UberPITCH – terms and conditions of participation

UberPITCH is organised by Uber B.V., a company incorporated in the Netherlands, with a registered address of Vijzelstraat 68, 1017HL, Amsterdam.  Entry and participation in UberPITCH is governed by these terms and conditions (the “Terms”).  Please read these Terms carefully before submitting an application to participate in UberPITCH.

UberPITCH – challenge information

UberPITCH gives users of the Uber app in Copenhagen the opportunity to submit an application form to discuss a business “Pitch” to a venture capitalist for the Copenhagen.  UberPITCH is aimed at encouraging entrepreneurs in participating cities in Europe (as determined at Uber’s sole discretion) to find out more about how to potentially accelerate the growth of their Pitch by speaking with venture capitalists who are active in their country and/or market.  Selected finalists chosen from eligible participants (being those participants who have successfully requested to discuss their Pitch using the Uber app with an appointed venture capitalist and signed any release and documentation associated with UberPITCH and strictly complied with these Terms) will then be given the opportunity to travel to Berlin to discuss their Pitch at the 2016 UberPITCH Conference with Uber Technology, Inc. CEO Travis Kalinick!*  Airfares to Berlin will be borne by Uber or Uber’s partners, and participants must agree to consent to share the necessary personal information in order to make any arrangements for such travel.  Any other associated cost will be borne by participants, including but not limited to transfers, meals and accommodation.  Finalist places are strictly limited and will be selected on a pan-European basis, only.  Some cities or countries partaking in UberPITCH may have no participants that progress to the finalist stage at the 2016 UberPITCH Conference.

Application forms successfully submitted (applications are accepted by online only) will be sent a special “Code” by return email. Users are responsible for having a valid and current email address.  The Code will enable users to unlock a special vehicle view on the relevant date in that city (see “How to participate in UberPITCH – below) that will allow them to request the opportunity to discuss their Pitch with the venture capitalist participating in the relevant Uber location.

*In the event that Travis Kalanick is unable to attend the 2016 UberPITCH Conference in Berlin, participants agree to partake in and discuss their Pitch with another Uber executive or employee, to be selected at Uber’s discretion.

How to participate in UberPITCH

UberPITCH will run from ca 08:00 – 18:00 on Tuesday, May 31, 2016, inclusive.

Submission of the application form does not guarantee that you will be able to participate in UberPITCH and participation is strictly limited and subject to availability.

Users are responsible for having a valid and current email address.  Users who have expressed an interest in participating in UberPITCH or those who wish to have more information, will need to respond to the email communication from Uber.  Communication will only be sent to those users of the Uber app who consent to receive marketing and communications from Uber.  A follow up email will be sent by Uber to interested users, which will contain these Terms and the application form.  Interested users must then read these Terms, read and complete the application form and return to Uber at the email address specified by Uber in said email.  All entries must be received by Uber no later than 12:00 on 30/05/2016.

For the avoidance of doubt, those users who successfully request to participate in UberPITCH will not be offered transportation services.  Participation in UberPITCH is provided free of charge, however participants must be registered users of the Uber app in order to participate.  Further, it is not required that participants must have successfully used the Uber app previously to request transportation, mobility or logistics services in order to participate.  We expect demand to participate in UberPITCH to be high and Uber takes no responsibility for any user that was unable, late, or unsuccessful in requesting to participate in UberPITCH.

The venture capitalists partnering with Uber in UberPITCH will work together to select the five finalists from eligible participants who will be travelling to the 2016 UberPITCH Conference.  Participants must be available on and around [06/06/16 – 10/06/16] in order to participate in the final stage at the 2016 UberPITCH Conference in Berlin.

Any Pitch that relates to on-demand transportation, mobility or logistics services will be expressly excluded from participating in UberPITCH and the  2016 UberPITCH Conference.

Eligibility

UberPITCH is only open to residents of a participating European country, as determined and communicated by Uber.  For the purpose of these Terms, participants must be residents of Denmark.

Participation is not permitted to the following persons:

In participating in UberPITCH, you confirm that you will comply with these Terms and are eligible to participate in accordance with the entirety of these Terms and able to travel to Berlin on and around 7-10 June.

Uber will not accept any application form that is:

There is a limit of one Pitch per user.

Uber and its appointed venture capitalists reserve all rights to disqualify you if your conduct is contrary to the spirit or intention of UberPITCH.

Berlin – for selected finalists

Selected finalists traveling to Berlin for the 2016 UberPITCH EVENT will have transport costs to Berlin provided by Uber or its partners.  Transportation to Berlin may be by ground or air, as determined at Uber’s sole discretion.  Finalists will be responsible for any other costs associated in travelling to the 2016 UberPITCH Conference, including insurance, spending money, tax, transfers, meals and accommodation.  

Finalists will be responsible for ensuring that they are available to travel and hold valid passports, any necessary visas and travel documents to participate in in the 2016 UberPITCH Conference in Berlin, Germany. The date of the conference in Berlin is subject to change and finalists will not be compensated nor able to negotiate a different day for attending the conference.

Finalists selected to participate in the 2016 UberPITCH Conference will be contacted by [email/phone/] by  06/06/16.

For the avoidance of doubt, the purpose of the 2016 UberPITCH Conference is to have the chance to speak about your Pitch with Uber’s CEO (or, another appointed Uber executive or employee if Travis Kalanick is unavailable).  No winner will be selected and there is no additional prize from the 2016 UberPITCH Conference.

Limitation of liability

Insofar as is permitted by law, Uber, its agents or distributors and the appointed venture capitalists will not in any circumstances be responsible or liable to compensate you for any loss, damage, personal injury or death occurring as a result of participating in UberPITCH, including the 2016 UberPITCH Conference, except where it is caused by the negligence of Uber, its agents or distributors or that of their employees.  Your statutory rights are not affected.

Confidentiality and Intellectual Property Rights

By participating in UberPITCH, you acknowledge that any ideas, comments or suggestions included in the application form are not confidential information.  You further acknowledge and agree that Uber or its appointed venture capitalists may develop, have developed, or be developing projects similar or identical to your Pitch.  By participating, you waive any legal claims they may have resulting from and relating to their Pitch.

Data Protection and Publicity

If you are a finalist, you agree that Uber may use your name, image and town or country of residence to announce finalists of UberPITCH and for any other reasonable and related promotional purposes.

By participating in UberPITCH, you agree that any personal information provided by you in the course of your participation may be held and used only by Uber or its agents and suppliers to administer UberPITCH.

General

If there is any reason to believe that there has been a breach of these Terms, Uber may, at its sole discretion, reserve the right to exclude you from participating in UberPITCH.

Uber reserves the right to hold void, suspend, cancel or amend the selection of finalists to the 2016 UberPITCH Conference where it becomes necessary to do so.

These Terms shall be governed by the laws of Denmark. The parties submit to the exclusive jurisdiction of the courts of Denmark.
