SUPPLEMENTAL TERMS – UBER TAXI (METERED PRICING) 補充條款 – Uber 的士 (按錶收費)

These Uber Metered Taxi Terms and Conditions (“Metered Taxi Terms”) govern Services (as defined in the Terms) made available by Uber that enable you to arrange and schedule the metered taxi services provided by Third Party Providers (collectively, “Uber Metered Taxi”).

These Metered Taxi Terms are supplemental terms to the Hong Kong Terms of Use (“Terms”). This means where you choose Uber Metered Taxi to request transportation services from Third Party Providers, the following applies to your use and access of Uber Metered Taxi:

In the event of any conflict or discrepancy between the English and Chinese versions of these Metered Taxi Terms, the English version shall prevail.

PLEASE READ THE METERED TAXI TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES, AS THEY CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND UBER. 

Capitalized terms used in the Metered Taxi Terms but not defined in the Metered Taxi Terms shall have the meanings ascribed to them in the Terms. 

By accessing or using Uber Metered Taxi, you confirm your agreement to be bound by the Metered Taxi Terms of Use. If you do not agree to the Metered Taxi Terms of Use, you may not access or use Uber Metered Taxi. 

Solely with respect to the Services for the Uber Metered Taxi, Section 4 of the Terms shall be deleted and replaced in its entirety with the following: 

You understand that use of the Services for Uber Metered Taxi may result in charges to you, for the services you receive (a) from a Third Party Provider as may be charged under the Road Traffic (Public Services Vehicles) Regulations (Cap. 374D) (“Charges”), and (b) from Uber (“Booking Fee”).  The Third Party Provider is solely responsible for the accuracy of the Charges.

The Charges, as permitted under the Road Traffic (Public Services Vehicles) Regulations (Cap. 374D) which may be amended from time to time, can be found on the website of the Transport Department. You acknowledge that the Third Party Provider is responsible for the calculation of the Charges in accordance with the Road Traffic (Public Services Vehicles) Regulations (Cap. 374D) notwithstanding any fare estimate provided in the Applications. 

After you have received the Uber Metered Taxi services, Uber will facilitate your payment of the applicable Charges on behalf of the Third Party Provider as such Third Party Provider’s limited payment collection agent. Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Third Party Provider.  Charges will be inclusive of applicable taxes where required by law.  Charges paid by you are final and non-refundable, unless otherwise determined by Uber.  You retain the right to request lower Charges from a Third Party Provider for the Uber Metered Taxi services at the time you receive such services.    

Uber may from time to time provide certain users with promotional offers that may result in different amounts charged for the same or similar services or goods obtained through the use of the Services, and you agree that such promotional offers, unless also made available to you, shall have no bearing on your use of the Services or the Charges applied to you.

For the avoidance of doubt, the Charges is intended to fully compensate the Third Party Provider for the services provided to you, and the receipt issued by the Third Party Provider (“Receipt”) shall be the legal receipt of the trip for the purpose of the Road Traffic (Public Services Vehicles) Regulations (Cap. 374D).  You have the right to demand the Third Party Provider for a printed copy of the Receipt in respect of your trip and Uber shall not be responsible for the accuracy of the Receipt.

You shall be responsible for the cost of repair for damage to, or necessary cleaning of, Third Party Provider vehicles and property resulting from use of the Services for the Uber Metered Taxi under your Account in excess of normal “wear and tear” damages and necessary cleaning (“Repair or Cleaning”). In the event that a Third Party Provider reports the need for Repair or Cleaning, and such Repair or Cleaning request is verified by Uber in Uber’s reasonable discretion, Uber reserves the right to facilitate payment for the reasonable cost of such Repair or Cleaning on behalf of the Third Party Provider using your payment method designated in your Account. Such amounts will be transferred by Uber to the applicable Third Party Provider and are non-refundable.

Additionally, if you fail to comply with these Terms you may be responsible for charges, including without limitation, for transactions that could not be completed properly, arising out of or in connection with your failure to comply with these Terms.

You agree and acknowledge that Uber shall be entitled to charge you a Booking Fee of HK$5 per every completed trip payable to Uber separate and independent of the Charges. 

Uber does not designate any portion of your payment of the Booking Fee as a gratuity or a tip to the Third Party Provider.  You understand and agree that the provision of any additional payment in excess of the Charges as a gratuity to the Third Party Provider is not obligatory but is voluntary. Where you pay a gratuity to a Third Party Provider, Uber may receive the gratuity on their behalf.  The Booking Fee paid by you is final and non-refundable, unless otherwise determined by Uber. 

All Charges and Booking Fee are due immediately and payment will be facilitated by Uber using the preferred electronic payment method designated by you in your Account, after which Uber will send you a record of payment by email. If your selected Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Uber may on its own behalf with respect to the Booking Fee, and as the Third Party Provider’s limited payment collection agent with respect to the Charges, use a secondary payment method in your Account, if available.

