Program Terms and Conditions

1. This Offer is jointly provided by (1) Uber B.V (“Uber”) a company registered in the Netherlands, whose registered office is at Burgerweeshuispad 301, 1076 HR Amsterdam, the Netherlands (registered at the Amsterdam Chamber of Commerce under number 56317441); (2) Uber Eats Ireland Limited (“Uber Eats”) a company incorporated in the Republic of Ireland and whose registered office is at 47 Thomas Street, 3rd Floor, Limerick; and (3) Avios Group (AGL) Limited (“AGL”) (company registered number 02260073) a company incorporated in England and Wales and whose registered office is at Waterside, Speedbird Way, Harmondsworth, United Kingdom UB7 0GB .
2. To be eligible for this Offer, customers must be:
   1. at least 18 years old;
   2. be a member of the AerClub and accept its Terms and Conditions. For full details of the AerClub’s Terms and Conditions please visit https://www.aerlingus.com/aerclub/members-area/aerclub-terms-and-conditions/; and
   3. hold an active Uber and/or Uber Eats account (as applicable) and accept the Uber’s General Terms of Use (“Eligible Participants” or, in the singular, an “Eligible Participant”).
3. In order to verify eligibility for the Offer as stated in clause 7, we reserve the right to require Eligible Participants to provide us with proof of age and identity.
4. To earn Avios, Eligible Participants must link their Uber and/or Uber Eats account to their AerClub account in the Uber and/or Uber Eats app and select AerClub as their Preferred Reward program.
5. To participate in this Offer, Eligible Participants must confirm and accept these Terms and Conditions as well as AGL’s Terms and Conditions. For full details please visit https://www.avios.com/en-GB/terms-and-conditions.
6. Only one Uber and/or Uber Eats account and a linked AerClub account will be eligible to receive Avios. The holder of the accounts must be the same person and the names must match.
7. Eligible Participants can earn Avios on each Eligible Use (defined below) at the following rates (the “Offer”):
   1. For the Republic of Ireland
      1. One (1) Avios per €1 of Qualifying Spend on Uber Trips;
      2. One Avios per £1 of Qualifying Spend on Uber Eats where the minimum Qualifying Spend of £25 is met.
   2. For the United Kingdom (Including Northern Ireland)
      1. One (1) Avios per £1 of Qualifying Spend on Uber Trips;
      2. One (1) Avios per €1 of Qualifying Spend on Uber Eats where the minimum Qualifying Spend of €25 is met, subject to exclusions in clause 9.
8. “Eligible Use” means:
   1. a trip booked and completed via the Uber app in the UK (including Northern Ireland) or the Republic of Ireland; and
   2. a food and beverage order placed via Uber Eats in the UK (including Northern Ireland) or the Republic of Ireland, whether ordered through the Uber app or the Uber Eats app.
9. For the purpose of this Offer, “Qualifying Spend” means:
   1. Uber Trips: the total price of a completed Uber trip before any promotions or discounts have been applied, excluding tips and any additional fees, such as cleaning fees.
   2. Uber Eats Orders: the total subtotal of the order before any promotions and/or discounts have been applied, excluding delivery fees, services fees, tips and any other additional charges. For the avoidance of doubt, if a basket subtotal is €/£40, but a discount reduces the actual amount paid to €/£20, Avois will be awarded on the €/£40 subtotal, provided the minimum €/£25 minimum spend threshold is met and the below exclusions apply.
      1. Grocery and retail orders are excluded;
      2. For the Republic of Ireland, in accordance with local regulations, any Uber Eats order containing alcohol products is entirely ineligible for Avios accrual. Avios will not be awarded for any part of an order if an alcohol item is included in the basket.
10. The Offer is valid on Eligible Uses completed within the UK and the Republic of Ireland. For Uber Travel Rail and Eurostar journeys, travel must include either a departure from or arrival in the UK.
11. Eligible Use include Uber ride and mobility services and Uber Eats orders available through the Uber platform, subject to availability by location and time.
12. Eligible Use may include the following Uber services (availability varies by city and time):
    1. UK (including Northern Ireland): UberX, UberXL, Uber Assist, Uber Access, Uber Comfort, Uber Exec, Uber Lux, Uber Reserve, Uber Pet, Uber Green, Uber Boat, Lime e-bikes and scooters, Black Cab, Uber Exec XXL Coach, Rail and Eurostar, and Uber Eats (excluding grocery and retail).
    2. Republic of Ireland: Uber Taxi, Taxi Fixed Price, Taxi XL, Uber Black, Taxi Max, Taxi Access, Uber Reserve, Uber Electric, and Uber Eats (excluding grocery and retail).
13. Uber Reserve is available in all cities in the Republic of Ireland and is available in selected locations within the UK and across certain Uber mobility categories, as follows:
    • Greater London: UberX, UberXL, Uber Exec, Uber Lux
    • Manchester: UberX, UberXL, Uber Exec
    • South-West (incl Bristol and Bath): UberX, UberXL, Uber Exec
    • Birmingham: UberX, UberXL, Uber Comfort, Uber Exec
    • Leeds: UberX
    • Leicester: UberX.
    • Merseyside (primarily Liverpool): UberX
    • Nottingham: UberX
    • Republic of Ireland: Uber Taxi, Taxi Fixed Price, Taxi XL, Uber Black, Taxi Max, Taxi Access, Uber Reserve, Uber Electric.

