READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING. YOU WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS AND AGREED TO BE BOUND BY THEM WHEN PARTICIPATING IN THIS PROMOTION. AMONG OTHER THINGS, THESE TERMS AND CONDITIONS INCLUDE LIMITATIONS OF YOUR RIGHTS AND REMEDIES.
- The Promoter
- The Promoter of this Promotion is Uber Eats (UK), a company registered under the laws of England and Wales (registration number: 10078453) whose registered address is First Floor, Aldgate Tower, 2 Leman Street, London, United Kingdom, E1 8FA.
- Eligibility and Participation
- The following terms and conditions shall exclusively apply to this BRIT Awards 2023 with Mastercard Prize Promotion (the “Promotion”) within the U.K. for the duration of the Promotion Period.
- The Promotion is open to all U.K. residents aged 18 years or over who have an active Uber One account with Uber and who are compliant with the Uber One Terms, except employees of the Promoter, their families, agents or any third party directly associated with the administration of the Promotion. Proof of age and/or identity and/or residency may be required.
- Winner(s) and their guest(s) must be aged 18 or over.
- To enter the Promotion you must:
- Have an active Uber One membership, click through the link on your received email and place an order with your Mastercard during the Promotion Period. Each order placed with a Mastercard counts as a unique entry.
- Promotion Details
- The BRIT Awards 2023 with Mastercard will take place on Saturday 11 February 2023 at The O2 in London (“Promotion Event”).
- The prizes available as part of this Promotion Event (the “Prize Packages”) are as follows:
- 1 x Diamond package prize consisting of: 2 level 1 tickets to the BRIT Awards; 3-course dinner with wine; 1-night accommodation at a London five-star hotel, and 2 x tickets to The Official After Show Party.
- 5 x L1 Ticket Only prizes consisting of:2 Level 1 tickets to the BRIT awards.
- Prize Packages (and associated tickets) are as stated and nothing else is included. There is no cash or other alternative for the Prize Packages in whole or in part.
- Prize packages (and associated tickets) are personal to the winners and the sale or offering for sale, transfer, resale, donation, or exchange of any tickets and/or part of any of the Prize Packages is strictly prohibited (including, without limitation, in person or online via an online auction website or online ticket resale marketplace). The Promoter reserves the right to cancel tickets and withdraw or make void any and all Prize Package elements if this term is not complied with.
- Promotion Period and Notification
- The Promotion will open for entries on January 5th 2023 at 00.01 and shall close on 13th January 2023 at 23.55 (“Promotion Period”). Entries received after the Promotion Period has closed will automatically be disqualified.
- The Promoter takes no responsibility for entries that are delayed, incomplete or lost due to technical reasons or otherwise.
- The winners will be chosen by a random draw performed by a computer process on Tuesday 17th January 2023 (“Draw Date”).
- The winners will be notified by email or telephone using the contact details linked to the winners’ Uber One account within three (3) days of the conclusion of the Promotion Period and must respond to the notification to claim their Prize Package within 72 hours. Failure to do this will result in the Prize Package being forfeited and the Promoter may in its absolute discretion award the Prize Package to a reserve selected at the same time as the original winner or dispose of the Prize Package in its discretion without liability to the winner.
- The Prize Package shall be awarded to the winner within three (3) days upon receipt of any additional details required to transfer the Prize Package to the winner. The Prize Package will be awarded in the form of digital tickets sent via email using the contact details linked to the winner’s Uber One account.
- General
- The decision of the Promoter regarding any aspect of the Promotion is final and binding and no correspondence will be entered into about it.
- The Promoter assumes no responsibility for any typographical or other error in the administration of the Promotion, errors in processing entries, identifying the winner, announcing the winner or the delivery of the Promotion.
- Entrants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon participation in the Promotion. The Promoter reserves the right to refuse participation in the Promotion to anyone in breach of these Terms and Conditions.
- The Promoter reserves the right to modify and amend these Terms and Conditions from time to time during the Promotion Period.
- The invalidity or unenforceability of any provision, or part thereof, of these Terms and Conditions will not affect the validity or enforceability of any other provision or part thereof. In the event that any provision, or part thereof, of these Terms and Conditions is determined to be invalid or otherwise unenforceable or illegal, the other provisions, or parts thereof, will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Promoter’s failure to enforce any term of these Terms and Conditions will not constitute a waiver of that term or any other provision of these Terms and Conditions.
- In the event there is a discrepancy or inconsistency between disclosures or other statements contained in the Promotion–related materials and these Terms and Conditions, these Terms and Conditions shall prevail, govern and control and the discrepancy will be resolved in Promoter’s sole and absolute discretion.
- Third Party terms shall apply to this Promotion:
- Winner(s) and their guest(s) acknowledge and agree that they are subject to the full terms and conditions of The O2 (Venue) including those put in place to mitigate the risks COVID 19, which can be viewed on the Venue’s website, and the Venue reserves the right to remove any person or refuse any person entry to The BRIT Awards 2023 with Mastercard regardless of whether they have a valid ticket. If a ticket is declared void or if a ticket holder is refused admission or removed from the Promotion Event because of a breach of the Ticket Terms and Conditions or breach of the terms and conditions of the Venue, no money shall be refunded
- Winner(s) and their guest(s) acknowledge and agree that they are subject to the full terms and conditions of the tickets which form part of their Prize Package, which can be viewed at https://www.brits.co.uk/terms-and-conditions (“Ticket Terms and Conditions). The Ticket Terms and Conditions are subject to change from time to time and may include the requirement for ticket holders to present valid photo ID (passport or driving licence) and/or other forms of identification (such as a debit or credit card) upon entry to the Promotion Event to ensure that the ticket holder is the same as the person named on their ticket. Tickets are personal to the winner(s) and the sale or offering for sale, transfer, resale, donation, or exchange of any tickets is strictly prohibited (including, without limitation, in person or online via an online auction website or online ticket resale marketplace). Failure to comply with any of the Ticket Terms and Conditions may result in refused entry, or the ticket holders being required to leave the Promotion Event.
- Promoter, its agents and BRIT Awards Limited do not accept any liability for any damage, loss, injury or disappointment suffered by any entrant entering the Promotion or as a result of accepting the Prize Package or any element of the Prize Package. Insofar as is permitted by law, the Promoter, its agents and BRIT Awards Limited are not liable or responsible for any injury, loss or damage to persons or property arising from or caused by the weather, acts of God, war, accident, pandemic or epidemic and any related government action or any other government restrictions or regulations, or from an act or omission of any individual or condition beyond its control. If delivery of any of the Prize Package elements is delayed or is not able to be delivered due to COVID 19, the winners will be notified by the Promoter as soon as possible.
- Personal data supplied during the course of this Promotion to the Promoter will be processed as set out in the Promoter’s Privacy Policy. The winner(s) full name, contact number and email address will be shared with Mastercard’s service provider The Big Group Limited for the purposes of fulfilling the prize. - The terms and conditions of this Promotion, and any disputes arising therefrom, shall be subject to English law and the exclusive jurisdiction of the English Courts.
