Uber Eats UK: Free Groceries for a Year Prize Draw T+Cs

Full T&Cs: 

1. The “Free Groceries for a Year Competition” prize draw (the “Prize Draw”) and the Discount is open to all U.K. residents (excluding Northern Ireland) aged 18 years or over who have a valid Uber Eats account, except employees of the Promoter, their families, agents or any third party directly associated with the administration of the Prize Draw. 

2. The Promoter is: UBER EATS UK LIMITED, a company registered under the laws of England and Wales (registration number: 10078453) whose registered address is First Floor, Aldgate Tower, 2 Leman Street, London, United Kingdom, E1 8FA.

3. The opening time and date for entries to the Prize Draw and use of the Discount is on 12th September 2022 from 12.15am BST and the closing time and date of the Prize Draw is 11.45pm BST on 26th October 2022 (the “Prize Draw Period”). Entries received after the Prize Draw Period will not be counted. 

4. To enter the Prize Draw and receive the Discount you must: 

● Have an active Uber Eats account, be 18+ and a resident of the UK (excluding Northern Ireland); and 

● Spend at least £20 on your first ever order from a grocery or convenience store using the unique code through the Uber Eats app during the Prize Draw Period.

You will automatically be entered into the Prize Draw and receive the Discount if you have complied with the above. One entry per person.    

5.   The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure.

7. A total of six (6) Prizes are available to be won: one (1) prize winner (a “Prize Winner”) per Participating University. “Participating University” means:

8. Each Prize Winner will receive the following prize (the “Prize”): 

● £200  worth of Uber Eats App credits per month to spend on groceries for a 12 month period. 

9. The Prize Winner must not (i) spend the Prize on tobacco; (ii) exceed a monthly spend of £50 on items from restaurants on the Uber Eats App using the Prize; or (iii) exceed a monthly spend of £50 on alcohol using the Prize. In the event that this clause 9 is breached, the Prize Winner will not be entitled to any further payments in respect of the Prize and the Promoter reserves the right to withdraw the Prize and cease any further payments in respect of the Prize. 

10. The Prize does not include any travel expenses, tax or personal expenses. Any other costs in addition to those set out in clause 7 are the responsibility of a Prize Winner. The Prize is subject to availability. There is no cash alternative to the Prize.

11. The Prize Winner will be chosen by a random draw performed by a computer process on 1st November 2022 (“Draw Date”). The Prize Winner will be notified by email or telephone (using details linked to their Uber Eats account) and must respond to the notification to claim their Prize within 48 hours. Failure to do this will result in the Prize being forfeited and the Promoter may in its absolute discretion award the Prize to a reserve selected at the same time as the original Prize Winner or dispose of the Prize in its discretion without liability to the Prize Winner. 

12. The Prize may take up to 30 business days to be processed from the date a Prize Winner claims the Prize under clause 10. The Prize is non-exchangeable, non-transferable and no cash alternative is offered. 

13. The Promoter assumes no responsibility for any typographical or other error in the administration of the Prize Draw, errors in processing entries, identifying a Prize Winner, announcing the Prize Winner or the delivery of the Prize Draw. 

14. The Promoter reserves the right to replace the Prize with an alternative Prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so. 

15. The decision of the Promoter regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered into about it. 

16. The name of a Prize Winner and county can be obtained by sending an email to UKIrestaurantinfo@uber.com within 30 days of the date of the Draw Date.

17. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry or refuse to award the Prizes to anyone in breach of these terms and conditions. The Promoter reserves the right to hold, void, cancel, suspend, or amend the Promotion where it becomes necessary to do so.

18.  Insofar as is permitted by law, the Promoter, their agents or distributors will not in any circumstances be responsible or liable to compensate  a Prize Winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, their agents or distributors or that of their employees. Your statutory rights are not affected. 

19. For the avoidance of doubt, the grocery and convenience stores and each of their respective subsidiaries, affiliates, owners, shareholders, officers, directors, agents, members, representatives and employees (“the Stores”) respectively will have no liability or responsibility for any claim arising in connection with participation in this Discount, Prize Draw or any prize awarded, except for any liability that cannot be excluded by law. By entering this Promotion, you acknowledge and accept that the Promoter is the sole promoter in relation to the Promotion and that the Stores have not offered or sponsored this promotion in any way.

20. A Prize Winner may be required to participate in publicity related to the Prize Draw which may include the publication of their name and photograph in any media.

21. Personal data supplied during the course of the Prize Draw may be used and passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the Prize.   Any Personal Data supplied during the course of this Promotion to Uber will only be processed as set out in Uber’s Privacy Policy found here:  https://privacy.uber.com/policy. 

22. A Prize Winner must be a U.K. resident and aged 18 or over.

23. Except where prohibited by law, participants agree that any dispute, conflict or controversy, howsoever arising out of or broadly in connection with or relating to the Prize Draw or the Prize awarded shall be resolved individually, without resort to any form of class action, and shall be first mandatorily submitted to settlement proceedings under the International Chamber of Commerce Mediation Rules (ICC Mediation Rules). If the said dispute has not been settled within 60 (sixty) days after a request for Mediation has been submitted under the said ICC Mediation Rules, such dispute shall be exclusively and finally resolved by arbitration under the Rules of Arbitration of the International Chamber of Commerce (ICC Arbitration Rules). The ICC Rules’ Emergency Arbitrator provisions are excluded. The dispute shall be resolved by one arbitrator to be appointed in accordance with the ICC Rules. The place of arbitration shall be London, England. The language of the arbitration shall be English.

24. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or the rights and obligations of you and the Promoter or their affiliates in connection with the Discount, Prize Draw or the Prize (whether contractual or non-contractual), shall be governed by, and construed in accordance with the laws of England and Wales.
