Terms and Conditions (the “Terms”)

READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PARTICIPATING. YOU WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND CONDITIONS AND AGREED TO BE BOUND BY THEM WHEN PARTICIPATING IN THIS CONTEST. AMONG OTHER THINGS, THESE TERMS AND CONDITIONS INCLUDE LIMITATIONS OF YOUR RIGHTS AND REMEDIES.

Eligibility and Participation

  1. The following terms and conditions shall exclusively apply to the Uber “Ten Years of Uber Contest” prize contest (the “Contest”) within Belgium for the duration of the Contest Period, unless otherwise specified in the Contest marketing.
  2. The Contest is open to all Belgium residents aged 18 years or over who have an active rider account with Uber and are compliant with the General Terms (the “Rider”), except employees of Uber (the “Promoter”), their families, agents or any third party directly associated with administration of the Contest. Proof of age and/or identity and/or residency may be required. 
  3. To be entered into the Contest the Rider must be an active Uber One member throughout the Contest Period or must join Uber One during the Contest Period. The Rider must also answer the following question: “What is the longest completed trip originating from Belgium and booked via the Uber app in kilometers?” Response to this question must be submitted through the Google Form provided by Uber, accessible via email or push notification. 

(together, the “Eligibility Criteria”).

Contest Period and notification

  1. The Contest Period will open on November 20, 2024 and shall close on November 26, 2024 (“Contest Period”).
  2. The Rider with the answer closest to the correct one will be declared the winner of the Contest. In the event of a tie, the youngest participant will be awarded the prize.
  3. The one (1) winner of the Contest shall be notified via EMAIL within 30 business days of the Contest coming to a close.  
  4. If the Promoter cannot reach the winner by EMAIL within 30 business days of the Contest coming to a close, or the winner refuses the Prize, then the Prize will be forfeited and a replacement winner will be notified by December 31st 2024.
  5. The Prize shall be awarded to the winner within 30 days upon receipt of any additional details required to transfer the Prize to the winner. The Prize will be awarded in the form of credit on the Uber app. 

Contest Details:

  1. The Rider that meets the Eligibility Criteria during the Contest Period shall eligible to win the following (the “Prize”):
    • A payment of five thousand euros (€5,000) worth of Uber credit (to be redeemed against Uber trips completed in Belgium).  
  2. The winner who accepts the Prize may be asked if they would like to participate in publicity related to the Contest, which may include the publication of their name and photograph in any media.
  3. The Promoter may need to provide the winner’s information and details of the winning entry to the Advertising Standards Authority on request.
  4. Personal data supplied during the course of this Contest will only be processed as set out in the Promoter’s Privacy Policy.

General:

  1. The Promoter does not assume any responsibility for any typographical or other error in the administration of the Contest.
  2. The decision of the Promoter regarding any aspect of the Contest is final and binding and no correspondence will be entered into about it.
  3. Third party terms and conditions may apply to any part of the Contest where applicable.
  4. Participants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon participation in the Contest. The Promoters reserve the right to refuse participation in the Contest to anyone in breach of these Terms and Conditions.
  5. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate a participator, accept any liability (whether direct, indirect, special, incidental, exemplary, punitive or consequential) for any loss, damage, personal injury or death arising out of or in connection with any participant’s participation in the Contest whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not the Promoter or its affiliates have been advised of the possibility of such loss, damage, personal injury or death. Your statutory rights are not affected. Any liability of the Promoter arising in connection with the Contest shall be several and the Promoter accepts no joint and several liability in connection with the Contest.
  6. The Promoter reserves the right to modify and amend these Terms and Conditions from time to time during the Contest period.
  7. The invalidity or unenforceability of any provision, or part thereof, of these Terms and Conditions will not affect the validity or enforceability of any other provision or part thereof. In the event that any provision, or part thereof, of these Terms and Conditions is determined to be invalid or otherwise unenforceable or illegal, the other provisions, or parts thereof, will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Promoter’s failure to enforce any term of these Terms and Conditions will not constitute a waiver of that term or any other provision of these Terms and Conditions.
  8. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in the Contest–related materials and these Terms and Conditions, these Terms and Conditions shall prevail, govern and control and the discrepancy will be resolved in Promoter’s sole and absolute discretion.
  9. Except where prohibited by law, participants agree that any dispute, conflict or controversy, howsoever arising out of or broadly in connection with or relating to the Contest shall be resolved individually, without resort to any form of class action, and shall be first mandatorily submitted to the accredited mediator recognized by the Federal Mediator Commission (Federale Bemiddelingscommissie/Commission fédérale de médiation).
  10. If the said dispute has not been settled within sixty (60) days after a request for mediation has been submitted under the said Mediator Commission, such dispute shall be exclusively and finally submitted to the courts in Belgium.
  11. All issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or the rights and obligations of the participants and the Promoter or its affiliates in connection with the Contest (whether contractual or non-contractual), shall be governed by, and construed in accordance with the laws of Belgium.