You may elect to cancel your request for services from a Third Party Provider at any time prior to such Third Party Provider’s arrival.

本 Uber 的士（按錶收費）條款及細則 (「咪錶的士條款」) 規管由 Uber 提供服務 (如該等條款中定義）讓你安排和預約第三方提供商所提供的咪錶的士服務 (統稱「Uber 咪錶的士」)。

本咪錶的士條款為香港使用條款 (「該等條款」) 的補充條款。換句話說，如果你選擇 Uber 咪錶的士預約第三方提供商提供的交通服務，你使用和存取 Uber 咪錶的士便須遵守以下條款：

本｢咪錶的士條款｣英文版本與中文版本之條款如有任何牴觸或差異之處，一概以英文版本為準。

本咪錶的士條款構成你與 Uber 之間的法律協議，因此務請在使用 Uber 咪錶的士服務前細閱。

在咪錶的士條款中使用但未在咪錶的士條款中界定的詞彙，具有該等條款所賦予的涵義。

使用 Uber 咪錶的士，即表示你確認同意受咪錶的士使用條款約束。如果你不同意咪錶的士使用條款，你可選擇不使用 Uber 咪錶的士。

僅就Uber 咪錶的士服務而言，該等條款第 4 條將不適用並由以下條款取代：你明白如使用 Uber咪錶的士服務，你將向以下雙方付費:（a）就你獲得的的士服務向第三方供應商支付其根據香港法例第 374D 章《道路交通 (公共服務車輛) 規例》向你收取的費用(「費用」)，及 （b) 就 Uber 提供的服務，向 Uber 支付服務費 (「Uber 預約費」)。 第三方提供商須全權負責費用的準確性。

你可於運輸署網站內參閱第三方提供商於香港法例第 374D 章《道路交通 (公共服務車輛) 規例》(或會不時修訂) 許可下向你收取的費用。你明白並確認即使 Uber 應用程式提供任何收費估算，第三方提供商有責任根據香港法例第 374D 章《道路交通 (公共服務車輛) 規例》計算費用。

在你獲得 Uber 咪錶的士服務後，Uber 會作為該第三方提供商的有限收款代理人  協助你向第三方提供商支付適用的費用。以此方式支付費用 將視為等同於由你直接付款予第三方提供商。如法律規定, 費用將包含適用稅項。除非 Uber 另行決定，你支付的費用均為最終款項且不予退還。你有權在獲得第三方提供商提供 Uber 咪錶的士服務時，要求第三方提供商降低其對該服務的費用。Uber 可能不時向特定用戶提供乘車優惠，此可能會導致你在某次使用服務時的收費跟另一次使用相同或類似服務或商品的收費不同; 除該等乘車優惠亦向你提供外，你同意該等乘車優惠不會影響你對服務的使用或適用於你的費用。

為免生疑問，費用會全部用於支付第三方提供商向你提供的服務，而第三方提供商發出的收據 (「收據」) 將為根據香港法例第 374D 章《道路交通 (公共服務車輛) 規例》所發出的合法的士行程收據。 你有權要求第三方提供商提供收據的列印本，Uber 對收據的準確性概不負責。

你必須承擔，因在你的帳戶使用 Uber 咪錶的士服務而導致第三方提供商之車輛及財物產生超出正常「磨損」範圍外損傷或必要清洗（「維修或清洗」）的損傷修理和必要清洗費用。若第三方提供商報告需要進行維修或清洗，且該等維修或清洗要求經 Uber 合理酌情權核實，Uber 保留代表第三方提供商透過你在帳戶中指定的付款方式就該等維修或清洗的合理費用協助你付款的權利。該等款項將由 Uber 轉交至適用的第三方提供商，且不予退還。

你同意並確認 Uber 有權在每個行程完成後向你收取 HK$5 的 Uber 預約費，此費用獨立於費用之外。

Uber 不會將你作爲支付Uber 預約費的任何部分劃撥為第三方提供商的賞錢或小費。你明白並同意，並非必須向第三方供應商支付超出收費金額的任何額外款項作為小費，此舉純屬自願性質。如果你向第三方供應商支付小費，Uber 可代他們收取有關小費。

你支付的 Uber 預約費是不可退還的最終費用，Uber 另有決定除外。

所有收費和 Uber 預約費均須即時支付，且 Uber 會根據你在帳戶中指定的優先電子付款方式協助你支付有關費用，其後 Uber 會透過電郵向你傳送付款紀錄。如確定你所選的帳戶付款方式已過期、無效或無法扣款，你同意 Uber 可依其名義就 Uber 預約費，及 作為第三方提供商的有限收款代理人就費用 使用你帳戶中的備用付款方式 (如有)。在第三方提供商抵達前，你可隨時選擇取消該第三方提供商的服務預約。