14. Validated Avios will be awarded within 24 hours of the Eligible Use. Where a booking includes multiple Eligible Uses, Avios will be awarded within 24 hours of the final completed Eligible Use.
15. If a booking includes multiple Eligible Uses (trips or orders) and the customer cancels one or more of them, the entire booking becomes ineligible for the Offer, and no Avios will be awarded for any of the uses in that booking.
16. This Offer is non-transferable and cannot be used in conjunction with any other Avios-related offer or Uber and/or Uber Eats offer or promotion.
17. Avios have no monetary value, are non‑transferable, and cannot be refunded nor exchanged.
18. Please submit all claims for any missing Avios as soon as your booking is complete.
19. For missing Avios queries please contact Uber and/or Uber Eats via the Help section of the app or visit Uber.com.
20. Aer Lingus, Avios Group (AGL) Limited, Uber and/or Uber Eats reserve the right to terminate an Eligible Participant’s participation in this Offer if they believe such Eligible Participant is in breach of these Terms and Conditions, or if their use is deemed unauthorised, fraudulent, or otherwise unlawful.
21. Aer Lingus, Avios Group (AGL) Limited, Uber, and/or Uber Eats reserve the right to withdraw this Offer or amend these Terms and Conditions, including Avios earn rates, without prior notice at any time, for whatever reason, and without any liability to Eligible Participants for doing so.

23. By taking part in this Offer, Eligible Participants agree to the personal data they supply being used by Aer Lingus, AGL, Uber and/or Uber Eats or their agents or subcontractors for the sole purpose of administering this Offer as set out in AGL’s Privacy Policy, Aer Lingus’s Privacy Statement and Uber and/or Uber Eats’ Privacy Notice.
24. Insofar as is permitted by law, Aer Lingus, AGL, Uber, and/or Uber Eats will not (and nor will our agents or distributors), in any circumstances be responsible or liable to compensate an Eligible Participant, accept any liability to an Eligible Participant (whether direct, indirect, special, incidental, exemplary, punitive or consequential) for any loss, damage, personal injury or death (other than caused by our negligence) arising out of or in connection with their participation in the Offer whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not we (or our affiliates) have been advised of the possibility of such loss, damage, personal injury or death. Statutory rights of Eligible Participants are not affected.
25. Any advertisements, banners or other promotional content related to the Offer will be read alongside these Terms.
26. This Offer shall be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales, but not exclusively if the Eligible Participant is a resident of the United Kingdom but outside England and Wales; then the courts of Scotland or Northern Ireland (depending on the Eligible Participant’s jurisdiction) also have jurisdiction. If the Eligible Participant is resident in the Republic of Ireland, then the courts of the Republic of Ireland also have jurisdiction.
27. Aer Lingus, AGL, Uber, and/or Uber Eats do not assume any responsibility for any typographical or other error in the administration of the Offer.
28. Aer Lingus, AGL, Uber, and/or Uber Eat’s collective decision regarding any aspect of the Offer is final and binding and we will not enter into correspondence with Eligible Participants (or their representatives) about it.
