Uber Bus – Uber Bus Packages Terms and Conditions – Egypt

These terms and conditions govern your purchase and use of Uber Bus Packages, which is a limited subscription (the "Program" or “Uber Bus Packages”) offered by Uber Technologies Egypt LLC, its parent, subsidiaries and/or affiliates (“Uber” or “we”). Uber is a technology company which provides mobile applications for users to arrange and schedule transportation services with third party providers of such services under agreement with Uber. Uber is not a provider of transportation services, as such all benefits and discounts offered under the Program are offered on an "as available" basis, contingent upon third-parties' availability to provide the transportation services and other contingencies which may impact availability of some benefits at certain times and places. Uber Bus Packages are provided in connection with use of the Uber or Uber Bus apps.

1. Incorporation.

These Uber Bus Packages Terms and Conditions ("Uber Bus Packages Terms") are expressly incorporated into and made a part of the Uber Terms of Use, Privacy Policy, Uber's Community Guidelines and the Uber Cash and Underpayments Terms and Conditions (collectively the “Uber Terms”). In the event of any conflict between these Uber Bus Packages Terms and the Uber Terms, these Uber Bus Packages Terms shall govern as applied to the subject matter herein. Subject to the foregoing, undefined, capitalized terms in these Uber Bus Packages Terms will have the meaning set forth in the Uber Terms.

By purchasing Uber Bus Packages you agree to these Uber Bus Packages Terms, as well as any other specific terms of the offer you received (the “Offer”), which may include important details and restrictions, including, but not limited to, where and when Uber Bus Packages may be used, the Rate and Packages Benefits (as defined below), and the validity period and number of trips under the package (the “Validity”). Please refer to your Offer for details before purchasing Uber Bus Packages.

2. How Uber Bus Packages Work.

Uber Bus Packages is a paid service provided by Uber that entitles the user to pricing benefits in relation to services provided by third party providers in a specific geographic area for the duration of the Uber Bus Packages, as set forth in your Offer (“Packages Benefits”). The details for the applicable promotions (and any applicable limitations) shall be set forth in your Offer and stated to you when you sign up for Uber Bus Packages, including but not limited to the billing rate for the Uber Bus Packages (“ Rate”). Packages Benefits do not cover applicable tax or optional gratuities. The total price of the Uber Bus Packages shall be presented to you at the time of purchase. Packages Benefits may be subject to applicable limitations. Packages Benefits are subject to third party provider availability and acceptance of requests for services in your geographic area. It should be understood that Uber and/or its affiliates do not provide free or discounted services but instead, as part of the pricing benefits, pay these amounts to third party providers on behalf of the user as third party payments.

3. Charges.

When you purchase Uber Bus Packages, you will be charged the Rate for the Validity of your selected Uber Bus Package on the date of purchase, which will activate your Uber Bus Packages, save as otherwise stipulated herein.

If your selected payment method is declined, Uber will prompt you for a new payment method. Uber is not responsible for any fees charged by the cardholder's bank including, but not limited to, overdraft fees, insufficient funds fees, interest charges, foreign exchange fees, cross border fees, and other penalties levied by the cardholder's bank.

If you select to pay your Uber Bus Packages in cash, you will be asked to pay the third party provider the Rate in cash before the first eligible trip that you take with your Uber Bus Packages. If you do not pay the Rate before that first trip, the third party service provider may refuse your trip request and ask you to off-board the vehicle if you do not have another payment method available including another valid Uber Bus Package. You may cancel your Uber Bus Package at any time before you request your first eligible trip using the Uber Bus Package.

4. Changes to your Uber Bus Packages.

Uber reserves the right to modify or stop offering Uber Bus Packages, or change Packages Benefits or Rates, at any time in its sole discretion. If your Rate increases or your Packages Benefits materially change, we will honor your existing Uber Bus Package until its Validity runs out.

Uber may terminate your Uber Bus Packages at our discretion without notice. Where you are entitled for a refund where required by applicable law, please contact customer service by way of the Uber app. We will not give any refund for termination related to conduct that we determine, in our sole discretion, violates these Uber Bus Packages Terms, Uber's Terms of Use, Uber’s Community Guidelines, any applicable law, or involves fraud or misuse of the Uber Bus Packages. Uber, at its discretion, may terminate your Uber Bus Packages effective at the end of the Validity of the Uber Bus Package by providing you notice of such termination. If that happens, you will have access to your Packages Benefits until the end of their Validity.

5. Combining Promotions.

Notwithstanding the terms and conditions of other promotions offered through Uber Bus , Uber in its sole discretion may permit Packages Benefits to be combined with other promotions and subject to applicable law.

6. Free Trial.

Uber and/or third parties on behalf of Uber may offer some users a free trial or other promotional entitlement to Uber Bus Packages . Such trial or promotional entitlement are subject to these Uber Bus Packages Terms except as otherwise stated in the Offer. Only one trial or promotional entitlement is available per user. Free trial eligibility is determined by Uber at its sole discretion and Uber may limit such eligibility or duration to prevent free trial abuse. Certain limitations may exist with respect to combining a free trial with any other offers.

7. Changes to These Uber Bus Packages Terms.

Uber reserves the right to modify these Uber Bus Packages Terms. If we make material changes while you have an active Uber Bus Package, we will notify you either in the hub and/or via email. Revised Uber Bus Packages Terms become effective upon notification to you and your continued use of Uber Bus Packages constitutes your acceptance of the revised terms.

8. Transfer of Rights.

Uber's rights and obligations under the Uber Bus Packages Terms may be assigned or transferred by Uber to any other related or unrelated entity at any time, and performances shall be the responsibility of that entity.

9. Disclaimer.

All interpretations of these Uber Bus Packages Terms will be at Uber's sole discretion and Uber's decisions will be final.

Uber Bus Packages and/or any of its features may be unavailable, inaccurate or interrupted from time to time for a variety of reasons. We are not responsible for any unavailability, interruptions or errors of the Program or its features that are outside of Uber’s reasonable control. Uber may from time to time request information from you to confirm your identity. Uber may delay your access to Uber Bus Packages until you comply with this information request. Uber Bus Packages and all the information accessible through it are provided for information purposes only on an "as is" and "as available" basis. We, our information providers and their agents make no warranties, representations, or guarantees of any kind, express or implied, including but not limited to, accuracy, currency, or completeness, the operation of Uber Bus Packages, the information, materials, content, availability, and products. Uber Bus Packages and these Uber Bus Packages Terms are provided by Uber and do not modify the contractual relationships among or between the individuals and entities that use Uber’s technology to offer or services, and Uber, except as expressly set forth herein. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to, implied warranties or merchantability and fitness for a particular purpose.
