request a trip in the special view called “UberRedBull”. To be able to receive as a gift a Red Bull unit “Red Bull” (UberRedBull) courtesy of A.S Brydens & Sons Ltd. The gift will be included with the cost of the trip for the User.
If the participant is a creditor of UberRedBull, he will receive a confirmation through the Uber application. There will be a total of 504 units of UberRedBull that will be distributed among users of the Uber application who request it.
1. Territory: This Activity will be valid and will take effect only within the Metropolitan Area of Trinidad and Tobago.
1. Participant information: The Organizers will consider the person who requested the trip in the special hearing as a participant in the Activity. At all times, participants will be required to provide truthful and accurate information and ensure that the information they provide is sufficient to be located. The Organizer will rely on said information for all purposes of the Activity.
Any inaccuracy that prevents identifying or locating the participant will imply disqualification. The same consequence will be the fact of providing false or inaccurate information. Any communication related to the Activity will be made according to the consigned data. By including your data, the participant declares and guarantees that he has sufficient authorization to participate in a personal capacity and enjoy the gift.

Any dispute of the participant with third parties regarding the ownership of the gift will be a matter unrelated to the Organizers, regardless of the origin or cause of the acquisition of El Helado, or any other aspect related to that or any other transaction in which the participant is involved.
1. The Organizer will not cover the expenses incurred by the participant to make his gift effective or for the enjoyment of it. The participant, upon receiving his gift, expresses his agreement and exempts the Organizers from any responsibility. Once the gift of compliance has been received, the Organizers will not be liable for any damage, loss or impairment suffered by the Organizer for reasons that are not attributable to the Organizer. The gift must be consumed immediately, the organizers will not be responsible for any damage that may be caused by mishandling the gift.
Each participant must comply with the laws of Trinidad & Tobago and with the instructions received by the Organizer or those who participate in the provision of any portion of the gift. Under no circumstances may the Organizers be forced to deliver more gifts than those offered in the advertising and Terms and Conditions of this Activity.

In the event that for reasons beyond the scope of the Organizers any portion of the gift must be suspended, or that doing so constitutes an unacceptable risk to the physical integrity and / or safety of the participant, the Organizer will have the option, not the obligation to exchange the gift for another of equivalent cost.
1. Image rights: The fact of participating in the Activity will imply the consent of the participants to have their name, voice and image used in television programs, publications and other advertising media, and in general in all material for dissemination purposes. Promotions that the Organizers wish to make in relation to the Activity, either during the promotional period or once it has expired. Also, the fact of participating in the Activity will imply the consent of the participants to the delivery of the gift is made on air can be transmitted by radio conversations that are made in the delivery of the gift. This authorization does not imply any duty to remunerate or compensate the participant. Additionally, as stated, participants and their companions must sign an express authorization for the use of these image rights as a condition for the gift to be delivered.
1. Responsibility of the Organizer: The Organizer is responsible only for the delivery of the gift indicated in this Regulation and for its application. Participants who receive the gift will be responsible for the use and enjoyment that they give to it. By registering, participants release responsibility from the Organizers, co-sponsors, affiliated companies, and others involved in this Activity, as well as their executives, employees, representatives or agents for any damage arising directly or indirectly as a result of their participation in the Activity, or that results directly or indirectly from their acceptance, withdrawal or possession of the gift, or from the fact that their identity is made public by the fact of having participated and / or won in the Activity.
Uber B.V. is released from any responsibility related to quality and compliance with applicable sanitary regulations regarding the food that will be delivered to each Participant. On the other hand, A.S Brydens & Sons Ltd. will be responsible for the quality of the food, as well as to comply with the Sanitary Regulations in force.

Notwithstanding the foregoing, the Organizer’s liability is expressly released for: a) Expenses incurred to participate in the Activity, to make the gift effective or to enjoy it; b) Human interventions not authorized by third parties to computer systems or similar that alter the development of the Activity; c) Damage suffered to the integrity or assets of the participants or third parties that are caused by virtue of this Activity or during the enjoyment of the gift.
1. Suspension of the Activity: The Organizer reserves the right to suspend the Activity temporarily or definitively if the existence of assignment or claim of gifts in a fraudulent manner is verified, as well as in cases of technical failures, or any other event outside the reasonable control of the Organizers. The alteration of documents and information about the participants, as well as deception, fraud or falsification, unauthorized manipulation that hinder the normal performance of the Activity and actions that in the opinion of the Organizers are illegal and may cause damage to the Activity or its Organizers may be prosecuted by the means provided in the Law.
1. Relationship between the parties: No provision of this Activity shall be construed as creating a relationship between the parties other than that arising from normal trade in commerce. No participant of the Activity, by virtue of being such, acquires the status of employee, representative, or agent of the Organizing Company. With the fulfillment of the obligations established in this Regulation, the relationship between the parties as a whole will end.
Simplified Privacy Notice: Solely and exclusively for the purposes related to the treatment and protection of personal data of the participants, the responsible entity is the one called Uber BV, domiciled in Meester Treublaan 7, 1097 DP, Amsterdam, the Netherlands, same as they will be treated with the sole purpose of registering their participation in the Activity, of contacting the participants to coordinate the delivery of the gifts and for purposes of dissemination, promotion and marketing. 1. Territory: This Activity will be valid and will take effect only within the City of San Juan, Trinidad and Tobago and is only applicable to active driving partners at the time of its publication.
