UAE 10 YEARS DRIVE AND WIN COMPETITION 

Effective as of November 6, 2023 

The Campaign will run from 0000 hrs (GST) on Monday 6th November 2023 to 1159 hrs (GST) on Sunday 14th January 2024(“Campaign Period”). 

For the purposes of the Weekly Prizes, the Campaign Period will be divided into 10 consecutive weeks.

All active Driver-Partners who use the Uber app will be eligible to participate in the Campaign, unless you have chosen to opt-out. There is no charge for participating in the Campaign. Additional information and details about eligibility requirements and the Prizes are available below. 

By participating in the Campaign, you are agreeing to be bound by these Terms.

As part of the Campaign, Driver-Partners will be eligible to win Weekly Prizes in each week. There will be 100 winners each week for 10 weeks, with a total of 1,000 Prizes available. The Campaign will then culminate with one Driver-Partner winning the Grand Prize.

The weekly Prizes include 10 mobile phones Samsung A24 4GB ram 128GB dual-sim   (collectively “Phones”and each a “Phone”)  and 90 shopping vouchers (each worth AED300) (collectively “Vouchers” and each a “Voucher”). Upon meeting the criteria for a given week during the Campaign Period, the 1st to 10th ranked Driver-Partners will win a Phone  and the 11th to 100th ranked Driver-Partners will win a Voucher. At the end of the Campaign, the 1st ranked Driver-Partner will win the Grand Prize. 

Each Driver-Partner is eligible to receive only one (1) Phone and one (1) Voucher as part of the Campaign, and, in addition, will be eligible to win the Grand Prize at the end of the Campaign Period. In no circumstances will a Driver-Partner be entitled to receive more than one (1) Phone or more than one (1) Voucher.

The criteria for winning the various Prizes is set out in the table below:

The decision of Uber regarding any aspect of the Campaign, including the winners of the Prizes, is final and binding.

Each winning Driver-Partner will receive a notification through a phone call to the phone number  associated with the relevant Driver-Partners’  Uber app account. The Driver-Partner shall also receive an email notification (provided that one is available to Uber) on winning a Prize.   

Each winning Driver-Partner will be required to present their ID and provide their signature on the “Gift Receipt Voucher” in order to collect their Prize. Each Prize must solely be collected by the winning Driver-Partner. Prizes that are not  collected by a winning Driver-Partner will  alternatively be given to the Driver-Partners’ employer/fleet partner. Driver-Partners will also be required to provide their signature on the “Media Release Form” at the collection venue prior to taking any photographs of or statements. 

If the winner is unreachable by phone or fails to collect their Prize at the set time and place, the winner will be accorded another chance to collect their Prize by being included in the following week’s list of winners. If the winner is unreachable by phone or fails to collect their Prize after the second week then the Prize will be given to the winning Driver-Partners’ employer/fleet parter. Uber does not accept any liability for reallocating Prizes where the original winning Driver-Partner is unreachable by phone or fails to collect their Prize.

The Grand Prize includes the vehicle only. The winner of the Grand Prize shall, after the collection thereof, bear any and all costs and administration requirements relating to ownership of the vehicle, including, among others, registration and licensing of the vehicle. The winner of the Grand Prize accepts that he/she will have no claim against Uber for the costs and expenses it incurs in connection with the ownership and operation of the vehicle, including, but not limited to, the costs and expenses associated with the collection, registration, usage and maintenance of the vehicle.

The Campaign is designed to enhance Your satisfaction. If you win a prize and would not want to participate, you may reject the prize in writing by sending an email to khayat2@ext.uber.com. The prize will go to the next qualifying driver.

The Campaign is a new and exciting Prize campaign and is aimed at increasing your satisfaction as an earner. However, it is not guaranteed, and we may need or choose to suspend or vary it from time to time or cancel it completely. We will update you of any key changes to the Campaign by way of in-app messages. Your continued participation in the Campaign shall be deemed as your acknowledgement of any modifications to these Terms. If you do not agree to any changes to these Terms, you may opt-out of the Campaign in accordance with the “Opt Out” section, above. If Uber has to, or decides to, cancel the Campaign, the criteria for eligibility will no longer be applicable after the cancellation date and distribution of the Prizes will be terminated.

