a. Uber Copter is a limited program. Participation is limited to certain groups based on location and other factors. Eligibility is non-transferable. To participate, you must have an Uber account and be in good standing. Guest riders must have their Seat booked by an eligible rider, and be accompanied by and on the same Flight as the eligible rider. Uber reserves the right to determine the eligibility of riders who can book and travel via the Uber Copter Service at its own discretion.
b. Children. Minors may use the Uber Copter Services but must be accompanied by the adult who booked the Flight using the adult’s Uber account. Child safety seats cannot be accommodated on the aircraft; children must be belted in their own seat. Lap infants under the age of 2 years old are permitted and must be held by an adult who is occupying an approved Seat.
c. Passenger Information. In accordance with Uber Copter’s security procedures, the following information will be required of each passenger:
Indirect Air Carrier. Uber is serving as an indirect air carrier pursuant to 14 CFR Part 295 and is serving as an air charter broker. All Uber Copter Flights are operated by FAA/DOT licensed operators, including, but not limited to, HeliFlite Shares, LLC (“HeliFlite”). Uber does not operate flights. Uber has entered into a contract with HeliFlite that stipulates the terms under which HeliFlite will serve as the direct air carrier for Uber Copter Flights. While on a HeliFlite aircraft as part of the Uber Copter Service, passengers are subject to HeliFlite’s insurance coverage; Uber does not directly insure passengers traveling on a HeliFlite-operated aircraft.
a. Fares. Passengers will be shown an upfront price prior to confirming the trip in the App. The price will include the amount paid by you to Uber for the Uber Copter Service (the “Fare”) as well as the amount paid by you to Third Party Providers for the first mile and last mile ground transportation, if applicable. The price for each Seat will be displayed on the App. The amount due will be payable upon completion of the trip. The price you agreed to while booking represents the total cost of the trip, including estimated fees and taxes, and city mandated fees (unscheduled deviations in the ground transportation leg(s), including changing the destination or other unforeseen changes, may cause the total cost to vary). Charges will be inclusive of applicable taxes where required by law. Charges may include other applicable fees, tolls, and/or surcharges including a booking fee, municipal tolls, airport surcharges or processing fees for split payments. As between you and Uber, Uber reserves the right to establish, remove and/or revise Charges for any or all services or goods obtained through the use of the Uber Copter Services at any time in Uber's sole discretion. Uber will use reasonable efforts to inform you of Charges that may apply, provided that you will be responsible for Charges incurred under your Account regardless of your awareness of such Charges or the amounts thereof. Upon request, Uber will provide a full accounting of the cost of the air transportation paid by you as part of the Uber Copter Service.
b. Payments. Uber currently uses third parties to process payments. Uber’s third-party payment processors accept payments through various credit cards, as detailed on the applicable payment screen. All monetary transactions on the App take place in U.S. Dollars.
Passengers must arrive prior to their scheduled departure time for all Flights. Although most Flights will depart as scheduled, occasionally Flights may depart up to 5 minutes ahead of their scheduled departure time due to weather, temporary flight restrictions, airport or air traffic tower congestion, pilot associated requirements or restrictions, or other critical circumstances. Flights will not wait for late passengers, and passengers who miss their Flights may be re-booked on a later flight or moved to alternative transportation to their scheduled destination.
a. You may cancel your Seat reservation(s) for a Flight by providing notice to Uber prior to the scheduled departure time of the Flight. Cancellation may be done through the App. Currently there is no fee to cancel the Flight portion of your trip; however, frequent cancellation of Flights or other abusive practices as determined by Uber may result in the suspension of your eligibility for the Uber Copter Services. Depending on the circumstance, you may incur a fee for cancellation of your first-or last-mile ride, in accordance with Uber’s Terms and Conditions. In the event your Flight is cancelled by Uber after your first mile vehicle is dispatched, you have the option of booking on a different Flight at no additional charge.
b. On occasion, your Flight may be delayed or canceled due to weather, helicopter mechanical issues, airport or helipad congestion, governmental flight restrictions, or other unforeseen circumstances. If your Flight is cancelled or delayed, you will be notified by Uber via the App or email, or other form of communication. Uber will strive to send notifications of delays or cancellations as far in advance as possible. However, weather conditions change rapidly and there may be circumstances in which Flights are canceled or delayed for weather or mechanical reasons up until the departure time.
To minimize the passenger impact of cancellations and delays, Uber may reassign you to a different Flight than the one you originally booked. If for any reason you decline to accept the alternate Flight, Uber will not charge you for your journey.
You are allowed one (1) luggage item and one (1) personal item. Your luggage will be inspected for size and weight upon check-in. Additional baggage or baggage that does not conform to the terms laid out in this section may be refused, or may lead to changes in the Flight schedule in consideration of aircraft weight and balance.
Approved personal items include a purse, briefcase, camera bag, laptop computer bag, or a bag similar in size. The personal item must fit in your lap or by your feet without obstructing any other passenger or your ability to fasten your safety belt.
Approved luggage items must not exceed 62 inches (157 centimeters) combined total length, height, and width, and must not weigh more than 50 pounds (22 kilograms). Luggage will be held in the aircraft luggage hold. Passengers will not be permitted to load or unload luggage from the luggage hold.
