Uber Electric Castle Contest Terms and Conditions

These Terms and Conditions (“Terms“) govern the Electric Castle contest (the “Contest“) organized by Uber B.V. through Uber B.V. – FIliala Bucuresti SRL (together “Uber“) in Romania. By participating in this Contest, you agree to be bound by these Terms.

The Contest is organized by: Uber B.V., a private limited liability company incorporated under the laws of the Netherlands under registration number 56317441 and with a registered address of Burgerweeshuispad 301, 1076 HR, Amsterdam, the Netherlands through Uber B.V. – Filiala Bucuresti SRL, registered in accordance with the laws of Romania (Bd. Primăverii nr. 19-21, sc. B, et. 2, Bucharest, Sector 1), acting as a marketing support entity. 

The Contest will run from July 7, 2025, at 00:00 EEST, to July 13, 2025, at 23:59 EEST (the “Contest Period“).

3.1. This Contest is open only to individuals who meet all the following criteria: 

a. Are legal residents of Romania. 

b. Are at least 18 years of age at the time of entry. 

c. Have an active and valid Uber rider account in Romania. 

d. Have successfully registered for the Contest via the designated registration method provided by Uber. 

e. Are not employees, directors, or officers of Uber, its affiliates, subsidiaries, advertising, promotional, or fulfillment agencies, or their immediate family members (spouse, parents, siblings, children) or persons living in the same household.

3.2. Uber reserves the right to verify the eligibility of all participants and disqualify any participant who does not meet the eligibility criteria or violates these Terms.

4.1. To enter the Contest, eligible participants must: 

a. Have an active Uber rider account in Romania. 

b. Register for the Contest through the specific in-app notification or communication channel provided by Uber during the Contest Period. Registration is mandatory for participation. 

c. Take the highest number of completed Uber rides in Romania during the Contest Period (July 7 – 13, 2025). Only completed rides that are ordered and paid for through the Uber application will be counted. Cancelled rides, uncompleted rides, or rides not initiated via the Uber app will not be considered.

4.2. Each unique Uber rider account is considered one entry. Attempts to manipulate the number of rides, including but not limited to, fraudulent rides, repeatedly cancelling and re-ordering rides, or creating multiple accounts, will result in immediate disqualification.

5.1. The winner will be the eligible participant who has completed the most Uber rides within Romania during the Contest Period (July 7 – 13, 2025).

5.2. In the event of a tie, the winner will be determined based on the total monetary value of completed rides (excluding tips and promotions) during the Contest Period, with the higher value prevailing. If a tie still exists, the winner will be selected randomly from the tied participants by an independent Uber representative.

5.3. The winner selection will take place on 14 July, 2025, before 16:00 EEST.

6.1. The prize consists of two (2) VIP tickets to Electric Castle, the annual music festival held on the Transylvanian domain of the Bánffy Castle, near Cluj-Napoca in Romania from Wednesday, July 16, 2025 to Sunday, July 20, 2025.

6.2. The prize is non-transferable, non-exchangeable, and cannot be redeemed for cash or any other alternative.

6.3. All other expenses not expressly mentioned as part of the prize, including but not limited to travel to and from the festival, accommodation, food, beverages, and personal expenses, are the sole responsibility of the winner and their guest.

6.4. Uber reserves the right to substitute the prize with an alternative prize of equal or greater value if the original prize becomes unavailable for any reason.

7.1. The provisional winner will be notified by Uber via the email address and/or phone number indicated in the registration form to the Contest within 24 hours of the winner selection date.

7.2. The provisional winner must respond to the notification within 24 hours to confirm eligibility and accept the prize. Failure to respond within this timeframe, or if the winner is found to be ineligible or in breach of these Terms, may result in disqualification and forfeiture of the prize. In such a case, Uber may select an alternate winner.

7.3. The winner may be required to sign an affidavit of eligibility, liability release, and publicity release (where permitted by law) to claim the prize.

7.4. Uber will coordinate the delivery of the VIP tickets directly with the winner. This may involve sharing the winner’s name and necessary contact information with the festival organizer for the purpose of prize fulfillment.

8.1. By participating in the Contest, the winner agrees to the use of their name, city of residence, and likeness for promotional purposes in any media without further compensation, unless prohibited by law. This includes, but is not limited to, announcements on Uber’s social media channels and website.

8.2. By entering the Contest, the winner irrevocably grants to Uber, its employees, agents, licensees, successors, assigns, and those acting with their permission or authority the irrevocable and unrestricted right to record, reproduce, adapt, edit, modify, summarise, publish, exhibit, distribute, broadcast, display, perform, use and otherwise exploit by any and all means and for any and all uses, and by and in any and all media, now known or hereafter devised, throughout the universe, in perpetuity, in any manner, format or context whatsoever, their appearance, image, name, likeness and/or voice, including their performance for or interview with Uber, and including any sound recordings and/or audio-visual recordings of them, as well as any information, ideas and other materials that they provide to Uber in connection therewith, that are obtained or collected by Uber for the purposes of conducting and administering the Contest.

9.1. Uber will process personal data collected in connection with this Contest in accordance with its Privacy Notice (as provided separately) and applicable data protection laws, including the General Data Protection Regulation (GDPR) and Romanian national legislation.

9.2. By registering for the Contest, participants explicitly consent to the collection and processing of their personal data (name, email, phone number, and ride count) for the purposes of contest administration, winner selection, and prize fulfillment.

9.3. The winner’s name and contact details will be shared with the festival organizer solely for the purpose of arranging the delivery and access to the VIP tickets.

10.1. The winner must fully understand that if s/he redeems and receives a prize, s/he is obliged to comply with tax legislation of Romania and pay the income tax. 

10.2.  Uber will inform the winner about the value of the natural prize in order for the winner to be able to calculate and pay the income tax. 

11.1. Uber reserves the right to modify, suspend, or terminate the Contest at any time, for any reason, including but not limited to, technical issues, fraud, or force majeure events, without prior notice.

11.2. Uber’s decision in all matters relating to the Contest, including the selection of the winner, is final and binding. No correspondence will be entered into.

11.3. Uber is not responsible for any technical malfunctions, network congestion, or other failures that may interfere with the submission of entries or the notification of the winner.

11.4. Uber is not responsible for any loss, damage, or injury sustained by the winner or their guest as a result of participating in the Contest or accepting the prize.

11.5. This Contest is not considered a game of chance or gambling activity under Romanian law, as the winner is determined by a verifiable criterion (most rides) and not solely by random selection. No purchase is strictly required to participate, as existing Uber riders can qualify by taking rides they would ordinarily take, and the contest emphasizes activity rather than a singular entry fee.

11.6. These Terms shall be governed by and construed in accordance with the laws of Romania and the European Union. Any disputes arising out of or in connection with this Contest shall be subject to the exclusive jurisdiction of the competent courts in Romania.

11.7. To the maximum extent permitted by law, all participants indemnify and agree to keep indemnified Uber at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the participants and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, the participants agree to defend, indemnify and hold harmless Uber from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from: (i) any misrepresentation made by the participants in connection with the Contest; (ii) any non-compliance or improper understanding by the participants of these Terms; (iii) acceptance, possession, misuse or use of any prize.