Uber may discontinue your eligibility to participate, or your participation, in the Campaign in the case of fraud, misuse of the Uber app, breach of your Driver Terms, the Community Guidelines and/or these Terms, or if Uber considers that your conduct is contrary to the spirit or intention of the Campaign. 

If your Driver account is permanently deactivated, your participation in the Campaign will cease immediately and you will not be entitled to receive a Prize in any circumstances (including if you met the criteria for winning a Prize prior to your account being deactivated).

All Prizes are granted at the discretion of Uber and may change, be withdrawn or be canceled at any time. The Prizes are non-exchangeable, non-transferrable and no cash alternative is offered to winning Driver-Partners. 

Prizes provided by third parties may require additional action by you, including agreeing to additional terms or creating an account with such third party. Uber is not responsible, and disclaims all liability for the products or services offered by third parties in connection with the Campaign. To ensure the success of the Campaign, Uber may collect information on such third party Prizes-based transactions for information and reporting purposes, in each case pursuant to the terms agreed to by the third party Prize provider and the Driver-Partner.

To facilitate your participation in the Campaign, Uber or third parties contracted by Uber is/are required to process certain personal data about you, such as acceptance rate, cancellation rate, star rating average and the amount of trips you have chosen to complete, to calculate whether the criteria for winning a Prize has been met and ranking you against other Driver-Partners. If you win, Uber will share your name and phone number with a third party (Campaign’s organizer agency) to contact you for collection of your Prize. If you elect to collect the Prize, you automatically provide your consent to Uber sharing your personal data with the Campaign’s organizer agency and to the Campaign’s organizer agency collecting your personal data, , such as but not limited to, your name, surname, emirates ID number, and signature on the “Media Release Form” prior to taking any photographs of you or your statements, as well as on the “Gift ReceiptVoucher”. We encourage you to read their privacy policy. Uber reserves the right to use these photos in advertising, in accordance with applicable law. Uber will be the controller of the personal data it processes to calculate whether you have met your criteria for winning and for ranking you against other Driver-Partners, and where Uber uses your photo in advertising materials. Dispute Resolution Process. 

In the event of any dispute or claim arising out of or in connection with these Terms, you and we agree in the first instance to discuss and consider referring the dispute or claim to arbitration under the rules of the Abu Dhabi Global Market (ADGM) Arbitration Rules, which rules are deemed to be incorporated by reference herein.

Governing Law and Jurisdiction. 

These Terms shall be exclusively governed by the Federal laws of the UAE. Other than where the you and we agree to refer the dispute or claim to arbitration, you and we irrevocably agree that the Federal courts of the UAE shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms or their subject matter or formation.

The Campaign may be unavailable, inaccurate or interrupted from time to time for a variety of reasons outside of Uber’s control. We are not responsible for any unavailability, interruptions or errors of Drive and Win, its features or any Prizes. All information accessible in connection with the Campaign is provided for informational purposes only on an “as is” and “as available” basis. We, our affiliated entities and third party Prizes providers and their agents, make no warranties, representations, or guarantees of any kind, express or implied, including, but not limited to, accuracy, currency, or completeness, the operation of Drive and Win, the information, materials, content, availability, and products. To the fullest extent permitted by applicable law, we disclaim all representations, warranties, guarantees and other promises, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms is intended to exclude liability for fraud or fraudulent misrepresentations or any other representations which cannot be excluded by law.

To the maximum extent permitted by law, Uber is not liable under or connection with these Terms for any thing other than to the extent that such liability cannot be limited by applicable law.  Nothing in these Terms limits any liability which cannot legally be limited, To the extent permitted by law, we disclaim all liability for any act or omission of you, any Driver-Partner or any other third party.