Oversized items are prohibited due to size or weight limitations, including but not limited to: golf clubs, surf boards, fishing poles, winter recreation equipment (skis, snowboards), bikes, and motorized wheelchairs.
Baggage may not be left unattended or out of the direct control of the owner, except when passed to a designated baggage handler. Any baggage that cannot be identified or linked to a ticketed passenger or otherwise presents a safety hazard will not be transported on the aircraft. Although Uber will assist you in attempting to recover items or luggage that has been left behind, Uber has no responsibility for left or lost items.
Please note that the following items may not be carried onboard the aircraft: firearms, weapons, lithium batteries (including “smart bags” with non-removable lithium batteries), explosives, aerosol cans, flammables, oxidizers, toxins, radioactive materials, corrosives, e-cigarettes, hazardous materials, and any item included on the Federal TSA Prohibited Item List. Smoking is prohibited in any form while onboard the aircraft.
Pets are permitted to be transported by customers in-cabin. There is no charge to the customer for transporting a pet in-cabin. All in-cabin pets must weigh under 20 pounds (9 kilograms) and be secured in an approved carrier (approximately 12"W X 12" D X 9" H) that will fit comfortably at the passenger’s feet or on the passenger’s lap for the duration of flight. The pet must remain in the carrier for the duration of the flight, while in the heliport, and on the flight line. Any animal that appears aggressive, ill, distressed, or otherwise presenting a hazard to the crew and other passengers’ comfort and safety may be denied transport. Passengers are responsible for complying with any applicable laws and/or governmental regulations of their destinations, including supplying valid health and rabies vaccination certificates when required. All rules about pets are subject to change.
Passengers will be assigned specific seats in consideration of aircraft weight and balance. Passengers are required to sit in their assigned seats, unless directed otherwise by the pilot.
For safety and the comfort of all passengers, no passenger will be allowed to infringe upon the seat of another passenger. It is recommended that if a passenger’s size might infringe upon any part of the adjacent seat, such passenger consider purchasing an additional seat to help ensure the additional space is available. At the direction of the pilot in command, Uber reserves the right to ask any such passenger to exit the helicopter.
Uber and the FAA/DOT licensed direct air carrier that operates Uber Copter flights, may, in their sole discretion, refuse to board a passenger on a Flight, or may remove a passenger from the helicopter for any of the following reasons, including but not limited to: (i) refusal or failure to comply with check-in procedures, such as presenting a valid government-issued photo ID that matches the name on the Uber account; (ii) failure to consent to or comply with any of these Terms; (iii) disobeying any instruction by Uber staff, ground personnel, or HeliFlite personnel, including pilots (“Staff”); (iv) displaying conduct that, in the Staff’s judgement, is abusive, unruly, disruptive, violent, threatening, or otherwise presents a challenge to the safety, health, or comfort of the Staff or other passengers; (v) appearing intoxicated or under the influence of drugs; (vi) positively matching against a name on the “no fly” list, even if this match is in error; (vii) failure to properly schedule travel in advance (e.g., an unscheduled guest or co-rider of a contracted passenger); or (viii) any other reason that in the Staff’s judgement presents a challenge to the safety, health, or comfort of the Staff or other passengers.
Neither Uber nor the direct air carrier will be responsible for the cost of such passenger’s ticket or any other associated costs such passenger may have incurred due to removal from the Flight.
Uber has contracted with third parties to provide various services, including a direct air carrier, heliport operators, security contractors and screening contractors. By consenting to these Terms, you are hereby also consenting to the terms and conditions of each of the third parties.
By participating in the Uber Copter Service, you agree to follow all safety instructions provided by Uber, the direct air carriers that operate flights, third party security contractors, and screening services at all times, including in the event of an emergency or an evacuation. Furthermore, you and your items may be searched or subject to other screening measures prior to or at any point during or after the flight to help maintain the safety and security of Staff and other passengers. You are prohibited from taking or attempting to take actions that may put at risk the safety or security of the Uber Copter Services or any passenger or Staff. Uber, in its sole discretion, may immediately suspend or terminate your access to Uber Copter Services and/or your Uber account if you take or attempt to take actions that may put at risk the safety or security of any Flight or the Uber Copter Services. Additional criminal and/or civil penalties may also be levied against you. Uber reviews all reports submitted to the customer service team and may conduct its own investigation, including if a criminal violation is suspected and/or may refer such suspected violation to the appropriate law enforcement agencies. Cooperation with a law enforcement investigation may, in compliance with applicable laws, result in the disclosure of any or all of your activities on or related to your use of the App.
Modifications. Uber may modify or immediately terminate all or any portion of the Uber Copter Service, including these Terms, in its sole discretion, at any time and for any reason. If you do not agree to modified Terms, you must request to terminate your agreement to the Terms as set forth below within thirty (30) days of the date of the modified Terms.
Termination. Uber may revoke or terminate your eligibility to participate in the Uber Copter Services if you fail to comply with any of the provisions of the Terms. You may terminate your agreement to the Terms by requesting in writing to be removed from the Uber Copter program. This written notice must be provided either (a) by mail or hand delivery to our registered agent for service of process, c/o Uber USA, LLC (the name and current contact information for the registered agent in each state are available online here). Upon any termination, you must immediately cease using the Uber Copter Services.
